Regular Meeting
June 14, 1965
The council of the City of Richf field met in regular session, Monday,
June 14, 1965, in the council.chambers of the City Ha11, 6700 Portland Ave.,
at 7:00 P,M.
The meeting was called to order by Mayor Olson.
Present: Anderson, Jacobsen, Randall and Olson.
Absent: Luettinger {on vacation)
Rev, Lowell A. Reinking, Church of Peace, gave the invocation.
1. Minutes
Motion by Anderson, seconded by Jacobsen, that minutes of the regular
meeting of May 24, 1965 be approved. Ail ayes - carried,

Motion by Anderson, seconded by Jacobsen, that the council authorize
the clerk to advertise for a hearing on the application of Richfield Evan-
gelical Free Church for a zoning variation at 6525 Longfellow Ave.; hearing
to be June. 28, 1965. Ali ayes - carried.
5. Set Date of Hearing - Adj, & A p~ sale - 6805 Harriet Ave.
Motion by Randall, seconded by Jacobsen, that the council authorize
the clerk to advertise for a hearing on the application of Kopp Bros. Con-
struction Co. for a zoning variation at 6805 Harriet Ave.; hearing to be
June 28, 1965. A 11 ayes - carried.
6. Set Date of Rehearing -City Project No. 533 (Storm Sewer)
Donald Fashant, 7341 5th Ave. S., represented some of the petitioners
and stated that the reason for being against the proposed storm sewer was
the high cast of the assessment,
J. C. Wachter, 7313 Clinton Ave., appeared and spoke in favor of the
sewer.
Motion by Randall, seconded by Olson, that the following resolution be

Willis Street represented the Hope Presbyterian church.

8. Hearing -Special Use Permit - 6520 Lyndale Ave. S.
It being 7:15 P.M. Mayor Olson called for the hearing on the applica-
tion of Kenneth Brown, 820 W. 65th St., for a special use permit at 6520
Lyndale Ave. S. and read the notice of hearing.
Lyman Brown, ?329 Bryant Ave. S., represented the applicant.
Dave Swenson, 6029 Chicago Ave., partner, appeared.
The f ollowing stipulations were requested by the council:
1. No demonstrations of bikes.
2. No outside bike storage overnight or outside storage of parts
at any time.
3. No rental of bikes.
Mr. Brown stated there would be no Sunday sales.
Chuck Larson, 5988 Grass Lake Terrace, owner of a Suzuki shop in
South St. Paul, stating he rented bikes and there were no objections.
A petition in favor signed by 23 property owners is hereby filed. C-7603
Steve Meyer, 7332 Lyndale Ave. Sa, of South Lyndale Home Association,
presented a remonstrance petition CC-76041 and requested deferral until after
the Jaycee's study of the Honda Sales question is reported.

Motion by Jacobsen, seconded by Anderson, that the hearing be closed.

Motion by Jacobsen, seconded by Olson, that the council grant the
special use permit to Kenneth Brown, 820 Nt, 65th St., to conduct a sales,
service and repair business of motor-scooters, go-carts and motorcycles,
subject to above three stipulations agreed on by the council. C-7594

9. Hearing - Land Division - 1301 W. ?3rd St.
It being 7:15 P.M. Mayor Olson called for the hearing on the applica-
tion of R. G. Kinsey, 7320 Fremont Ave. S., for a land division and read the
notice of hearing.
R. Kinsey, applicant, appeared.
Mr. Kinney appeared as the real estate representative. No persons ap-
geared in opposition.
Motion by Anderson, seconded by Randall; that the hearing be closed.
Ali ayes - carried.
Motion by Randall, seconded by Jacobsen, that the council approve the
land division for R, G. Kinsey, 7320 Fremont Ave., to divide Lots 2, 3, 4,

It being ?:15 P.M. Mayor Olson called for the hearing on the applica-
tion of Laura C. Kramer, 7648 Penn Ave.. S. for a land division, and read the
notice of hearing.
Clarence Johnson, attorney, represented the applicants.

James Resop of the Towle Co. confirmed option on sale. No persons ap-
peared in opposition.
Motion by Anderson, seconded by Jacobsen, that the hearing be closed.

