Village of Richfield
May 27, 1952
Pursuant to due call and notice thereof, an adjourned meeting of the
Village Council of the Village of Richfield, Minnesota,, was duly held at the
Village Hall Tuesday, May 27, 1952.
Members present: Reller, Iverson, Lindeberg, Shields and Walters
Members absent: None
1. Minutes of previous "meetings
The minutes of the regular meetipg held May 12, 1952, were read and
corrected. Moved by Walters, seconded by Shields that said minutes as corrected
be approved. Carried.
The minutes of the Adjourned ' eeting of `jay 19., were read and corrected.
Moved by Walters, seconded by Iverson, that said minutes as corrected be approved.
2. Park Lights
Moved by Iverson, seconded by Lindeberg, that the matter of park lights
be made a special order of business. Carried.
Moved.by Iverson, seconded by Lindeberg that the previous action of
the Council be amended to the effect that the lights in Augsburg Park be tumied
off by 10:30 instead of 10:00 p.m. Carried.
3. Resolution on Re- zoning
Moved by Reller that the following resolution be adopted:
RESOLUTION
BE IT RESOLVED by the Village Council of the Village of Richfield as
follows:
1. That petitions for rezoning shall be accompanied by a plat or
sketch showing the property involved in the petition and all property wi thin
300 feet thereof.
2. That such plat or sketch shall be drawn to accurate scale and shall
show the names of the owners of all property within. 300 feet of the property
to be rezoned.
3. That the petitioner for rezoning or for a special use permit shall
hereafter be required to deposit the sum of $15.00 to pay the expense of pvlili-
cation of notice of hearing on said petition, before any action is taken on
such petition.
The motion to adopt the foregoing resolution was seconded by Walters.
All members voted in favor thereof, and said resolution was declared duly
passed and adopted.

Moved by Walters, seconded by Iverson that the foregoing licenses_ and.per
mits be approved. Notion carried.
5. Cancellation of Special Assessment
Mrs. Louise Shaver, 6300 Logan Avenue South, appeared regarding her request
for the cancellation of the special assessments for storm sewer and blacktopping
on Lots 1,2 and 3. Block 9, in Ray's Lynnhurst Addition. Councilman Walters moved
the adoption of the following resolution:

in 1950 for blacktopping, Petition P, the following lots were inadvertently assess-
ed although they received no benefits from said imprbvement: ,

NOW THEREFORE BE IT RESOLVED, by the Village Council of the Village of
Richfield that the 1952 installment and all subsequent installments of such

BE IT FURTHER RESOLD, that the auditor and treasure-of Hennepin
County be and they. are hereby authorized to make the necessary corrections to
give effect to this resolution upon,their respective records.
Motion seconded by Shields. Carried.
6.- -Division of Lots
Parr. B. W. 0!•Connell requested permission to divide Parcel #5230 into two
50 -foot lots. Notion by Walters, seconded by.Iverson that there is no objection
to such division subject to the owner furnishig a deed to 'a strip of land 30 feet
wide for 64th Street. Notion carried.
7. Augsburg Park Concessions
Moved by Walters, seconded by Iverson that thefee for the electrical
facilities in Augsburg Park used by Augsburg Park Concessions be fixed at 935.00
for the season, payable in advance. Motion carried.
B. Mosquito Abatement
Mr. E. N. Hallin, 6416 20th Avenue S., reported on a program to spray
the east Richfield area for mosquito control, but stated a low flying waiver
over a congested area was needed from the C.AA. Sentiment was expressed that
there was no objection on behalf of the Council for such a permit, but no action
was taken.
9. Asphalt Storage Tank
Moved by Walters, seconded by Shields that, the Council approve the plans
for the location of the asphalt storage tank in East Park, and that the south
411.5 feet of the park be dedicated for street department purposes, in addition
to 33 feet being designated for street right -of -way. Motion carried.
Moved by Lindeberg, seconded by Walters, that bids be called for at
the June 9th meeting for the installation of concrete piers for the storage tank
and for the installation of fencing around the area. Carried.

10. Western Oil & Fuel Company Contract
Moved by Iverson, seconded by Walters that the Mayor, Manager and Village
Clerk be authorized to sign the contract with the Western Oil & Fuel Company
covering asphalt emulsion and anti - stripping compound, in accordance with their
bid, and Ahat the contract be given Engineer s File No. 139.
11. Request for Abatement of Assessments
A request from Mr. Arthur E. Anderson, 6429 Portland Avenue South, and
Mr. Herbert W. Hecker, 6501 Portland Avenue South, for relief from storm sewer
assessment was presented.
Moved by Reller, seconded by Walters, that the matter be referred to the
Village Attorney. Carried.
12. Bids for Mowing Equipment
Moved by Iverson, seconded by Walters, that authorization be given for
advertising for bids for mowing equipment. Motion carried.
13. Acceptance of Leeds -
Moved by Walters, seconded by Lindeberg, that the deed for street pur -_-
poses from Bowen & Strand be accepted for the following:
a. Colfax Avenue from W. 77th Street to W. 78th Street .
b. W. ?7th Street from Bryant to Colfax Avenue .
c. Market Drive from Bryant Avenue to 'Dupont Avenue
Notion carried.
14. Installation of Sidewalk
Mr. Wesley G. Bryant, 6234 Nicollet Avenue South, requested permission
to have concrete sidewalk installed for a distance of approximately 75 feet in
front of the above address.
Moved by Walters, seconded by Lindeberg, that the request be approved
subject to the approval of the Village Engineer. Carried.
15. Street Grading
Mr. Leif E. Holter, 6832 Garfield Avenue South, appeared relative to
street grading in his area. The Council then discussed the area involved in a
grading project for a complete job.

