10-27-1952.r • :,~ ~~ 1 i~lINUTES OF REGULAR MEETING VILLAGE OF RICHFIELD October 27, 1952 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Richfield was duly held at the Village Ha11 Monday, October 27, 1952, opening at 7 o'clock P.M. Members present: Reller, Shields, Lindeberg, and Walters Members absent: Iverson 1. Minutes of Previous Meeting Motion by Shields, seconded by Lindeberg, that the minutes of the October 13th meeting be approved. Carried. 2. Reports The following reports were presented: 1 1. Police report for September 2. Public Health Nursing Service report for Septembe 3. Inspection Division report for September ~.. Financial report for September 5. Liquor Store report for September 6. Report from Finance Director on Investment of Funds Motion by Shields, seconded by Lindeberg, that the above reports be accepted and placed on file. Carried. 3. Petition on Emerson--6bth to 67th ' Motion by Walters, seconded by Shields, that the petition requesting that no further alterations be made in the boundaries of Emerson Avenue between . 66th and 67th be received and placed on file. Carried. ~.. Use of Augsburg Park on Halloween Motion by Lindeberg, seconded by Shields, that the request of Burton K. Storm for use of Augsburg nark for October 31, from 6:30 to 9:30 be granted and that any charges for such use be waived. Carried. 5. Building, Electrical and Mechanical Codes Advisory Committee _ Motion by Walters, seconded by Shields, to concur in .the recommendation of the Building, Electrical and Mechanical Codes Advisory-Committee that the Council go oo. record, for the guidance of the Building Inspector, providing that permits will be granted for all commercial structures designed prior to the time when a comprehensive building code for the village has been adopted by ordinance, if the plans comply with the 1~iinneapolis Building Code. Beddow be appointed to Elie Building, I+:lectrical and Mechanical Codes Advisory Committee to replace Gust Fallden and G. Reed Macomber, who were unable to serve. Carried. b. Letter from H. f. Haverstock, Jr. Motion by falters, seconded by Shields, that the letter from H. f. Haver- stock, Jr. regarding drainage into Grass Lake, be received and placed on file. Carried. 7. Bids on Plow Motion by falters, seconded by Lindeberg, that the council concur in the recommendation of the Engineer, and purchase Wausau snow plows from the George.T. Ryan Company as previously .bid, and that the check of the unsuccessful bidder be returned. Carried. 8. Bids on Typewriters Motion by Lindeberg, seconded by Shields, that the council concur in the recommendation of the Clerk and ~'~anager and reject all bids on typewriters, re- turning the certified checks for same. Carried. 9. Bids on roof at Liquor Store A report was presented that the bonding company guaranteeing the roof on the liquor store building had conferred with the Engineer, had agreed to hire the low bidder for repairing the roof, and will deal directly, and that it was recom- mended that bids be rejected by Coinicil. 1"potion by falters, seconded by Shields, that the council concur in this recommendation. Carried. l0.• Highway Department Plans Robert Cook appeared before the council to discuss a proposal of the State Highway Department relative to Trunk Highway No. 100. The manager was instructed to arrange for a joint meeting of the council .with the Zoning Committee, the Engineer, and representatives of the Highway Department to discuss the proposed improvements. 11. Special Use Permits A. Trailer Court: Motion by falters, seconded by Reller, that the council concur in the re coi~nendation of the Zoning Corarnission in granting to Curtis Greer and Harold Jasper,. 