MUTES OF ALJOLTMIED COUNCIL MEETING June 10, 1952 Pursuant to due call and notice thereof, an adjourned meeting of the Vil- lage Council of the Village of Richfield, Minnesota, was duly held at the Village Hall, Tuesday, June 10, 1952, opening at 7:00 P.M. Members presentx Reller, Iverson, Lindeberg Members absent ` Shields, Walters 1. Minutes of Previous Meetings The minutes of the Regular Meeting of May 26th and the Adjourned Meeting of May 27 were read and corrected. Moved' by Iverson, seconded b� -Lindeberg, that said minutes as corrected be approved. Carried. 2, Letter RegardingFirearms Ordinance - A letter from the Village Manager regarding the Firearms Ordinance was pre- sented. Moved by Iverson, seconded by Lindeberg that the latter be placed on file. Carried. ° 3. Park Concessionaires Reports ° The Park Concessionaire's reports for the periods, May 11 to 24, 1952, and May 25 to June 7, 1952, were presented. - Moved by Iverson, seconded by Lindeberg that the reports be accepted and placed on file. Carried. 4, Financial Reports Financial reports for the month of April were presented. Moved by Reller, seconded by Lindeberg that the reports be accepted and placed on file. Carried. 5, Relief Report The monthly report of George Soberg covered relief expenditures for May was presented. Moved by Iverson, seconded by Lindeberg., that the report be accepted and placed-on file: Carried. 6. Fairwood Park Building A delegation was present to discuss the Village's participation to the amount of ;1,000, in the construction of a warming house at Fairwood Park, in accordance with a previous agreement. It was agreed that the delegation will meet with the Manager and Engineer to draw up plans for the building. 22 6/10/52 -2- 7. Ordinance 3.222 (Firearms) Mayor Reller moved the consideration of a new ordinance pertaining to the regulation of ffrearms. The attorney then read Ordinance No. 3.222. ORDINANCE NO. 3.222 AN ORDINANCE PROHIBITING TM, POSSESSION OF FIREARMS BY CRIMINALS AND SUBVERSIVE ELEMENTS, At•TD REPUTING THE MANUFACTURE, SALE. OR OTHER TRANSFER AND POSSESSION OF CONCEALED WEAPONS AND FIREARM WITHIN THE VILLAGE OF RICHFIELD AND PROVIDING PDTALTIES FOR VIO- LATIONS THEREOF said ordinance being on file in the Clerk's office. Moved by Iverson, seconded by Lindeberg, that this constitute the first reading of this ordinance. Roll call: Ayes -3; Nays -0. Carried. Mayor Reller agreed to move re- consideration of the repealoof Ordinance 3.22 to the next meeting. 9. Special Election on Liquor Question The Village Clerk presented a tabulation of the vote from the various elec- tion districts at the special village election held Monday, June 9, 1952,-on the question, "Shall the Village Continue to Operate Its Municipal Liquor Store Rather Than Issue Private Liquor Licenses ?" Also presented were affidavits showing required posting and publication of notices. Moved by Reller that the following resolution be adopted; 23 6/10/52 -3- A RESOLUTION DETER11INING RESULTS OF SPECIAL ELECTION BE IT RESOLVED by the Village Council of the Village of Richfield that it is hereby found and determined that at the election held in and for s aid Village on Monday, June 9, 1952, to vote on the question,° "Shall the Village Continue to Operate Its Municipal Liquor Store Rather Than Issue Private Liquor Licenses ? ", the vote teas as follows: Votes: Yes..1815 NO... 33 0 Spoiled or Blank......; - Total Vote....9...1849 and that said proposition carried by more than the requisite majority vote. Village Hall Change Order A report was presented that a change order providing for the construction of a door in the rear of the fire station would cost 6357. Moved by Lindeberg, seconded by Iverson, that such a change order be authorized, together with one -for the construction of a window in the toilet room at the rear of the fire station. Carried. ` 11. Bids on Concrete Piers Moved by Reller, seconded by Lindeberg, that the bids on concrete piers opened June 9, be rejected., aAd that the certified checks be returned to the bidders. Carried. Moved by Iverson, seconded by Lindeberg that the Manager be instructed to re- advertise for concrete piers at a location to be deterrin_ed later. Carried. 12. Bids on Spray Bar Moved,by Lindeberg, seconded by Iverson, that the bid of' the Frawley Equipment Company, in the amount of $1022-50 22.50 for a spray bar, as submitted a t . the June 9th meeting be accepted. Carried. 13. Bids on L.P. Gas Moved by Reller, seconded by Iverson, that the bids on liquefied petroleum gas for heating the village hall be rejected, that certified checks be returned, and that a new analysis be.made of the provlem. Carried. 24- - 6/10152 -�- 14. Bids on Mower Moved by Reller, seconded by Lindeberg that the Manager be authorized to re- advertise for bids on mowers. Carried. 15. Special Use Permit—Wexler Apartments A report was presented from the Planning and Zoning Commission relative to a special use permit for the Wexler Efficiency Apartments. No action was taken by the Council. 16. Special Use Permit-- Augustana Lutheran Church Moved by Reller, seconded by Iverson that a special use permit be granted to the Au.gustana Lutheran. Church to build and mainta.ln a church in the block be- tGreen 76th and 77th Streets and Chicago and Elliot Avenues, subject to all con - di tion's set by the Zoning Commission at its hearing of May 26, 1952, and set forth in lettdr dated Jame 7, 1952, and filed with the clerk. These conditions are: 1. Within 30 days, the petitioner shall acquire ownership to the land in question and such evidence of ownership shall be presented to the Council. 2. Adequate provision shall be made for off -the- street parking. 3. The building shall be set back a minimum of 35 feet from all the property lines. Motion carried. 17. Special Use Permit- Three - family Unit An application for a special use permit for a three - family unit at the southeast corner of 64th & Humboldt was referred back to the petitioner, as not properly presented, but should be a re- zoning matter. 