V.ILIAGE CF RICHFIELD REGUNa = ING December 13, 1954 The council of the Village of Richfield met in regular session in the council chanbers of the Village Half 6700 Portland Ave. South, at 7:00 P. M., Monday, December 13, 1954. The meeting was called to order by Mayor Kittell. Present: Walters, Shields, Wallick and Kittell. Absent: Rose. Reverend C. M. Johnson, Oak Grove Lutheran Church, gave the invocation. 1. Minutes Motion by Wallick, seconded by Walters, that the minutes of the regular meetings of November 22nd and December 6th, 1954; and the adjourned meetings of November 24th, November 29th and December 8th, 1954 be approved. Carried.. 2. Reports Motion by Shields, seconded by Wallick, that the following reports be ac- cepted and assigned clerk's file numbers: Inspection Report - November, 1954 C -1879 Relief Report - November, 1954 C -1880 Carried, 3. License Application - Ohnstad Ray Ohnstad, 5533 - 33rd Ave. S., appeared before the council to request a Christmas tree license on property known as 6509 Standish Ave. Motion by Wallick, seconded by Shields, that the application of Ray Ohnstad, for a license to sell Christmas trees at 6509 Standish Ave., be granted. Carried. 4. Suspension of Beer License- -Roy & Bob ' s Milk House The manager read a report from the police department dated December 1, 1954, pertaining to violations of a beer license for the Roy & Bob's Milk House. C -1887. -2- December 13, 1954 P. V. Mabry, attorney representing Roy & Bob's Milk House, appeared before the council; Robert M. Bottolene and Roy H. Johnson, co- owners, also appeared. Motion by Wallick, seconded by Wa]1ick, that the council suspend the license for the remainder of the year 1954. Carried. 5. Hearing -Plat of Strand.-Bowen Addition It being 7:30 P. H,, Mayor Kittell called for public hearing on the plat of Strand -Bowen Addition, and read the notice of hearing6 Mri Oscar Strand appeared in behalf of the new plats No persons appeared in opposition. Motion by Walters, seconded by Shields, that the hearing be closed. Motion by Walters, seconded by Shields, that the council authorize the engineer to negotiate a contract between the developer and the village and present it to the council for approval; Carried. 6. Bill No.. 1954 -24 (Heating & Electrical) C -1876 Bill No. 1954 -24 entitled "AN ORDINANCE RELATING TO HEATING AND ELECTRICAL I16TALLATIONS, ADOPTING CERTAIN ORDINANCES CF THE CITY OF MINNEAPOLIS BY REFERENCE" was read by the village attorney, the same being on file in the office of the village clerk. C -1876. R. F. Melohy, 6730 Harriet Ave. So., appeared recommending that an ordinance other than the Minneapolis electrical code be adopted. Motion by Wa]1ick, seconded by Shields, that this constitute the second reading of Bill No. 1954 -24. Poll of votes,: Ayes - Walters, Shields, Wallick and Kittell. Nays - none. Absent - Rose, Carried. Motion by Wallick, seconded by Shields, that the Council adopt Bill No. 1954- 24; that it be published in the official newspaper; that it be spread in the ordinance book and made a part of these minutes. 1 -3- December 13, 1554 Poll. of votes: Ayes - Walters, Shields, Wallick and Kittell. Vacating Streets & Alleys Motion by Shields, seconded by Wallick, that the following resolution be adopted; that it be spread in the resolution book and that it be made a part of these minutes: RESOLUTION NO. 563 RESOLUTION VACATING STREETS AND ALLEYS OF BLOCES 2, 3, 10 and 11., LUGSBURG PARK ADDITION Poll of votes_: Ayes - Walters, Shields, Wall ick and Kittell. Nays - .none. Absent - nose. Carried. 