05-25-1953232 VILLAGE OF RICHFIELD REGULAR, MEETING MAY 25, 1953 - - Pursuant to due call and notice thereof the Council of the Village of Richfield met in regular session in the Village Hall, 6700 Portland Avenue, Mondeay, May 25, 1953 at 7 P.M. Members Present: Rose, Shields and Roller. Members Absent: Waiters and.Iverson. 1. Minutes.. Motion by Shields, seconded by Rose that the minutes of the regular meeting of May -11, 1953 be approved. Carried. 2. Report. Motion by Shields, seconded by Rose that the report of the Public Health Nursing Service of April 1953 be accepted and assigned Clerk's File No. 0-642. Carried. 3. Petition, Oiling Alley. Motion by Shields, seconded by Rose that the Council accept and file the petition for oiling the alley between Thomas Avenue and Upton Avenue from 69th street to 70th Street. Carried. Clerk's File No. C-643. 4, Oiling Priority. Motion by Shields, seconded by Rose that priority for oiling of alleys be given where petitions have been submitted. Carried. 5_ Grading Alleys. Motion by Shields, seconded by Rose that the following resolution be adopted= that it be spread in the resolution book and that it be made a part of these minutes. RESOLUTION N0. 152. The manager reported on the hearing held by the Zoning Commission on May 19, 1953, at which the Zoning Commission recommended granting a zoning variance to John C.'McDonald, 7214 Thomas Avenue to add a low concrete slab porch to his home. Motion by Shields, seconded by Rose that the council concur in the recommendation of the Zoning Commission and grant a zoning variance to Mr. McDonald.- Carried. i Clerk's File No. 0-652. 8. Amendment to Used Car Dealers Ordinance. Motion by Shields, seconded by Rose that the attorney be instructed to draw an amendment to the Used Car Dealers Ordinance to incorpotate requirements-for used car lots similar to those conditions of the special use permit required bf Mr. Loran C. Buzzard, at Nicollet Avenue and 70th Street. Carried. 9. Special Use - emits_ (a) The manager tread the report of the Zoning Commission hearing of May 19, 1953, which recommended granting a special use'permit tb A. M. Garde, 6300 Lyndale Avenue S. for a used car lot on Lots 1 and 2, Ray's Lynnhurst 2nd Addition. Motion by Shields, seconded by Rose that the council concur in the recommendation of the Zoning Commission to grant a special use permit to Mr. Garde, providing requirements of the proposed amendment to the Used Car Dealers Ordinance are met. (b) The manager read the report of the Zoning Commission's hearing held May 19, 1953, at which the Zoning Commission recommended granting a special use permit for a small animal hospital.to Geo. E. Motion by Shields, seconded by Rose that the council concur in the recommendation of the Zoning Commission Rio grant a special use permit to Geo. E. Ewert. Carried. Clerk's File No. C-654. 10, Bids, Liquor Store Cooler. Motion by Shields, seconded by Rose that the present cooler in the Liquor Store be retained. Carried. The Engineer presented the tabulation of bids received on the walk -in cooler at the regular meeting May 11, 1953 and the same.were considered. Motion by Shields, seconded by Rose that the council accept the bid in the amount of $2,840. of the Automatic Refrigeration Corporation, 1305 Washington Ave. Sou as recommended by the Village Engineer, and that the bid securities be returned after execution of a contract. Carried. 234 Motion by Shields, seconded by Rose that the mayor and the manager be authorized to execute a contract with Automatic Refrigeration Corporation, Carried. 11_ Divisions of Land. (a) Motion by Shields, seconded by Rose that the council not grant the division of parcel #5700, Section 27, Township 28, Range 24, as' requested by A. t1. Herman, 6405 Girard Avenue South. Carried. (b) Motion by Shields_, seconded by Rose that the council defer action on the division of the South '2 acres of the 4S*N*N* of Section 34, Township 28, Range 24, except the * thereof, as requested by Bert G. Monten, 6945 Logan Avenue South, until the Engineer has had an opportunity to discuss the grading of 5th Avenue South, south from its present terminus. Carried. Kelley, 7329 Lyndale Ave. South, until Engineer has been able to acquire necessary additional information. Carried. 14 Proposed Plat Mikkelson. _ Motion by Shields, seconded by Rose that in the matter of the division of part of Lot 7, Mc Cabe's Woodlake Outlots, as- equisted by J. M. Mikkelson, 7030 Harriet Avenue South, that inas much as the area is too large to be considered as a division of land, the Clerk be authorized to advertise a public hearing at 8:30 P. M. June 8, 1953 to hear reasons for or against acceptance of a new plat. Motion by Shields, secmded by Rose to:aallow the claims of Orfei & Mariani, Check # 20, Sanitary Sewer FLmd, in the amount of: $67,192.60 for work an project No. 174; and Phelps -Drake Construction Company, Check # 19, Sanitary Sewer Fund 'in the amount of 533069.77, project # 175. Carried. 24. Personnel- Sanitary Sewer Projects. Motion by Shields, seconded by Rose that the manager be authorized to employ the following personnel as outlined in the memo from the Department of Public Works, dated May 25, 1953, and assign the memo Clerk's File No. C-663. Carried. 1. Four Chairmen to be paid at the rate of $250.00 to 6 275.00 per month 2. One addi.ti6n<al instrumentman at $450.00 per month. ° 3. Two additional inspectors at $400.00 per month. 259 Letters - G. M. Orr Engineering Company. Motion by Shields, seconded by Rose that the manager instruct G. N. Orr Engineering Company that the council concurs with their recommendations of $3.49 per foot as assessment for lateral sanitary sewers; -and that they shall proceed to cc%pute the assessment on that basis. Carried. Motion by Shields, seconded by Rose that the manager instruct G. M. Orr Engineering Company not to prepare working plans for the sanitary sewer system for the area east of Cedar Avenue and south of 70th street, including the lift station -at 70th Street and 20th Avenue. ' Carried. Notion by Shields, seconded by Rose that the manager instruct G. M. Orr Ragineering Company to construct the concrete portion of the lift station at 13th Avenue and 73rd Street, large enough to handle the entire area and provide pump capacity for the area in which sewers are being constructed at this time. The Village Attorney gave a verbal report on the Petit and Mauer Addition, Village Plat #67, Contract # 153, and read a letter from the Veterans Administration dated May 26, 1953, .file No. 3035 -4BA. Motion by Shields, seconded by Rose that the council consent to the attachment of a rider to the bond of Petit & Mauer Construction Company, Contract # 153,naming Carl R. Gray, Jrl, as Administrator of Veterans Affairs, or his successor in office, as an additional obligee. Carried. Clerk's File No. C -667. 32. License and Deed - Holy Angels Academy. Motion by Rose, seconded by Shields that the council accept .the deed for a strip of land 17' in width adjacent to the south boundary of West 66th Street from Nicollet Avenue to Pleasant Avenue, and accept the license easement to canstract a-slope upon the property of the Holy Angels Academy. Gilbert Sandin, developer of the EE�2SSE- 416E- 41-SW1�, Section 35, Township 28, Range appeared before the council in regard to the commercial development agreement with the Village of Richfield. Two property owners from the neighborhood were present and entered into the discusssion. Notion by Rose, seconded by SUelds that the mayor and manager be authorized to execute that commercial development agreement between the Village of Richfield and Gilbert Sandin, dated Nay 25, 1953.
