Ali ayes -~ carried. 12. Legion Lake Storm Sewer Outf ail Cost The attorney explained that the percentage cost to Richfield is the same as when the county had proposed peat storage for the village. The cost to be covered by $20,000 from municipal state aid and $10,000 from appropriations in Pub9:ic Works Reserve Fund as approved i n the 1964 improvement program. Motion by Anderson, seconded by Jacobsen, that the council approve Richfield*s participation in cost for the Legion Lake storm sewer outfall. Ail ayes - carried. 13. Hearing - Special Use Permit 1400 E. 78th St. It being 7:15 P.M. Mayox Olson called for the hearing on the application of Warren Sinclair Car'Niash, 7012 5th Ave. S., for a special use permit a t 1400 S, 78th St. and read the notice of hearing. 'U~.rren Krier, lessee, appeared representing the applicant, Thomas Bouiay requested clarification on whether this operation would be permitted in any gas station, Adequate parking was discussed. The attorney raised the question of whether this was a filling station -4- Nov. 23, 1964 principally and^car wash incidentairy. Fred Van Darn gave information as to the City of Bloomington°s def inition of a car wash. Motion by Anderson, seconded by Jacobsen, that the hearing be closed. Ali ayes - carried. Motion by Anderson, seconded by Randall, that the council grant the special use permit to Warren Sinclair Car 'I9ash, 7012 5th Ave. S., to locate a coin oper- ated car wash in the service station at 1400 B. 78th St. subject to the foliow- ing stipulations: barrier curb on north and east to complete curb around the perimeter of the lot, with no curb running to the building. Mayor Olson called for the hearing on the application of Hirsch Bros., Inc., 3954 Wood dale Ave,, for a special use permit at 7444 Cedar Ave, and read the notice of hearing, James Hirsch appeared as applicant, Comments by the Planning Commission in their report on this property were discussed, No persons appeared in opposition. Christmas Lights on I:yndale Ave. Motion by Anderson, seconded by Jacobsen, that the council approve the -12- Nov. 23, 1964 erection of lights for Christmas on Lyndale Ave. from 62nd St. to 68th St. and that similar requests in other areas should have council approval. A11 ayes - carried. 33~ Appeal to Supreme Court on General Hospital Case The attorney explained the basis of the theory of allocation for educa- tion could be applied to other items. He suggested that the council work with the legislators on clarification of this point.