8.. Hearing - Plat of Smie ja I s addition It being 8:00 P. M., Mayor Kittell called for the public hearing on the plat of Smiejals Lddition, and read the notice of hearing. No persons ap- peared in opposition.. Motion by Wallick, seconded by Shields, that the hearing be closed, Carried. Motion by Wallick, - seconded by Shields, that the council authorize the village engineer and attorney to negotiate a contract with the developer and present it to the council for approval. Carried. 9. Hearing - Plat of Thernell. 2nd addition It being 8:00 P. M., Mayor Kittell called for the public hearing on Thernell* 2nd addition, and read the notice of hearing. No persons appeared in oppositionFl Motion by Wallick, seconded by Shields, that the hearing be closed. Carried. Motion by Wallick, seconded by Shields, that the council authorize the village engineer and the attorney to draw up a contract with the developer and present it to the council for approval, Carried, -4- December 13! 1954 10. Hearing - Rezoning of Nicollet LLve, between 66th -& 67th Sts.. , Herbert W. Olson, 6638 lst Ave. So., appeared as spokesman for neighbors opposing the change of zoning of Nicollet live. between 66th & 67th Sts:, and presented a petition. Motion by Wallick, seconded by Shields, that the petition of 25 signatures protesting the change of honing on Nicollet Ave. between 66th and 67th Sts. be accepted and filed; Carried. C -1881. Darrelk N. Kf.assy, 6635 Nicollet Ave., one of the applicants for the re- zoning, appeared in favor of the zoning change. F. B,. Fitzgeraldi 66111 Nicollet bve., expressed agreement to the rezoning of the S. 1/2 of the W. 1/2 of Lot 12j Goodspeed's Second Plat, and the W: 1/2 of Lot 11, Goodspeed's Second Plat. Clifford Phernetton, 6621 1st kvei, spoke in opposition to the change of zoning. Motion by Wall icki seconded by Shields, that the hearing be closed. Carried. Motion by Wallick, seconded by Shields, that action on this zoning be de- ferred until Monday, December 27, 1954, at which time the village administra tive officers shall present a report on the requirements of the Red Owl Food Stores, Inc., under their contract, and the status of the operation of the beauty parlor at 6635 Nicollet Lve. Carried. 11. Hearing - Rezoning bf Southeast Corner of intersection of Lyndale & 67th St. It being 8:00 P. M., Mayor Kittell called for the hearing on the rezoning of the intersection of Lyndale .Lveo and 67th St., and read the notice of hearing. Mayor Kittell read the letter from Dr. Earl M. Campbell dated Nov.. 11, 1954, and filed Nov.. 29, 1954 - -C -1871 Lorin Gasterland, 6716 Garfield Ave., appeared as spokesman for a group of -6- December 13, 1951 Lotion by Wallick,, seconded by Shields, that the report be accepted and filed. Carried. 16. j Preliminary Plat - Christian's 2nd Addition Motion by Walters, seconded by Wallick, that the council tentatively ap- prove the preliminary plat of Chris tiant s 2nd Lddition and authorize the clerk to advertise a public hearing for 8:00 P+ Mj,,, Monday., December 27, 1954. Carried. 17. Heating Basement of Village Hat l Motion by Shields, seconded by Wallick, that the bid of the Domestic Heating Co. for a heating plant for the basement in the Village Hall and a portion of the upstairs area.in the amount of $1227.00 be accepted, that the bid security of the unsuccessful bidders be returned forthwith and that the bid security of the Domestic Heating Co. be returned upon execution of a contract and the furnishing of a surety bond. Carried. .,I- December 13, 1954 18, Club Liquor License - V. F. W. An application for a club liquor license for the V.F.W. was presented. Motion by Wal]ick, seconded by Shields., that this matter be deferred until the regular meeting on December 27, 1954, pending investigation. Carried. 19. Division of Land - Penn Development Co. Motion by Wallick, seconded by Walters, that the request of Penn Development Co, to divide Lot 7, Richfield Gardens, be granted. Carried. C -1884. 20. Petition -.