8701 Lyndale Avenue South, a special use permit for a trailer court on the east 300 feet of Parcel 7600, on the west side of Cedar at 76th Street, subject tb the following conditions recommended by the Zoning Commission: (1) that deeds be given for 30' for 76th St. and 60' for 18th Ave. So.; (2) that action to develop is taken within. six months; and (3) that the special use permit not be transferable. B. Motel: Motion by falters, seconded by L~ndeberg, that the council concur in the recommendation of the Zoning Commission in granting a special use permit for a motel between Emerson and Girard, 77th to 78th, to Leo Lyons, 7600 Fremont Ave. So. Neslunrl) Motion by Walters, seconded by Lindeberg, that the council concur in the recommendation of the Zoning Commission granting a front yard variation on the . south 6$ feet of Lot 10, Block 5, Fairwood Park (6605 Oliver) as requested by D. L. Neslund. Carried. 13. Divisions of Property A. Kenneth Bryant. Motion by Walters, seconded by Lindeberg, that the council offer no objection to the application of Kenneth Bryant, 6$18 Harriet Ave., for division of property as follows: Parcel 52.80 into three lots,- two to be 59.15' x 13l~. 2b ~ , one 118.9 ~ x 13l~. 26 ~ , otherwise known as 7110 and 7~1.1.~ Clinton Ave., and 7l~12 Third Ave. Carried. B. Fra~~ Podratz. Motion by Walters, seconded by Lindeberg, that the council offer no objection to the application of Frank Podratz, Bloomington Lake, for division of property as follows: Lot 7, Block 5, Nicollet View Gardens into two lots, each 71~.5~ wide and 122.12' long. Carried. C. Harry D. Ticknor. Motion by Lirzdeberg, seconded by Walters, that the council offer no objection, subject to approval of the Engineer, to the application of Harry D. Ticknor, 6.25 Irving Ave. So., for division of property as follows: Divide Parcel 5100 into the NZ of E2 of Parcel 5100 and the S2 of Ez of Parcel 5100. Carried. 1~.. Building Permits A. Ntotion by Walters, seconded by Lin deberg that the application of Gerald Haggett, 6331 Blaisdell Ave. So., for a building permit for a structure to be used for wholesale and retail radio and television parts business, and also sales and service, be approved. Carried. B. Motion by Walters, seconded by Shields, that the application of August Cederstrand Company, 966 Central Avenue, fora building permit for a repair and paint shop on Wold-Chamberlain Field for General Mills, Inc., be approved. Carried. 15. Opening of Bids (School Sig~aals) Pursuant to due advertisement therefor, the following bids were opened on school signals: Portland and Sheridan and East 70th 5t.~ West 66th St. Total H. B. Carried. 1 10~ 1Q~27/52 ~ 16. School Traffic Problems Motion.by Walters, seconded by Shields, that the manager be authorized to contact the school board, requesting them to contact the P.T.A. Council and arrange for a joint meeting with representatives of the council to determine the best method of regulating school traffic, and to recommend an overall policy including the matter of installati~ of school traffic signals. Carried. 17.~ Building Permit (Single family dwelling) I'~otion by Walters, seconded by Shields, that the application of B. E. Crogness, 7109 Garfield Avenue, for a building permit for single family dwelling in open development at 6201 Third Avenue South be approved, subject to compliance with the Engineer's recommendation by deeding the west 30' and the north 30' for street purposes. Carried. 18. Plumber's License Motion toy Walters, seconded by Shields, that the application of the Lake Street Plumbing Company for a plumber's license be approved. Carried. lg. Sale of Judge's Bench Motion by Walters, seconded by Shields, that the Manager be instructed to obtain bids on the sale of the bench formerly used by the municipal judge. Carried. 20. Release of Bonds and Checks Motion by Walters seconded by Lindeberg, that bonds and checks be released in the following additions: A. For streets in Blair's Wooddale, Columbus Avenue, 7th Addition B. Preliminary P3,at (Jerpbak Addition) Motion by Walters, seconded by Shields, that the Mayor, Manager and Engineer be authorized to execute Contract No. 155 for Jerpbak Addition, f rom 62nd to 63rd and from 11th Avenue to one-half block east of 12th Avenue, and that tentative approval be given to the plat. Carried. 22. Street Improvements A. (Mattson Second Addition) Motion by Walters, seconded by Lindeberg, that the 1~iayor and Manager be aguthorized to execute Contract 1Vo. 151 for improvement of streets in P~iattson Second Addition. Carried. B. (Sheridan Avenue) Motion by Walters, seconded by Shields, authorizing work on Sheridan Avenue, according to terms set forth in a letter to Raymond E. Jacobson, a copy of which is placed on file as Clerk's File No. 286. Carried. 