RESOLUTION
BE IT Rte OLVED by the Village Council 'of the Village of Richfield
as follows:
5/27/52 -6-.
1. 'That it is hereby determined to be necessary and expedient to the
public convenience and general welfare that the following improvements be under-
taken:
Grading,drdinage and establishment of streets and alleys in the
following area: - '
From the east side of Lyn.dale Avenue South to thevest side of
the Minnesota Northfield & Southern Railway Company's right -of-
way, from the center line of West 69th Street to the south side of
West 68th S tree t.
2. That the Village Engineer be and is hereby authorized and directed
to prepare preliminary plans and estimates of cost for such improvements, and that
such plans and cost estimates be submitted to this Council by the Village Engineer
at his earliest convenience.
3. That said improvements shall hereafter be known as Village Project
No. 131. "
4. That in case said improvements shall be made, that part of the total
cost thereof representing benefits received as hereafter determined by the Village
Council will be assessed against every assessable lot, piece, or parcel of land
within said district based upon the benefits received.
5. That at 8:00 PA in the Village Nall of the Village of Richfield, on
the 30th day of June, 1952, the Village .Council will meet and hold a public hearing
on said proposed improvements; and that the Village Clerk is hereby authorized and
directed to publish notice of said hearing as required by law.
Motion seconded by Iverson. Roll Call: Ayes -5; Nays -0. Carried.
16. Opening of Street
Dean Robertson, 6222 Clinton Avenue South, requested that Clinton Avenue
South be opened up from .its present northern terminus through to 62nd Street.
No action was taken, but the attorney agreed to (check the ownership of the property
involved in securing street right -of way.
17. Petition for Street Grading
A petition was presented requesting street grading on Third Avenue
South from 68th to 69th Streets. Motion by Councilman Walters, seconded by Iverson
that the petition be placed on file. Carried.
18. Division of Tract
A request was presented from Elmer Pingree, 2939 Columbus Avenue, for
division of a tract in accordance with Sketch At 7'4 Rkp .,� lived by Iverson, seconded
by Walters, that there was no objection to suc request. Motion carried.
19. Proposed Plat

A proposed plat was presented east of Newton Avenue South from 76th to
77th Street. Moved by Walters, seconded by Iverson that the plat be approved subject
to the conditions set fprth in Engineer's Contract No. /y_ / ,,,and also subject

22. Special Use Permit- Assembly of God Church, 76th Street & Nicollet Avenue (Nays -0)
(Carried.) -
A request was received from the Richfield Assembly of God Church for a
special use permit to build and maintain a church on the southeast corner of 76th
Street and Nicollet Avenue. Moved by Walters, seconded by Shields that the pe-
tition be referred to the Zoning Commission, and that the date of hearing be set
for Monday, June 16, at 8:00 o'clock at the Village Hall.. Motion carried.
23. Position Classification
Moved by Reller that the following resolution be adopted:
RESOLUTION-- Finance -clerk Classification
BE IT RESOLVED by the Village Council of the Village of Richfield that the
resolution of this Council establishing position - classifications and designating
salary pay ranges for such classifications for -the year, 1952, in accordance with
the Personnel Ordinance_olf this Village be.and is hereby amended to add the po-
sition - classification of Director of Finance - Clerk- Treasurer, and to fix the salary
range for said position- classification at Range 43.
24. Public Examiner
A communication was presented calling attention to the fact that the request vim
to the public auditor for an° examination of the village books called for a two -year
audit for the years 1951 and 1952, and suggesting that separate audits be made. -
Noved by Reller, seconded by Walters, that the original resolution requesting a two -
year audit of the village books be amended, requesting the 1951 audit as soon as possible,
and the 1952 audit follotdng the close of the fiscal year. -otion carried.

25. Hearinz on Road Oiling
Moved by Iverson that the following resolution be adopted:
RESOLUTION ACCEPTING AND APPROVING PRELIMINARY PLANTS AND COST
ESTIMATES ON PROPOSED STREET IK - ROVE14EN T PROJECT NO i 1283 ORDERING
AND FILING TI EREOF: DESIGNATING THE SA4E AND ORDERING A HEARING THEREON
BE IT RESOLVED by the Village Council of the Village of Richfield as
follows
1. That the preliminary plans and cost estimates for a general program
of street surfacing of all village -owned sheets shall include:
Part 1. Oiling street surfaces (penetration'method)
Part 2. Oiling street surfaces (mixed to a depth of two inches)
Part 3. Placing bituminous seal coat on ex; sting blacktop streets,
prepared pursuant to a previous resolution of this Council passed. on Apri114,
1952, are hereby accepted, approved and ordered placed on file in the office
of the Village Clerk, given Engineer' s Project No, 128, and kept open to public .
inspection.
2. That said improvements shall -:,hereafter be knot+mas Street Imrrove-

3. That in case said improvements shall be made that part of the total
cost thereof representing benefits received as hereafter determined by the Vil-

o'clock P.M. on the 30th day of June, 1952, the Village Council will meet and
hold a public hearing on said proposed improvements; and that the Village Clerk
is hereby authorized and directed to publish notice of said hearing as required
by law.
