NMETING September 19j 1955 i i Pursuant to council action on September 129 1955, the Village Council of the Village of Richfield met at an adjourned meeting, Monday, September 19, 1955, in the Village Hall, 6700 Portland Ave., at 7:00 P. M. The meeting was called to order by Mayor Kittell.. Present: Rose, Shields, Wallick and Kittell.. Absent: Walters. 1. Hearing on Rezoning - Gilbertson Pursuant to council action of September 120 1955, Mayor Kittell called for the hearing on rezoning of the NZ of Lots 19, 20, 211, 22, 23, and 24, Block 4, Lyndale Shores on Woodlake- -from residential to commercial. Mayor Kittell read a letter dated September 91. 1955, from Warren Zetzman objecting to the rezoning of the above described property from residential to commercial.. Motion by Wallick, seconded by Rose, that the letter from Mr.. Warren Zetzman, 6733 S. Lyndale Ave., relative to the rezoning of Ni of Lots 19, 20, 211; 22, 23 and 24, Block 4, Lyndale Shores on Woodlake, from residential to commercial, be accepted and filed.. Carried.. C -3177 Mayor Kittell read a letter from Richfield State Agency, Inca, 6608 Lyndale Ave.. S,, withdrawing their name.from the Norman Gilbertsen petition filed August 3„ 1955, pertaining to the land in the vicinity of 67th and Lyndale Ave.;-.also a letter from Mrs. H. C. Fowler, 714 Lake Shore Drive, with - drawing her signature from the Norman Gilbertsen rezoning petition. Motion by Wallick, seconded by Rose, that the letter from the Richfield State Agency, e letter from Mrs. H. C. Fowler, relative to the withdrawal of their signatures from the petition to rezone the N2 of Lots 199 209, 21„ 22,,23, 24, Block 4;, Lyndale Shores on Woodlake, be accepted and filed. -2- September l9, 1955 Carried. This resolution appears as ,resolution Non 889 i' -6- September 19, 1955 12. Report on Method of Assessing Storm Sewer Projects Robert Carroll of G. M. Orr Eiigineerifig Co. appeared betbre the council and presented a report embodying four possible methods of assessing for storm sewer projects. A discussion followed. Motion by Shields, seconded by Rose, that spreading of assessment rolls for storm sewer construction shall be by one of the following methods in the discretion of the administrative staff; provided that variations shall be allowed to equalize assessments within storm sewer districts: DIRECT BENEFIT - NO EQUALIZATION IN DISTRICT 1) The trunk sewer shall be assessed over the entire district equally if it is installed complete on one construction project.. If the trunk sewer is installed in more than one construction stage, the total cost of the re- maining trunk sewer shall be estimated based on the last construction pro- ject and an assessment rate computed for total area served.. The area fully served by the.trunk sewer extension shall be assessed this computed rate and the balance of the project cost assessed against theproperty not fully served. If the total trunk sewer cost is less than the amount to be as- sessed under this method, the entire cost of the trunk sewer shall be as- sessed only against the area fully served. 2) The balance of any storm sewer construction project shall be assessed against the directly benefitted areas. 3) Future construction areas in the same district will have to share in ad- ditional trunk sewer costs.as they are installed and bear the entire cost of sewer installed to completely serve them whether equal to previous as- sessments or not. 4) One parcel of land may receive several assessments for trunk sewer before it is completely served and fully.assessed. DIRECT BENEFIT - FIRST ASSESSMENT BASED ON ESTIMATED TOTAL COST FOR DISTRICT - NO EQUALIZATION IN DISTRICT. 1) The cost of the sewer to complete the entire district shall be computed based on'the first construction project in the district that completely serves an area, and a rate for the entire district computed. 2) The area to be fully served shall then be assessed at the rate computed in step 1 above. -7- September 190' 1955 3) The balance of the cost of the first project in the district shall then be assessed against the area not fully served. If the total cost of the j project is less than the amount to be assessed against the area fully served under this method, only the cost of the project can he assessed and shall be assessed only against the area fully served. 4) Future construction areas in the same district shall have the assessments calculated under the same method with the exception that the areas pre- viously completely served shall not be included in the assessment. 5) One parcel of land may receive several assessments before it is completely served and fully assessed..
