The council of the Village of Richfield met in regular session in the council
chambers of the Village Hall, 6700 Portland Avenue, Monday, August 22, 1955 at 7:00
P.I.
The meeting was cati le d to order by Mayor Kittell.

It being 8:00 P. M. mayor Kittell called for any outstanding bids. None
were f orthcoming. Motion by Wallick, seconded by Rose that no further bids be
received. Carried.
7. Hearings on Proposed Assessments for Various Projects. (Continued)
Village Project No. 306. No persms appeared.
Village Project No,, 316. Iir. Frank Delay, 7121 4th Avenue, appeared in ob-
jection, and requested tYat the assessment be reduced to 20% and 80% on ad valorem
taxes. Hr. Mortenson, 7109 4th Avenue South, appeared to ask if he could construct
a concrete sidewalk rather than the bituminous sidewalk. He was advised he could
do this at his own cost. No other persons appeared.

Village Project No. 296.. Councilman Rose presented a petition requesting
assessment for grading 71st Street from 4th Avenue to Portland Avenue on a
village -wide basis.

petitioners present objecting to being assessed. Gail C. Hookers 7100 Portland
Avenue appeared in opposition to the pso posed assessment.
Motion by Wallick, seconded by Shields, that the Manager, the Engineer and
the Attorney study and recommend equalization of .this assessment. Carried.
Village Project No.. 308. Nir. Boyd Aldrich, 324 ' Apple Lane, appeared to
object to his assessment on Village Project No. 308.
Motion, by Walters, seconded by Rose, that the council consider revision of
the assessment of Parcel 7731, Plat 45850, after 1vir. Aldrich, the Manager and the
Engineer have conferred. Carried,

Village Project No. 225. Mr,, Frank Riley, 6343 Wentworth Ave.. appeared
in objection to the assessment for Village Project No: 225.
Motion by Shields, secorAed by Rose, that the council defer action on the,
assessment on Village Project No. 225 until the next regular meeting, September
120 1955, and request a representative of the G. M. Orr Company to be present
with information relative to the establishment of the charge of $25,000 to
Richfield Plaza. Carried.
Village Project No. 239. Robert Meintm, 6945 Harriet Avenue,' appeared
as spokesman for a group of fifteen property owners objecting to the assessment
for Village Project No. 239.
Motion by Walters, seconded by Rose, that the proposed assessment on
Village Project No. 239 be referred back to the Manager and Engineer for pre-
partition on the basis of 20% special assessment and 80% ad valorem tax.'Carried.'

The Manager reported on tabulation of bids for storm enclosure for liquor

Motion by Walters, seconded by Wallick, that the bid cf Adams Construction Co.

in the amount of $1,252.00 be accepted. Carried.
11. Hearing. Rezoning - Broad & Gilbertson.
The Manager reported that the applicants had withdrawn their request to re-
zone from residential to commercial the following property:
- NJ of Lot 19, Lots 20, 212 22, 23, and
24 of Block 40 Lyndale Shores on Woodlake.
Mayor Kittell read a letter from Broad and Gilbertson.
Motion by Wallick that there be no hearing on the application to rezone the
above described property inasmuch as the applicants have withdrawn their request.
Notion withdrawn.
Motion by Walters, seconded by Wallick, that the hearing on the application
to rezone the NJ of Lot 19, and Lots 20, 212 22, 23, and 24, of Block 4, Lyndale
Shores on Woodlake, be adjourned until 8 :00 P. iii. September 12, 1955._ Carried.
Motion by Wallick, seconded by Walters, that the village Clerk be and
hereby is authorized to publish notice of adjourned hearing on the retuning of the
Ng of Lot 19, and Lots 20, 21, 22, 23 and 24 of Block 4, Lyndale Shores on

commercial, at 8 :00 P. M. September 12, 1955

12, Hearing, Special Use Permit - Byrd.
Mayor Kittell called for the hearing on the. Special Use Permit of Everett B.
and Alveda L. Byrd, to establish a drive -in cafe "Bast side of Portland Avenue and
North of the Shell Oil Station, 66th Street and Portland Avenue ", and read the
notice of hearing.
Councilman Shields presented a petition with seventeen signatures opposing
the granting of this special use permit.
Motion by Shields, seconded by Rose, that this petition be accepted and filed,
Mr. Everett B. Byrd, 6231 Pillsbury Avenue, applicant, appeared before the
council in support of his application.
Mr. Henry E. Lundquist, 6520 Portland Avenue zp peared as spokesman for a
group of property owners, opposing the application of Mr. Byrd,
Mr. Ray Anderson, 6625 Portland Avenue, 4peratar, appeared before the council;
he exhibited plans and explained the proposed operation.
Mrs. Francis McCarthy, 6505 Portland Avenue, appeared in opposition.
Mrs. Evelyn Alstrgp, 6507 Portland Avenue, spoke in opposition.
Mr. Francis NcCartby, 6505 Portland Avenue, appeared in opposition*
Pars. June Lundquist, 6520 Portland Avenue, appeared in opposition.
Motion by Shields, seconded by Wallick, that the hearing be closed. Carriedi

Portland Avenue on.the basis of traffic hazard, on the basis of depreciation of
value of residential property and because of denying a drive .-in cafe on the
Southeast corner of 66th Street and 5th Avenue for the same reasons,

Motion by Rose, seconded by Walters, that the council grant the recpest of
Everett H. and Alveda L. Byrd, for a special use permit to establish a drive -in
safe at 65th and Portland Avenue, subject to the applicant entering into a special
use contract to be submitted to the council at a later date.