23. The Nlayor then announced the following appointments : - Finance Committee Engineering Committee Reller Reller Shields Lindeberg Walters Iverson Keller moved that the above appointments be c~firmed, and that the following rules and regulations apply to the committees: 1. The Finance Officer shall serve as Secretary of the Finance Committee. 2. The Engineer-shall serve as Secretary of the Engineering Committee. 3. The Manager shall serve on both committees. 4. The Attorney shall be subject to call by both committees. 5. Voting shall be limited to the Mayor and Counci]men._ Motion seconded by Shields. Carried. 28. getup vs. Village of Richfield motion by Walters, seceded by Shields, that the Engineering Department be instructed to make a survey to see what can be done to mitigate damages alleged in the action of hemp versus Village of Richfield, at ?318-)nth Avenue South. Carried. 29. Stop Sign Instal lation Motion by Walters, seconded by Shields, that installation of stop signs be authorized at the following intersections: 69th Street and Upton Avenue South 69th Street and Vincent Avenue South. ivIotion carried. 30. Richfield-l+;dina Interceptor Sewer 1 The Mayor reported on a joint conference with Edina officials relative to a division of costs on the construction of a join t Richfield-Edina interceptor i sewer, at which agreement was reached that each delegation return to•its respective council to present the mutual recommer]dation that total costs be shared on a ~ ~I fifty-fifty basis, excepting only costs for the acquisition of any land neeessar~r 10/27/52 within they village limits of Richfield. Motion by Shields to: 1. Approve-the report of the negotiating committee; 2. Accept-the principle oi' equal division of costs for the constructing of the point sewer line, excepting only the cost of acquisition o~ land within the Village of Richfield; 3. Authorize the Mayor to convey to Edina Richfield Council's acceptance of the proposal; !~. Crder the Attorney to enter into negotiations far a contract, in the event Edina also accepts. Lotion seconded by Lindeberg. Carried. Motion by Walters, seconded by shields, authorizing the Engineer to proceed with surveys necessary to the sewer construction project as follows: Columbus Avenue from 672 to b82. East 73rd from Portland to 3rd Avenue. Carried. 31. Contract with T. G. Evensen The Village Attorney presented a proposed contract with. T. G. Evensen and Associates for fiscal services. 1~oved by Walters that the proposed contract between the Village and T. G. Evensen -and Associates, Inc., be given Clerks File Igo. 288, and be placed on file, and that the Mayor and Manager be authorized and directed to execute said contract on behalf of the ®illage and that the Village Clerk affix the Vil7.age seal thereto. Shields seconded the motion. .upon roll call, all members of the Council voted in favor thereof. Carried. Motion by Walters, seconded by Shields, directing the N~anager to c.~ rite a letter to T. G. Evensen and Associates authorizing them to proceed with Part I of said contract. Carried.. 32. Liquor Store .Policy on Cashing Cheeks Motion by Walters, seconded by Shields, that the Village Council does _ not approve or authorize the cashing of checks at the municipal liquor store, and further requests the Village Manager to so inform the manager o~ the liquor store, and the employees of the liquor store. Carried. 33. Insurance Survey Motion by Shields, seconded by Lindeberg, that a survey be made of the complete insurance program of the Village by the Home Insurance and Home indemnity Company and that the report of such survey be referred to the Finance Committee for review. Carried. .35• Residence of Fgnployees Motion by Shields, seconded by Walters, that it shall be Council policy - that all Village employees become residents of the Village within six months from date of employment, if not already residents..
