12-14-1964CITY OF RICHFIELD Regular Meeting December 140 1964 The council of the City of Richfield met in regular session, Monday, Decem- ber 14, 1964, in the council chambers of the City Hall, 6700 Portland Ave, at 7:00 P,M, The meeting was called to order by Mayor Olson, Present: Anderson, Jacobsen• Luettinger, and Olson, Absent: Randall (Arrived late) Father C. J. Morrissey, Church of the Assumption, gave the invocation, 1, Minutes .Motion by Luettinger, seconded by Jacobsen, that the minutes of the regu- lar meeting of November 23, 1964 and the special meeting of November 30, 1964 be approved. All ayes - carried. 2. Reports Motion by Anderson, seconded by Jacobsen, that the following reports be accepted and filed: Bldg, Inspection report, Nov, 1964 C-7427 Henn. Amendment to Car Wash Ord, No, 2,12 The attorney read the proposed amendments to the existing ordinance. The council suggested that copies of the proposed amendment be sent to those having pending applications. C-7431 Earle D. Evans of Abel Sanitation, 4317 W. 111th St., appeared. Amendment 10 Auto Livery Ordinance No. 3.09 Bill No. 1964 -14 entitled: 0°'AN ORDINANCE REGUTA TING AND LICENSING AUTO LIVERIES AND TAXICABS IN THE CITY OF RICHFIELD, HENNEPIN COUNTY, MINNESOTA00 was read by the city attorney, the same being on file in the office of the city clerk. C -7432 The attorney explained the position of the Railroad & Warehouse Commis- sion and the necessity of contractual basis to qualify for common carrier. Also, the use if it involves running of errands would require an auto livery license. -3® Dec. 14, 1964 Ted Christian, attorney for Larry Williams, appeared and requested the application for auto livery as applied for under licenses on the agenda be dropped inasmuch as the Railroad & Warehouse Commission had issued their certi- ficate and the .city had no part in the regulation. Motion by Luettinger, seconded by Anderson, that this constitute the first reading of Bill No. 1964 -14, and that it be published in the official newspaper in accordance with Sec. 3.05 of the City Charter. Authorize Call for Bids - Police Cars Motion by Jacobsen, seconded by Luettinger, that the council authorize the clerk to advertise for bids on patrol coaches; bids to be opened Jan. �, 1964. All ayes carried. 70 Hearing - Adjustment & Appeals_- 7336 Blaisdell Ave. It being 7115 P.M. Mayor Olson called for the hearing on the application of R. B. Charlson, 7336 Blaisdell Ave., for a, zoning variation at 7336 Blaisdell Ave, and read the notice of hearing. R. B. Charlson, applicant, appeared; no persons appeared in opposition. Special Use Permit - 7539 Pillsbury It being 7 :15 P.M. Mayor Olson called for the hearing on the application -4- Dec. 14, 1964 of Donald Garrison, 7539 Pillsbury Ave., for a special use permit at 7539 Pillsbury Ave, and read the notice of hearing. Don Garrison, applicant, appeared; no one appeared in opposition. A peti- tion was presented for filing. C -7435 Motion by Anderson, seconded by Jacobsen, that the hearing be closed. All ayes - carried. Motion by Anderson, seconded by Jacobsen, that the council grant the special use permit to Donald Garrison, 7539 Pillsbury Ave., to park rubbish truck (packer body) in his driveway until June 1, 1965. All ayes - carried. C -7436 9. Hearing - Special Use Permit - 7744 Harriet Ave. It being 7s15 P.M. Mayor Olson called for the hearing on the application of Solupak, Inc., 7744 Harriet Ave., for a special use permit and read the notice of hearing. George and Fred Van Dorn appeared as well as Don Balmer, builder. No one appeared in opposition. Motion by Anderson, seconded by Jacobsen, that the hearing be closed. All .yes - carried. Motion by Jacobsen, seconded by Luettinger, that the council grant the special use permit to-Solupak, Inc., 7744 Harriet Ave., to locate gasoline pumps at car wash at 7744 Harriet Ave. All ayes ® carried. C -7437 Councilman Randall joine3the meeting. 