Motion by Anderson, seconded by Randall, that the council approve the
land division for Laura C. Kramer, 7648 Penn Ave. 5., to divide Parcel 1024,
Plat 44832. All ayes - carried. C-7596
il. Commercial Bldg. Permit - 7527 Lyndale Ave. S.
S. A. Warren appeared as applicant, explaining the franchise operation
with 7:00 A.M. to 11:00 P.M. as hours of operation, 7 days a week. Protec-
tion to residences was discussed.
• Steve Meyer appeared with questions.
Motion by Olson, seconded by Jacobsen, that this matter be deferred to
June 28th for opportunity of applicant to meet with area residents and busi-
nessmen. All ayes - carried,
12. Commercial k idg. Permit - b420 Lyndale Ave. S.
Burt Rutman appeared as applicant. He explained the proposed building
for storage. The attorney suggested a commitment in writing as to its up-
keep, with reviewai in three years for passible extension of two years; and
being razed or replaced at end of five year period.
Motion by Jacobsen, seconded by Anderson, th at the council grant the
commercial building permit to Burton Rutman, 6400 Lyndale Ave. 5., under a
three year temporary permit with renewal for two years if kept in good re-
pair, but being replaced after that time. Ail ayes - carried. C-?597

The Edina council is to receive a copy of this resolution with the
request that they take similar council action on this matter.
14. Authorize Agreement with Henn. County, Hwy. 62,--4th Ave. to 17th Ave. .
Mr« McRay, Asst. County engineer, appeared in explanation of plans;
storm sewer cost discussed; no interchange at 12th Ave.; Richfield's offer
to serve the 30 residents in Minneapolis also discussed.
Motion by Anderson, seconded by Jacobsen, that a letter be sent to the
Hennepin County Board and the City of Minneapolis be contacted by phone re-
questing reconsideration of Richf field°s offer to annex or serve the Minnea-
polis residents in order to avoid necessity of putting a bridge on Blooming-
ton Ave. Ali ayes - carried,.

on this matter until June 28th in order to contact City of Minneapolis on

points stated above for purpose of attempting to save the cost of the pro-
posed Bloomington Ave. bridge on the 62nd St. Crosstown. All ayes - carried.
15. Agreement Btwn. County and Richfield on Traffic Control Signals
Motion by Olson, seconded by R.andail, that the matter of an agreement
between the County of Hennepin and City of Richfield relating to traffic
control signals be deferred until Mr. Fischer can explain to the council the
ramif ications of the agreement. Mr. Fischer is to meet with the Planning
Commission and Safety Council first. All ayes - carried.

20. Water Meter Bids
Motion by Jacobsen, seconded by Anderson, that the minutes of the bid-
opening on water meters, June 9, 1965, be approved. All ayes - carried. C-7601
The manager presented a tabulation of bids together with his recommenda-
tion for award,

low bid of American Meter Controls, Inc, for $43,450.00 as recommended by
the manager, Ail ayes - carried.
The council requested an amendment to the water ordinance to clarify
the section on security deposits on meters.
21. Board of Review Appoizrtment
Motion by Jacobsen, seconded by Randall, that the council concur in the
manager's appointment for one year of the following persons to serve on the
Board of Review as required by Section 7.04 of the City Charters 0. J. Janski
and Glen Do (Dan) Rognrud. All ayes - carried.
22. Extension of Purchase Agreement
Motion by Jacobsen, seconded by Anderson, that-the council make a f final
extension to January 1, 1966 on the purchase agreement of the gravel pit pro-
perty as requested in a letter from Mr. Wolfenson on May 25th. All ayes -
carried,

Mayor Olson as voting delegate to the Detroit National League of Cities Confer-
ence, and that Councilman Jacobsen be designated as alternate. All ayes -

28. Resolution on Apportionment
Motion by Jacobsen, seconded by Anderson, that the council ratify the
resolution to the National League of Cities submitted on apportionment of state

Mayor Olson gave an oral report on the U. S. Conference of Mayors he
recently attended in St. Louis, Mo.
Mr. Jacobsen brought up the storm drainage question of Melvin Olson,
6428 Irving Ave. S.
Mayor Olson read a letter from Naegele Advertising Sign Co. Motion
by Olson, seconded by Anderson, that this matter be placed on the agenda far

A letter was read from Emanuel A. Serstock dated June 10, 1965 concern-
ing the business relationship between Mr. Abendschein and Dr. Blaine, which
