09-28-1953VILLAGE CF HE CHFIELD REGULAR MEETIN G September 28, 1953 Pursuant to due call and notice thereof, the council of the Village of Richfield met in regular session in the Village Hall, 6700 Portland Avenue S., at 7 P. M. on Monday, September 28, 1953. Present: Walters, Rose, Shields and Iverson. Absent: Reller. 1, Minutes, Motion by Shields, seconded by Rose, that the minutes of the regular meeting of September 14, 1953 be accepted. Carried. 2. Report. Motion .by Shields, seconded by Rose, that the council accept and file the report of the Rural Hennepin County Nursing District for June, July and August, 1953. C -985. Carried. 3. Village Project No. 128. Village wide oiling program, 1952. Vice - President Iverson read the notice of hearing on assessments on Village Project No. 128.. Mr. Al Trapp, 7515 5th Avenue South; appeared relative to the condition of 5th Avenue from 75th to 76th Street. He was not appearing in opposition to the assessment. No other persons appeared. Motion by Walters, seconded by Shields, that the hearing be closed. Carried. 4. School Traffic Signs. The manager read letters relating to school traffic signs from the Church of Saint Richard (C -986) and Eliot School PDk (C -987). Motion by Walters, seconded by Shields, that the Engineer be instructed to install flap type school stop signs at the intersection of 70th Street and Elliot Avenue and 70th Street and 10th Avenue. Carried. 5. Village Project No. 139. S tree t Improvement. Vice - President Iverson read the notice of hearing on assessments on s tree t improvement, V. P. No, 139. No persons appeared. Notion by Shields, seconded by Walters, that the hearing be closed; Carried. 6. Minutes - Zoning Commission. The Manager read the minutes of the Zoning Commission meeting held on Tuesday, September 22, 1953. C -989. 7. Rezoning - Penn Avenue at 73rd St. Motion by Walters, seconded by Shields, that the council concur with the recommendation of the Zoning Commission that the W2 of Parcel No. 8700, Section 33, Township 28, Range 24, the Southeast corner of the intersection on which there is an existing oil station, be rezoned to commercial from residential. Carried. C -990. T€ 9/28/53. S. Calvary Lutheran Church. Notion by Shields, seconded-by Walters, that the council concur in the recommendation of the Zoning Corr fission to grant a special use permit to the Calvary Lutheran Church for the construction of a day school and parish house on part of Block 13, Girard Parkview Addition, being on 16th Avenue South between 65th and 66th Street, Carried., C -991. Motion. by Walters, seconded by Shields, that the council grant Calvary Lutheran Church a commercial building permit for the construction of a day school and parish house as above described, providing that this and future build- ings conform to the existing set -back on the East side of 16th Avenue between 65th and 66th Streets; and further moved that all fees in connection with this J permit be waived. Carried. C -992. 9. School Traffic Signs. The manager read a letter from A. C. Carlson, 6820 Grand Avenue, relative to insta11at3on of school traffic signs at Harriet Avenue South and 70th Street, C -993• Motion by Shields, seconded by Rose, that the Engineer be instructed to install flap type school signs, if recommended by the Police Department, Carried, 10. Village Project No. 1". Grading Blaisdell Avenue, 64th to 642 Street. Vice - President Iverson read the notice of hearing on assessments for street improvement, Village Project No. 144. Wm. Rebman, 6414 Blaisdell and 'Dennis Ferrell, 6420 Blaisdell Avenue, appeared to inquire about the proposed assessment on their properties. When informed of the amount of their assessments they were not opposed. -No other persons appeared. Motion by Walters, seconded by Rose, that the hearing be closed. Carried. Motion by Walters, seconded by Shields, that the following resolution be adopted; that it be spread in the resolution book- and that it be made a part of these minutes. Carried. RESOLUTION NO. 208 RESOLUTION C CNFI RMING THE ASSESSMENT FOR VILLAGE PRUJ'ECT NO, 144 C(FSIST- Poll of vote's: Ayes - Walters, Rose, Shields and Iverson. Nays - none. Absent:Reller. This resolution appears as resolution No. 208 in resolution book No. 1. 21. Rezoning - 66th Street and Xerxes. The k wager read a letter from Bert Lundin, 3015 West 66th Street, requesting rezoning from residential to commercial Lots 4 and 5, Block 8, Tingdale Brothers, Lincoln Hills Addition, being the southeast corner of Xerxes Avenue and West 66th Street. Notion by Walters,- seconded by Shields, that the council refer to the Zoning Commission for a public hearing, Tuesday, October 20, 1953 at 8 P. M., the rezoning of Lots 4 and 5, Block 8, Tingdale Brothers, Lincoln Hills Addition, and that the Cleat be authorized to advertise such hearing. Carried. 