Village of Richfield . REGULAR MEETIN G APRIL 27, 1953 Pursuant to due call and notice the Council of the Village of Richfield met . in regular session in the Village Hall at 7 P.M. on Monday, April 26, 1953. On roll call there were present: Walters, Rose, .Shields, Iverson, and Reller. No members were absent. 1. N6.n.utes approved. Motion by Iverson, seconded by Rose t~.at the Council approve the minutes of ~ the special meeting April 6, 1953. Carried. 2. Minutes Approved. Motion by Rose, seconded by Iverson. that the council approve the minutes of the regular meeting of April 13, 1953. Carried. 3. Memorial Plaque Presen ted. Harry Mayeron of the G. M. Orr E"ngineer3.ng Company appeared before the .council .and presented a memorial plaque commemorating the start of the Sanitary Sewer in Richfield on behalf of the G. M. Orr Ce., Orfei and Mariani and Phelps-Crake Company, Inc Mr. Mayerson also presented the shovel used by Mayor Reller at the ground-breaking ceremonies. Motion by Rose, seconded by Iverson that the Mayor write a letter of thanks to the Orr Company, Orfei & Mar3.ani and the Phelps-~ra.ke Company, for the plaque. Carried. 4. Reports. Rasmussen. The Mayor read the recommendation of the Zoning Commission for a special use permit to ;gage and Valdemar Rasmussen for the erection of a retail outlet. for nursery stock on the Northwest comer of ?3rd and F.ortland and the remonstrance petition signed by nearby residents. 21~ Motion by Shields, seconded by Iverson that the council grant a special use permit to Aage and Valdemar Rasmussen forthe erection of a retail outlet for nursery stack on the Northwest corner of ?3rd and Portland, as recommended by the Zoning Commission, and subject to the following restrictions. 1. The permit to build shall be non-transferable. ~- _. 2. The sale of items from the greenhouse shall be restricted to those normally associated with greenhouses and nursery products with the exception of sale and rental of power equipment. Carried. The mayor read the report of the Zoning Commission relating to the application of Northwestern Bell Telephone Company to- re-zone from open development to commercial the ~--of the Block bounded by 66th Street on the South, by Pleasant Avenue on the East, by 65th Street on the North, and by Grand Avenue on the ~nTes t, which report recommended such re-zoning. Motion by Walters, sec~.ded by Shields that the council concur in the recommendation of the Zoning Commission and refer the matter of amending the Zoning ordinance to the Village Attorneys Carried. Clerks s File No. G-576. 8. Side Yard Variance. Henry J. Carlson. P~ayor Reller read the Zoning Commissions s report relating to the application of Henry J. Carlson, 7321 Wentworth Avenue for a side yard variation on the North 105, front and rear, of all that part of the W3W2 of the N 1A acres of the S 20 acres of the SW~E~, Section 34, Township 28, Range 2~., which report recommended granting of the side yard variance. Motion by Iverson, seconded by Walters, that the council c~cur in the report of the Zoning Commission and grant a side yard variance as requested. Carried. C1erk~s File. No. C-577. ' 9. Side Yard Variance. Russell Moehrle. Mayor Reller read the report of the Zoning Commission recommending the side yard variance of Russell Moehrle, 730l~ Dapont Avenue South. Abigail F1off. Mayor Reller read the report of the Zoning Commission recommending the granting of a .special use permit for operation of a used ear lot on paa~t; of parcels # 4605 and 100 in Section 28, Township 28, Range. 2J~. Motion by Walters, seconded by Iverson that the council concur in the recommendation of° the Zoning Commission, provided the applicant show full proof of ownership of the land. Carried. Mayor Reller read the report of the Zoning Commission recommending granting of a special use permit for a used car lot on Lot 2, Block 2, of J~ N~ Hauser s Second AdditLon, at 6465 Lyndal e. " Motion by Iverson, seconded by Wa1 tens, that the council concur in the recommendations of the Zoning Commission to grant a special use permit subject to the following condition. 11 1. The North and East boundaries of said premises shall b e screened with a row of Lombardy poplars or similar trees spaced not rare than six feet apart. Mayor Keller read the Zoning Commission's report recommending granting of a special use permit to Mr. R. A. Sykes for a used car lot on the S2 of Lot 2, Block 1, Tingdale Brothers, Lincoln H3.lls Addition, 6600 Penn Avenue South. Motion by Walters, seconded by Shields that the council concur in the recommendation of. the Zing Commission for granting of..this special use permit. Carried. Clerk's file No. C-581. 13. Special Use Permit. Roller Rink. Mayor_ Keller read the report of the Zoning Commission relating to the establishing of a roller rink at 61413 Lyndale Avenue South, and the petition opposing the roller rink. The manager reported verbally that the owner of the building had stated that he would not allow a roller rink to operate at this. location. Motion by Walters, seconded by Shields that the council table indefinitely the matter of granting a special use permit for a roller rink at this location. Carried. ].Li.. Re-Zoning- Penal Avenue 73rd to 71~th. Mayor Keller read the report of the Zoning Commission recommending re-zonin g from commercial to residential that area lying between the center lines of ~hr.een Avenue South, Oliver Avenue South, East 73rd Street and East 7ltth Street. Motion by Walters, 'seconded by Iverson that the council concur in the recommendation of the Zoning Commission and refer to the Village Attorney the mat+er of amending the Zoning Ordinance. Carried. Mayer Keller read the report of the Zoning Commission recommending the granting of a side yard variance to Lonald Samskar on the ~ of Lot 5, Goodspeeds,First ?lat. Mot3.an by Shields, seconded by Walters that the council concur in the recommendation of the Zoning Commission in the granting of a side ,yard variance to Mr. Samskar. Carried. 16. Preparation of Special Assessment Roll. Motion by Walters," seconded by Shields that the manager be authorized to notify G. M, Orr Engineering Company to prepare the assessment roll for all mainr;t~t^imk or interceptor sanitary sewers in accordance with terms of Article 14, item 5 in the Agreement fbr Engineering Services dated April 214, 1953, between the Village of Richfield and G. M. Orr Engineering Company the preparation of such assessment roil to be in accordance with instructions set forth by the Village Manager. Carried. l7. Instructions to Assessor. Mo13on by Iverson, seconded by Shields that the assessor be memorialized to aid the property o~ners on Penn" Avenue between 73rd to 714th streets to secure abatement of real estate taxes for the year 1953 in so far as is practicable. Motion by Walters, seconded by Iverson that the council authorize the payment of f214 Estimate # 2, final, to Ray W~ Skelton, Inc. for work performed on Village Project # 13g, Contract # 150, in the amount of X819.00. The Village Engineer reported that he would meet Tuesday, April 28, 1953 with the Village Engineer of Edina and officials of Northern States Power Company to discuss the removal of the power line on Xerxes Avenue. The council informally recommended that the power line be removed to the al1~y bet:aeen Xerxes and Washburn Avenue. 21. Gas Service Connections. A del.ega•t3on of property owners inquired as to the surfa-~ing of 73rd Street between Chicago and Portland Avenues after construction of the sanitary sewer main. The Engineer informed those present that the street will be returned to its original condition and that damages will be repaired by the contractor. 25. Bids -Police Car. (Conucilman Iverson requested that it be noted in the minutes that he had voted no because he felt that light for adult ball players should not be paid for by the Village tax-payers) _ Motion by ~•verson, seceded by Shields that the conditions of use of Augsburg Park, except payment for lights, shall be the wane as conditions for use during 1952.
