The council of the Village of Richfield met ~n re~iiar Session, Monday, March 11, 195? at 7:Q0 P.M. in the a~uncil chambers of the Village Hall, 6?00 Portland Ave. The meeting was called to order by Mayor Kit tell. Present: Wa11ic&,, Shields, Serstock, Schultz and Kitten. Rev. Edwin C. BilertsenA St. Nicholas Episcopal Church, gave the invo- cation.. 1. Minutes Motion by Schultz, seconded by Shields, that the minutes~of the regular meeting of February 25, 1957 be approved. Carried.. 2. Reports Motion by Serstocks seconded by Schultz,. that the following reports be accepted and filed: Hennepin County Relief February 1957 C-4464 Inspection Sept, Report February 195? C-4465 Carried. 3, Annual Financial Statement Motion by Serstock, seconded by Schultz, that the financial statement for the Village of Richfield for the year 195 6 be accepted and filed and be published in the official newspaper. Motion by Serstockp seconded by Shields, that the council authorize the clerk to advertise a hearing on the rezoning of Lot il, Richfield Gar- dens, excepting the north 330 ft. thereof; hearing to be Mondays March 25, 1957 at 7:15 P.M. Desi nation of Village Tree A Letter from the Richfield Garden Club dated February 27, 195?, was read relative to the designation of 'Che "floweringcrab" as the official. tree of the village. Mrs. George Moen appeared representing a group of garden club members. Motion by Schultz, seconded by Shields, that the council officially de- signate the village tree to be the "f lowering ¢rab". Carried. 6. Commercial Permit & Off-Street Parking - 6535 Portland_Ave. Motion by Shields, seconded by Serstock, that the commercial building permit be granted for J.°.. Schweim, 6550 Portland Ave., said permit for a retail sales and repair lawn equipment and skates at 6535 Portland Ave. Carried, C-4~P6? Off-Street Parking - Oak Grove Lutheran Church Motion by Shields, seconded bq Serstockp that the council grant tenta- five approval for the off-street parking layout for Oak Grove Lutheran Church, W. 71st St. & Lyndale Ave. S., and authorize the drawing of a contract. Carried. $. Hearing -Special Use Permit - 6745 Cedar Ave. It being 7:15 P.M., Mayor Kittell called for the hearing on the special use permit of Robert C. Jorgensen and Ben UV. Jorgensen for a gasoline fili- ing station at 6745 Cedar Ave. and read the notice of hearing. Robert C. Jorgensen, 1537 Maynard Drive,, St. Paul,, and Ben W. Jorgensen, b539 Cedar Ave., applicants, appeared in their own behalf. -3- March 11, 195? No persons appeared in opposition. Motion by Shields, seconded by Serstock, that the hearing be closed. Carried, Motion by Shields, seconded by Serstock, that the council grant the request of Robert C. and Ben W. Jorgensen for a transfer of their special use permit from 6601 Cedar Ave. to 6745 Cedar Ave., a relocation of their present gasoline filling station. Carried. C-4468 9. Hearing - Vacate Portion Rate Drive Tt being 7:15 P.M., Mayor Ritteil called for the hearing an the vacat- ing of a portion of street on Rae Drive and read the notice of hearing, James Rae and Mrs. Rae appeared as applicants.. No persons appeared in opposition. Motion by Shields, seconded by Schnitz, that the hearing be closed. Carried. Motion by Shields, seconded by Schultz, that the council not vacate at this time the west portion of Rae Drive which was designated to be used as a Cul-de-sac, but reconsider the matter at the time of developing the Rae property or the construction of 65th St. Carried.. 10. Bids - Crushing Gravel Mayor Kitteil read the minutesof the bid opening for. the crushing of gravel dated March 6, 195?. Motion by Shields, seconded by Serstock„ that the minutes of the bid- opening dated March 6, 1957 be approved., Carried, C-4469 The managers tabulation and recommendation for award was presented. Motion by Schultz, seconded by Shields, that the low bid of Earthmovers, Inc. for a total of $2,560.00 be accepted as recommended by the manager. Carried. -4- March 11, 1957 11. Division of Land .. Division of Land - 6433 to 6449 Girard Ave. S. w~r.~ It being 7:30 P.M,, Mayor Kitteii called for the hearing on the land division of E. S. Stiles, 6449 Girard Ave.. S. and-read the notice of hearing. No persons appeared. Motion by Serstock„ seconded by Schultz, that the hearing be closed. Carried. Motion by Serstock, seconded by Schultz,-that the council grant the land division for B. C-4471 14., Petition -Sanitary Sewer - W« 71; 5t. Mayor Rittell read a letter dated Pebruary 18, 1957 from Richard M. '~ Report on Petition to reconsider Special Use Permit--1001 B. 66th__St. The manager presented a report of the Village Bngineer dated February 28, 1957 containing information on the contemplated drive-in at 1001 East 66th St. Motion by Serstock, seconded by Schultz, that the council accept the report indicating that the proposed drive-in would not be built. Carried. 16. Army Reserve Program Col. Nei son and Lt. Lavern F. Sykora appeared before the counci 1 to outline a proposed Army Reserve Program in Richfield. A discussion followed. 17. It was agreed without vote that the bid of the low est responsible bidder. be accepted. In the event bids. are identical, the choice shall be made by lot- except that the bid of a Richfield business shall be accepted if all other factors are equal. 1 32. Load Limits for 1957 A memorandum from the village engineer. dated March 11, 1957 relative to load Limits of vehicles on village streets was presented by the manager. Motion by Shields, seconded by Wallick, that the council approve the _il_ March llq 1957 engineer's order limiting the load of vehicles on village streets in acs cordance with Section S of Ordinance No. 10.08, an ordinance providing for seasonal load prohibitions or restrictions. Carried. 33..
