The President called the meeting to order. The .Clerk then. read the minutes of the lit regular meeting held on May 7.lrth, 1951. The minutes were corrected 3n the item on page b2, concerning the Rules and Regulations regarding. Augsburg Pang, to reads psixteen years and over.e It was moved by Ernest Iverson and seconded by Toffi Walters that the minutes be approved as corrected and authorized for pu}~13.cation ixi the official neespaper for the Village. Carried. ... 1. Mr. Wi'~~~am B. Bell, 819 - 8th Street South, asked about getting a license for outdoor dancing at the diner at 78th Street and Garfield. There will be either a 70 x 70 or a 60 x 60 slab constructed for dancing. and there will be a fence around it. Ae was instructed to bring in a sketch for his proposed construction and to apply for the licenses needed and then come to the next Council meeting. 2. Mr. Ir~ix~g Fine, 7301 Sheridan Avenue South, asked permission to bring 76th Street between Sheridan and IIpton down to grade at his own expense, 3n return for which he asked for the surplus dirt for his own use. He stated that the. grade shows that there would be a three to four foot cut, and he u~.erstands that the V311age did not plan to cut this street down to grade this year. It was moved by Gordon Bowen and seconded by Tom falters that permission be granted providing the Engineer and the Street Co~3.ssioner deem it advisable. Carried. ... 3. Mr. C. W. Schribber, representing the Coffman Realty, Sono Aquila Averme, St. Louis Park, submitted a new plat for approval. The plat covers the area West of First Avenue South and !~~ feet North of 70th Street. The plat will be called ~leredith~s Addition. The plat includes four 75 foot lots and one 100 foot lot. It was moved by Gordon Bowen and seconded by Ernest Iverson that the plat be accepted providing it fulfil]. all the requirements of the Platting ordinance. Carr3.ed. ... It.. qtr. C. W. Schrieber oonsented to provide the Village with five in- serts for-=the Village plat books. ... 5. ~Ir. garrs~ Nelson, 1305 E. 66th Street, stated that he had been unable to get a plumber to do his plumbing work. The Ordinance does not permit hi~a to do his own plumbing. It was moved by Tom Walters and seconded by Gordon Bowen that the matter be referred to the Plumbing Inspector and that he give a Memo to the Council in. which he is to state if the raatorials purchased by Mr. Nelson, m®et with the requirements of the Ordinance. He also is to state the reason, if possible, why a plumber will not do the ~ rk. Carried. .. 6. Mr. Ben Gardner, 7012 Portland Avenue South, presented petitions signed by residents in the area of I~th and 5th Avenues and 68th and 69th Street, requesting that the streets in that area be graded. The Attorney, Clayton L. Le Fevere, explained that in undeveloped property, the Council requires aquit-claim deed. He recommended that these be made out to the Village, covering the shave stated area, and when this has been done, the streets can be graded without any fur ther petitioning. ... ?. Mr. W. E. Medcalf, 6933 Oliver Avenue South, aga3.n r®quested what action had been taken about the removal of the ut-house and the condition of thewell located at the N.E. corner of 70th ~treet and Penn. The Clerk read the Health-Officerts reports on his inspection of said property. The Health Officer found the place relatively clean and--free of garbage, debris' etc. The condition of the build3.ngs, however, was, quite poor, especially the garage,. which. houses an outdoor toilet.' The outhouse meets State re- quirements as to depth and eleanliness but requires fore ad®quite scr®ening. ~ The well is in danger of being oonta~.nated, if not alxeady contaminated, be- c~use of its location below the 1eve1 of the outhouse and within 50 feet of it• The Health Officer has requested the State Department. of Health to send an engineer to.make a complete study of the well and outhouse and to test the water. The Council decided to await the report of the State Department of t Health before ~ taking any further action. ... '8, Mr. B. Ld. O'Connell, 72l.