Ave, at 7;00 P.M. The meeting was called to order by Acting Mayor Shields. Present: Anderson, Jacobsen, Schultz and Shields, Absent: Olson {On vacation Rev. Harvey A, Childress, Church of Christ, gave the invocation. 1. Minutes Motion by Jacobsen, seconded by Shields, that the minutes of the regular meeting of May 28, 1962, and the special meeting of June 4, 1962 be approved. All ayes ., carried', 2. Petition to Rezone Property - Portland & 76th St. Pf letter was read from A. G. Bogen, dated June 1, 1962, requesting a deferral of his request to rezone property on the west side of Portland Ave. from 76th St. to 77th St., which matter had been deferred from the meeting of May 28ths Motion by Anderson, seconded by Jacobsen, that the request of A. Acting Mayor Shields called for the hearing on the application of Gilliam Naiditch and read the notice of hearing. The son of TNilliam Naiditch appeared. Irving Sunn, attorney, repre- seated the applicant. No persons appeared in opposition, A discussion was held on the proposed apartments. It was stated by the attorney that he had made the application in error by submitting the number of apartment!~units in each building to be different, Motion by Schultz, seconded by Jacobsen,. that the hearing be closed. All. ayes - carried. Motion by Schultz, seconded by Jacobsen, that the council authorize the clerk to set date of hearing for a new application of Wm. Naiditch, 455 Rice St., Ste Paul for a special use permit at 7721 and 7733 Emerson Ave. and 1100 and 1112 cif. 78th St. for three 17-unit and one 13 unit apartment buildings; hearing to be June 25, 1962. LeFevere in which he presented an opinion that the council lacked authority to issue a permit for the construction of an industrial building in a gener~ al commercial district such as this proposed buildings Motion by Jacobsen, seconded by Schultz, that the council deny the request of Gm B. Strom, 6617 Humboldt Ave. S,, for a commercial building permit to construct a building at 717'U0. 65th St. All ayes ~ carried. -8- June 11, 1962 15. Letter on Sunday Closing Sam Rutman, owner of the Lyndale Fruit and Vegetable Market, 6412 Lyndale Ave., appeared regarding the Sunday closing ordinance. It was agreed that an amendment should be made to the Sunday elosing ordinance covering the sale of fruits, vegetables and plants in a place exclusively for sale of such, but that the sale of firewood on Sunday was prohibited.