18. Petition for Re- zoning A petition for re- zoning the west side of Elliott from 69th to 70th from commercial to residential wa.s referred back to the petitioner. 19. division of Property An application was presented for the division of property along Park Avenue between 70th and 71st Street. Carried. 24. Sewer Contract with Minneapolis A proposed contract betYreen the Village of Richfield and the City of Minneapolis was presented to the Council for approval. Said contract related to the interconnection of Village sewers with those of the City of Minneapolis. Mayor Reller introduced the folloxing Resolution and moved its adoption. RESOLUTION AUTHORIZING CONTRACT 141TH THE CITY OF MINNEAPOLIS FOR INTERCONNECTION OF SANITARY S&%WS BE IT KSOLVED by the . Village Council of the Village of Richfield as follows: 1. That the proposed contract betaaeen the Village of Richfield and the City of Minneapolis for the interconnection of sanitary sewers be given Clerk's File Number C -107, and placed on file. 2. That it is determined to be necessary, and expedient to the public health, convenience and general welfare that such contract be entered into by the Village of Richfield. 3. That said contract is hereby approved and accepted by this Council; and that the Mayor, Manager and Clerk are hereby authorized and directed to exe- cute said contract by and on behalf of the Village of Richfield. Moved by Lindeberg, seconded by Iverson., that this constitute the first reading of Bill 1952 -13, Roll Call: Ayes -3; Nays -0, Carried, 270' Nursing Service The attorney - Teported.that a previous resolution pertaining to partici- pating in public health nursing district of Rural Hennepin County was inade- quate to comply with the laze, and suggested, the following resolution: RESOLUTION AUTHORIZING PARTICIPATION IN NURSING DISTRICT BE IT R ESOLVED by the Village Council of the Village of Richfield that the resolution adopted by the Village Council relating to support of Public Health Nursing District of Rural Hennepin County be hereby amended to read as follows: 'MfiS : Pursuant to . Sections 145.08 and 145.12, Minnesota Laws of 1949 as amended, provisions were made for the establishment of a public health nursing district in that portion of Hennepin County outside of the City of Minneapolis. 'WHEREAS: On'January 4, 1952, the representatives of a number of towns, villages and cities of rural Hennepin County in a meeting at Robbinsdale, Mi.nne- sota, established a public health nursing district pursuant to Sections 145.08 and 145.12, laws of 1949 as amended, and proceeded to elect a Committee as pro- vided for in this act to administer the affairs of such District. 'Now, therefore, be it resolved by the Village Council of the Village of Rich field that said Village be included in the public hea? th nursing district of rural Hennepin County as organized on January 4, 1952, end that it hereby agrees to contribute an apportionment of the cost. and expenses incident to the carrying out of the purposes of said nursing district as authorized by Section 145.08, Minnesota Statutes, equal to its pro rata share thereof, based. upon the popUation of each of the respective political sub - divisions included within s=aid nursing district as determined by the last Federal c en-sus., provided that such apportion - ment shall not exceed in any one year thirty -seven cents per capita, and provided CS J w 6/10/52 -8- further that no liability shall be incurred by the Village of Richfield here- under until two or more of the participating pUtical subdivisions shall have signed an agreement in writing, authorized by their respective goveming bodies, providing for the formation of said nursing district, which agreement shall make provision for the apportionment of the cost and expenses of the said dis- trict on the basis of the population of each participating subdivision according to the last Federal census. 7fie total cost *and expense for which each parti- cipating political sub - division .shall be liable shall, however, not exceed thirty -seven cents per capita according to said Federal census, and, "BE IT F[ r-M RESOLVED that the Mayor and Manager be authorized to execute in behalf of the Village an agreement in writing to be entered into with one or more of the piitical subdivisions of Hennepin County authorized to parti- cipate in said nursing district which shall provide for the apportionment of the cost and expenses, incident to the carrying out of its purposes on the basis of the population of each participating subdivision according to the last Federal c ensus." Roll call: Ayes -3: Nays -0, Carried, 28, Kennel Licenses Representatives of dog kennel operators complained that the 6100 kennel, license fee was too high, and asked for a reduction. The Council agreed to - take up the matter at a future meeting. 29. Contract Authorized- -American Bitumuls and Asphalt Co. Moved b Lindeberg, seconded by Iverson, that the Mayor and Manager be authorized to sign a contract with the American Bitumuls and Asphalt Co. for emulsified asphalt pursuant to bids previously received by the Council, and that said contract be given Clerk's File No. C -108. Carried. 30. Authorization of Contract-- Socony Vacuum Oil. Compan�r Moved by Iverson, seconded,by Lindeberg, that the Mayor and Manager be authorized to sign a contract with the Socony Vacuum Oil Company for Soiltex, pur- suant tD'bids previously received by the Council, and that said contract be given Clerk's File Mo, C -109, Carried, 31. Bus Service Trustee.Lindeberg brought up the matter of complaints received on the bus service in Richfield, and inquired as to what could be done about improving the service. The - matter was referred to the attorney for investigation. 32.- League Convention Moved by Iverson, seconded Clerk and Engineer be authorized of Minnesota Municipalities at St. paid. Carried, 33.
