council chambers of the Village Ha71, Monday, November 10, 1958 at 7:00 F.Mr
The meeting eras called to order by Mayor Keldsen.

Donald Lundquist, 61400 Pillsbury Ave. appeared making inquiry as to
whether or not lots would be graded to street level and whether there would
be a retaining wall, also inquiring as to the grading of street levels.
The council stated that discussion of street levels would take place at
time of building permit consideration,

Zoning must not discriminate between property owners.

It has already been determined that the owner could-have apartment permit
an this type of property and refusal here would have to b® on special
circumstances and there do not appear to be such.
There is no traffic problem.
Esthetics is not a legal basis for refusal of the permit and there is no
other basis ion the attorneys opinion.
Two auc~ permits have been previously issued in this area.

Mayor Keldsen called for the hearing on the rezoning of property known
as 6709 Lyndale Ave. which matter had been deferred from the last regular
meeting.

Jerome Blatz, attorney, appeared representing the applicant, J. L.
Willsey, 6709 Lyndale Ave., explaining that the rezoning of property is
necessary 3.n order to use lot for parking in conjunction with restaurant
on the Robert Broad property on Lyndale Ave.
Lorin Gastorland, 6716 Garfield Ave., appeared opposing the rezoning
and read a letter from an appraisal firm on the effect on appraised value
of homes in the area.
