The council of the Village of Richfield met in special session in the
council chambers of the Village Halls 6700 Portland Ave., Monday,. Septem~-
ber 17,, 1956 at 8:00 P.M,
The meeting was called to order by Mayor Kitteli,
Presents Wallick, Shields, 5erstock„ Schultz and Rittell,
Absent: None.
A11 members of the council.waived notice of tali of this special
meeting.
Mayor Kittell appointed Clayton L, LePevere as Clerk pro tea: to
record the minutes of this meeting in the absence of Village Clerk, Paul
H, Haugen,
1. MacGr~e ar ~t Damta vs. Richf ieid
A9r. Raya-ond Scailen and Mr, Charles Howard of the law firm of Faegre
& Benson appeared before the council to explain a proposed settlement of
the legal action being t,~ied in the District Court of Hennepin County,
wherein the engineering firm of MacGregor :tnd Davis was suing the Village
of Richfield for an amount in excess of $379.000 for engineering services
in connection with sanitary sewers. A proposed settlement of ail claims
in existence Y~etween said engineers and the Village of Richfield for the
sum of $76,~ was recommended by these attorneys and by the village at-
torney.
Nation by Sbieids, seconded by 5erstoek, that the council approve
the proposed settlement upon the condition and understanding that all

such settiem~'b and that such settlement be approved by the District Court
of Hennepin County; and that the village attorney and the law firm of
Faegre & Benson be authorized and directed to take such action gs might be

Nays - none. Absent - none. Carried.
2. Commercial Bldg. Permit - Tisdel
Motion by Shields, seconded by Schultz, that the council grant the

applica#ion of A. V. Tisdel for a commercial building permit to construct
a gasoline service station at 6545 Penn Avenue South. Carried. C-4303 A
Motion by Shields, seconded by Schultz, that the council authorize
the preparation of an off-street parking agreement for 6545 Penn Avenue
to be presented at a subsequent council meeting for the council's consider-
ation. Carried.

Motion by Shields, seconded by Serstock,. that the meeting be ad-
journed; Carried..
