REGULAR MEETING
September 14, 1953
Pursuant to due call and notice thereof, the council of the Village of
Richfield met in regular session in the Village Hall, 6700 Portland Avenue South,
at 7 P. M. on Monday, September 14, 1953,
Present: Walters, Rose, Shields and Reller.
Absent: Iverson.
1. Minutes.
Motion by Shields, seconded by Walters, that the minutes of the - adjourned
meeting of September 9, 1953, be accepted. Carried.
2, Reports.
Motion by Walters, seconded by Shields, that the council accept,.-;id file the
following report. Carried.
Relief Report - August 1953. Clerk's File No. C -951.
3. Hearing - Budget 1954.
Motion by Walters, seconded by Shields, that the hearing for the, proposed
1954 budget be set for 8 :30 P. M., Monday September 28, 1953, and that the Village
Clerk be authorized to advertise this hearing in the legal newspaper. Carried.
4, Bill 1953 -70
Bill 1953 -7 was read, the same being on file in the office of the Village

MINNESOTA. CORPORATION, I IS SUCCESSORS AND ,ASSIGNSP TO ERECT, INSTALL, ENLARGE,
OPERATE, REPAIR, AND MAINTAIN, IN THE VILLAGE OF RICHFIELD, M NNESOTA, T[WS-
MLSSION LINES AND AN ELECTRIC DISTRIBUTION SYSTEM, INCLUDING NECESSARY POLES, POLE
LINES, MASTS, WIRES, CABLES, AND FIXTURES AND APPURTENANCES, FOR THE FURNISHING OF
ELECTRIC ENERGY TO THE VILLAGE AND ITS INHABITANTS, AND OTHERS, AND TRANSMITTING
ELECTRIC ENERGY INTO AND THROUGH THE VILLA OE, AND TO USE THE STREETS, ALLEYS, AND

Motion by Walters, seconded by Rose, that this constitute the second reading
of Bill 1953 -7. Carried.
Notion by Walters, seconded by Rose, that Bill 1953 -7 be adopted; that it
be published in the official newspaper; that it be spread in the ordinance book
and that it be. made a part of these minutes. Carried.

Bill No. 1953 -8 was read by Mayor Reller. This bill entitled, AN ORDINANCE

is on file in the Clerk's Office.
Motion by Walters, seconded by Rose, that this constitute the first reading
of Bill No. 1953 -8.

6. Improvement - Thomas Avenue.
Mr. Earl Sharpe and Mr. Robert W. Barne tt appeared before the council rela-
tive to the improvemen t of Thomas Avenue S ou th f rom 67 th to 68 th S treat.
Discussion followed.
Without motion Mr. Sharpe was instructed to grade and surface Thomas Avenue
as per the instruction given him by the Engineering Committee.
7. Es tiuwte. Payment.
Motion by Walters, seconded by Shields, that the council accept the construc-
tion report on Village Project No. 179 (22.5 %, complete), and allow payment of
estimate to Peter Lametti Construction Company in the amount of 41,3446.58,
check No. 133 SS. Carried.
8, Estimate, Payment.
Notion by Walters, seconded by Shields that the council accept the construc-
tion report on Village Project No. -155 (44. 4% complete),, and a11ow payment of
estimate to Huber Tree 'Service in the amount of $2,608.67, Check No. 134 S5.
Carried.

Motion by Walters, seconded by Shields, that the council accept the construe-
tion report on Village Project No. 172 & 2-A (50% complete), and allow payment
of estimate to Bituminous Surface Treating Compamy in the amount of $12,976.86,
(Check #136 SS, $5,908.13 and Check #1363 PIR Fund). Carried.
10. Deed for S tree t - Bedney.
Motion by Waiters, seconded by Rose, that the council accept and file the
following deed for street purposes. Carried.
Robert S. Bedney and Dorothy J. Bedney (husband and wife), The south 30''
of 76th Street from E line of 4th Avenue to 1341 E of E line of 76th Street.
11. Deed for Street - Juntilla.
Motion by Walters, deeonded by Shields, that the council refer to the Engineer-
ing Committee the deed of ...-Ernest Juntilla. and Viola Juntilla, husband and wife,
7046 5th Avenue, deeding Lot 25 and 51 of Lot 24, Block 2, Savage's 1st Addition,
to be taken from the 71st Street side of their property., for study and recommenda-
tion. Carried..
12. Acceptance of Streets. Sunnyside Acres.
Motion by Walters, seconded by Shields, that the following resolution be
adopted; that it be spread in the resolution book and that it be made a part of
these minutes. Carried.

Motion by Shields, seconded by Walters that the council grant a division
of Parcel 6300, Section 27, Township 28, Range 24, into two parcels; one to be
1001 by 136-391; the other 50 ► by 136.39, as requested by Merle N. Hulthen,
6217 3rd Avenue South. Carried. C -954.
14.. Hearing to Vacate Alley.
Mayor Reller read the notice of hearing to vacate the alley between Lynwood
Blvd., and Lakeshore Drive. No persons appeared in opposition. Mr. Robert
-McKeown and Paul W. Hansen, appeared in favor.