10 9/28%530 32. Sanitary Sewer Assessments, The Manager read a letter from Anton J. Meaning, 702 E. 66th Street and Ed Olson, 704 E. 66th Street, relative to assessments' for sanitary sewer inter- ceptors and laterals on their property. C -994, 13. Bids - Snow Plowing. The manager read the advertisement for bids on Village Project No. 208, - Bituminous Surfacing. The following bid was-received: Jay W. Craig Co,, - Bid Security 5% Bid Bond - in the total amount of $21,683.67. Motion by Shieldq, seconded by Walters, that the bids be closed; Carried. Motion by Walters, seconded by Shields, that the following resolution be adopted; that it be spread in the resolution book and that it be made a part of these minutes. Carried. RESOLUTION NO. 209 RESOLUTION ACCEPTING BIND AND AWARDING CONTRACT CV BITUMINOUS SURFACING, V.P. NO. 208. Poll of votes: Ayes - Walters, Rose, Shields and Iverson. Nays - none. -Absent - Reller. This resolution appears as resolution No. 209 in resolution book No. 1. 15. Hearing - Proposed Budget (1954) . The Manager read the notice of hearing on the proposed 1954 budget. The proposed 1954 budget was read by the Manager. No persons appeared. Motion by Walters, seconded by Rose that the hearing be closed, Carried, Motion by Walters, seconded by Rose, that the council lay aside consider- ation of the proposed 1951 budget at this time and continue with the remainder of the i tems on the agenda. t 16. Village Project No. 225, Stone Sewer. Vice - President Iverson read the recommendation of the Engineering Committee 4 - 9128153. of its September 21st meeting that the council authorize the preparation of the plans and specifications, advertise for bids and order a public hearing on the constraction of the storm sewer outfall basin on 65th Street from Pleasant Avenue to Grass Lake. Motion by Walters, seconded by Shields, that the following resolution be adopted; that it be spread in the resolution book and that it be made a part of these minutes. Carried. Lotion by Rose, seconded by Iverson, that the council refer the problem of assessment on Village Project No. 225 to the Finance Committee for consideration at its meeting on October 5, 1953, and notify Wm. Rebman, Dennis Ferrell, TPArcy Leek, and Mr. Catanach. Carried. 18. Drainage. 3rd Avenue & 69th Street, Vice - President Iverson read the recommendation of the Engineering Committee made at its meeting September 21, 1953, relative to recommending that the G. M. Orr Company be authorized to prepare plans and specifications for drainage in this area. Motion by Walters, seconded by Shields, that the G. M. Orr Engineering Company be authorized to prepare plans and specifications for storm sewer catch basins and manholes at 3rd Avenue South & 69th. Street, as per contract. Carried. 19, Sub - dividers Contract - Bowen & Strand. Motion by Walters, seconded by Rose, that the Mayor and Manager be authorized to execute a sub - dividers contract with Bowen and Strand. Carried. C -1024. q 20. Joint. Acquisition of Land with Metropolitan Airport Commission. Notion by Shields, seconded by Walters, that the Manager be authorized to request M. A. C. to join the Village of Richfield in acquisition of land for a diagonal s tree t. Carried. 21. Ordinance 3.22. Notion by Walters, seconded by Rose that the council refer to the attorney for study and recommendation, the problem of possible change in section 10 bf Ordinance 3.22, relating to guarantee of wells. Carried. 22. Bill 1953 -8. Bill 1953 -8,, AN ORDINANCE RELATING TO PLUMBING, PROVIDING FOR THE ISSUANCE 9/28/53. CF TZ4PORARY CESSPODL PERMITS, now on file in the office of the Village Clerk, was read by the attorney. Motion by Walters, seconded by Shields, that this constitute the second reading of Bill 1953 -8. Carried. Poll of votes: Ayes - Walters, Shields, Rose and Iverson. Nays - none. Absent - Reller. Motion by Walters, seconded by Shields, that the 1953 -8 be adopted; that it be published in the official newspaper; that it be `spread in the ordinance book and 'that it be made a part of these minutes. The manager read a petition requesting a change of zoning from residen- tial to commercial on the W oof Lot 11, Goodspeed's 2nd Plat, 6635 Nicol-let Avenue, and a petition of remonstrance against the operation of a beauty shop at 6635 Nicollet Avenue. Xr. and Mrs. D. M. Klassy appeared in support of the petition for rezoning and Mr. J. A. O'Donghue, 6735 Nicollet Avenue and Mr. F. G. Overman, 6629 Nicollet Avenue appeared in opposition. Mayor Reller took his chair duJring the discussion which ensued. Motion by Walters, seconded by Rose, that the council refer the rezoning- petition to the manager, engineer and attorney to determine if the petition is sufficient to require a hearing before the zoning commission. Carried. 24. Ordinance 2.03 Motion by Walters, seconded by Iverson that the council refer to the Zon- ing Commission Section 4 -B (Use Regulations For Residential Districts), Ordinance 2.03, with the request that they study and advise the council whether the ordinance should be changed or remain unchanged. Carried. 25. Estimate - Orfei & Ma.rianni. Motion by Walters, seconded by Shields, that the council allow the estimate of Orfei & Mariani, Village Project No. 174, in the amount of $41,690.62 (Check 143 SS). Carried. Q6. Estimate - Phelps - Drake. Motion by Walters, seconded by Shields, that the council allow the estimate of Phelps -Brake Company, Village Project No. 175, in the amount of $29,447.22 (Check 144 SS). Carried. 27, Sanitary Sewer Progress Kaps. Motion by Iverson, seconded by Walters, that the council accept the progress maps on sanitary sewer construction as presented by the Village 1hgineer.