10. Hearing - Special Use Permit - 7723 Portland Ave. It being 7s15 P.M. Mayor Olson called for the hearing on the application of Helen Hellman, 1233 Russell Ave. N. for a special use permit and read the notice of hearing, -5- Dec. 14, 1964 Uldis Treiberg, architect, and MroHellman, 620 E. 78th St., appeared. They outlined the proposed nursing home as follows: A 21 story structure; operation to include two nursing stations, each having 4 or 5 employees and service personnel of 5 to 10; the use to be in connection with hospital so that patients would have no cars. James Mahoney, 626 E. 77th St., raised the question of area for grounds and mentioned freeway and area noise as a distracting factor to the home, lack of adequate green area was discussed. Motion by Anderson, seconded by Jacobsen, that the hearing be closed. All ayes - carried. Motion by Anderson, seconded by Jacobsen, that the council grant the special use permit to Helen Hellman, 1233 Russell Ave.. The council recessed for 5 minutes and then reconvened with all members present. 11. Special Use Permit (Deferred) Nicollet. Wentworth, 77th, 78th Mayor Olson called for consideration of the application of Soens Con- struc tion Co., 7720 Pillsbury Ave., for a special use permit, which matter had been deferred from the meeting of Nov. 23rd, Dan Rognrud represented Soens Construction Co. and presented a petition favoring the proposed apartments. C-7439 Warren Roda, 7639 Wentworth Ave., stated he had approval from all owners on Wentworth and Bob Walker, 7638 Blaisdell, told that he had circulated a petition among property owners on Blaisdell Ave. Adequate parking, proper bufferage to residential area, three - bedroom -6- Dec, 14, 1964 town houses adding to the school system, and adjacent property owners'. approv- al was discussed. George Thorsen, 7645 Wentworth Ave,, appeared in favor. Warren Roda brought up storm sewer drainage. Motion by Jacobsen, seconded by Anderson, that the council grant the special use permit to Soens Construction Co., 7720 Pillsbury Ave., for the lo- cation of four 6 -unit apartment buildings (all 3 BR units); three 12 -unit apartment buildings (eight 2 BR and four 1 BR) and four 11 -unit apartment build- ings (all 1 BR units) at the following location: From 1/2 block west of Nicollet Ave, to Wentworth Ave., 77th St, to 78th St. All ayes - carried, C -7440 12. Commercial Building Permit - 7444 Cedar Ave. Philip Hirsch represented the applicant, Hirsch Bros,, Inc, The question of requirement for fencing at 72nd & Cedar Ave. was raised. Sodding to the boulevard at 72nd & Cedar Ave. was discussed. Motion by Luettinger, seconded by Jacobsen, that the council grant the building permit with fence on westerly boundary, landscaping; that tentative approval to the off - street parking layout be granted to meet code and council policy, Poll of votes: Ayes - Jacobsen, Luettinger and Randall. Nays - Anderson and Olson, Absent - none. Carried, 13. Letter on Pension - Richfield Police Dept, Floyd Roman, chairman of the Pension Committee for the Richfield Police Dept, presented the proposal for legislation regarding their retirement system, Sgt, Lundquist and Patrolman Peterson also appeared. Motion by Jacobsen, seconded by Anderson,, that the manager engage an actuarian up to $600,00 appropriation to be transferred from Contingency Ac- count to the Police Account, and that a report to be made by December 280 1964. All ayes - carried. -7- Dec. 14, 1964 14. Bids - Petroleum Products Motion by Anderson, seconded by Luettinger, that the minutes of the bid- opening of Dec. 10, 1964 on petroleum products be approved. All ayes - carried, - C -7441 The manager presented a.tabulation of bids together with his recommenda- tion for award. Motion by Anderson, seconded by Jacobsen, that the council make the follow- ing awards to low bidders as recommended by the manager: for award. Motion by Anderson, seconded by Jacobsen, that the bid of Turnquist Paper Co. for $2,797.40 be accepted as the low bid. All ayes - carried. 16. Bids - Chemicals for Water Treatment Plant Tom Gallagher of Lyon Chemical Co., appeared. Motion by Anderson, seconded by Jacobsen, that the minutes of the bidet opening of Dec. 10, 1964 on chemicals for the water treatment plant be approved. All ayes - carried.