Notion by Walters, seconded by Shields, that the council grant the division
of Lot 1, Block. 2, PortlandAvenue. Acres, into four lots, each 57.32' in width,
as requested by Ross Bassett, 5516' 26th Avenue South. Carried, C -955,
16. Division of Land - Koranda.
Motion by Walters, seconded by Shields, that the council grant the division
of Parcel 700, Section 27, Township 28, Range 24, -into two parcels; one 99.28'
by 151.681 and one 99.161 by 116-31., as requested by Mrs. C. J. Koranda, 6800
Portland Avenue South. Carried. C -956.
17. Division of Land - Fifer.
Motion by Shields, seconded by Walters, that the council grant the division
of Lots 30, 31, 32, 33, 34, 35, 36, and 37, Western Surety and Adjustment
Company Addition, "The Pinesfe, into three lots of 66.661 each, as requested by
Joseph J. Fifer, 4245 15th Avenue S., Minneapolis. C -957,

Motion by Shields, seconded by Walters, that the council accept the wed
of Cyril J. Koranda and Dorothy A. Koranda for the S2 of 68th Street from
5th Avenue to Portland Avenue and the W12 of Portland Avenue from the center line
of 68th Street to 159.26, South. Carried. C -958.

19. Division of Land - Harford.
Motion by Walters, seconded by Shields, that the division of land of Ralph
E. Harford, 7400 Portland Avenue be referred back to the applicant. Carried.
20. Division of Land - Arne Bogen.
Arne Bogen, Owner and Arthur Downer, seller, appeared before the council and
discussed this division of land,
Motion by Walters, seconded by Shields, that the council grant the applica-
tion of Arne G. Bogen, 1006 First National Soo Line Building, for a division of
the E2 of the South 118.9' of the North 389.7' of the E2NW-z$NE-43!SE41 of Section 34,
Township 28, Range 24, provided that the house will be 10' from the North lot line
and that the land shall be sloped to conform to an, existing driveway at 7476
4th Avenue South, such agreement to be submitted in writing. Carried. C -959.
21.. Commercial Building Permit - Stinar.
Motion by Shields, seconded by Walters, that the council approve the applica-
tion for a commercial building permit of F. A: Stinar, 6520 14th Avenue South,
for construction of an addition to an existing building on Lot 14, Block 3,
New Ford Town. Carried. C -960.
22. Special Use Permit - Cutler.
Motion by Shields, seconded by Rose, that the council refer to the Zoning
Commission for public hewing on October 20, 1953, the application of Dr. James
H. Cutler, 7145 Nicollet Avenue South, for a special use permit for construction
of a veterinary clinic between Colfax and Dupont on W. 78th S ire et; and that
the Village Clerk be authorized to advertise for such hearing. Carried. '
23. Division of Land - Cutler.
Motion by S hie lds seconded by Walters that the council grant the application

5300, Section 33, Township 28, Range 24, provided that Dr. Cutler enter into
a sub - divider's contract to deed and develop adjacent streets. Carried. C -961,
24. Commercial Building Permit. Texas Company.
Motion by Shields, seconded by Walters, that the council approve the
commercial building permit of the Texas Company for construction of a service
station on Lots 1 and 2, Block 1, Tingdale Brothers, Lincoln Hills Third Addition,
as per the plans submitted. Carried. C -962.-

Motion by Shields, seconded by Walters, that the council grant the following

26. Petition to vacate Alley.
Motion by Shields, seconded by Waiters, that the council refer to the

the petitioners to be present. Carried.

Motion by Shields, seconded by Walters, that the council accept and file
r the petition of residents protesting _the establishment of an alley between 13th
and 14th Avenue South, and 68th and 69th Street., and advise the petitioners that
( no alley exists or is planned in this area. Carried. C -963.

Motion by Walters, seconded by Rase, that the council accept and assign

Motion by Rose, seconded by Shields, 'that the council •refer to the Engineering
Committee for study and recommendation of priorities the summary of public
improvraents as submitted by the Village Engineer. Carried.

Motion by Walters, seconded by Shields, that the clerk be authorized to
advertise for bids to be received on September 28, 1953 on re- surfacing with a
2" stablized base, 66th Street from Humboldt to 11th Avenue South. Carried.
31.1 Letter, Minneapolis Gas Compares.
Mayor Reller reviewed the points in a letter from the Minneapolis Gas
Company dated September 10, 1953 for the benefit of those persons assembled.
Mr. C. C. Oliver of 6814 Humboldt Avenue South, appeared and stated that
the Gas Comparry had refused to give him service at 6814 Humboldt. Discussion
followed.

r to the Village Attorney, who may employ any legal assistance necessary to
determine if this constitutes a breach of franchise, and to recommend action.

Harry Mayeron of the G. M. Orr Engineering Company, appeared before the council
and presented a tabulation of bids on Village Project No. 214, Sanitary Sewer
Laterals in business districts, and recommended awarding the contract to Phelps -
Drake Co.,Inc. in the amount of $142,994.35.
Motion by Walters, seconded by Shields, that the following resolution be adopted;
that it be spread in the resolution book and that it be made a part of these

No. 1 in the amount of $747.18 on Village Project No. 180, construction of lift
stations and sewage metering station, and authorize the Mayor to sign the same.,

Motion by Shields, seconded by Walters, that the council approve: change order
No. 1 in the amount of $76.00 on Village Project No. 184, 'sta.irway in Village
Hall, and authorize the mayor to sign the same. Payment to be made from the