~ Nicollet, presented a petition for black- . topping ?3rd street between Pleasant and I~icollst. It was moved by Gordon Bowen, and seconded by'Tom'Walters that the petition be accepted and the hearing be held on June 8th, 1951 at the 'Pillage Hall. Carried. ... 9. Mr. C. E. Coulter, 3139 Garfield Avenue South, presented a proposed plat for C. J. Auny. The plat includes the area South of 62nd Street and Eras the trunk Highway X65 to 134 feet East of Dupont. It was moved by Gordon Bowen and seconded by Ernest Iverson that the Council offer no objection to the plat if presented as proposed. Cat~ried. " ... - 10. Mr. Albin Benson, 5135-Elliot, and Otto Huber, 6605 Portland Avenue ' requested permission to locate~a popcorn trailer at the corner of 66th St. and Portland, in the area now 1ffiown as 6605 Portland. They were instructed _ that Mr. Huber must. apply for the food and soft drink licenses. ... ~~ 11.}~r. Marshall, L. Schmitt, 5020 Josephine Avenue, Edina, asked for a permit to build aDairy-Mor on Lot 13 and 7~., Block 1; Nsw Ford Town addition at approximately 66th Street and Longfel5.oia Avenue south. Carried. .... , .. 12.Mr. T. ~. McAndrews; 6521 Oliver Avenue south, inquired again about the Gibbish Excavation Company, as to what was being done to al.7.ev3.at® the nuisance. He stated that a fence is now being. built around the Gibbish building on the Penn Avenue side with access from Oliver. The Attorney stated that'ic:formation was being gathered to determine whether or not Gibbish had' located on this property before the Zoning Ordinance. Carried. ... 18. A communication from geraait Haugen on the matter of the Fare Civil. Service Commission, called the attention of the Council that J~cie 15th marks the expiration of the probationary period. All ps^esent members will becwne permanent firemen after that date. The Ealgineer, Mr. Wefald, reported on his inspection of the Axel Nielson property. Mr. Wefald stated that°the extra reservoir might become valuable when the new highway goes through. He stated that the State High- ° way has no ob~eetion to'Mr. Aeilson removing the top soil, but A~r.Wefald suggested that the area from which top soil can be removed, be restricted. It wads moved by Tom Walters and seconded. by Gordon Bowen that Mr. Nei3:son be permitted to remove the top soil from the area as designated by the Engineer. Carried. ... 21. The Engineer also reported on the Storm Sewer for the Wexler Addn. The cyst of the estimated Storm Sewer is from X20,000 to ~35,~. Carried. ... 23.~ The Manager presented a Recreation Survey mad® by Gerald B. Fitz- gerald, covering. Management, Facilities and Financing of a community wide recreation program. The matter of part-time help in the offices when the present office staff are on vacations was called to the attention of the Council. It was= moved by Gordon Bowen and seconded by Tom Walters that the Manager be authorized to hire any help he d®~s necessary to fi11, in daring sneer vacations. Carried. ... 27. The Manager reported on the schedule for employ®®s of the Liquor Store presented by the Manager of the Liquor ®tore. The report stated that for ~12.C0 a week more a full-tjme man could be employed.to take the place of the two or three part-time men employees. It was moved by Ernest Iverson and seconded by S. M. Little3ohn that the Manager be•authorized to hire a full-tame employee for the Liquor Store. Carried. • ... 28. The Police Chief reported that the Superintendent of the Fort Snelling Rational Cemetery had requested that Richfield provide three m®n for patrol duty on Memorial Day. It was moved by Gordon Bowen and seconded by Tom Walters that a special detail be authorized for duty at the Cemetery on Memorial Day. Carried. i I l F: f ... 29. It was reported that Gordon Bogen load been requested by the League of Minnesota Municipalities to conduct a panel at the convention to be held at Rochester. on the Personnel Ordinance, on Saturday, June 16th.' Littlejohn, an exofficio member of the library committee, stated that the friends of the Library recommended that a library build3xlg be constructed.. He stated that the friends could raise ~3,~0 and that the ~.~ a month rent now being. paid would go a long way,in payi.ng~the remainder of the building. He stated that,the N.E. corner of Augsburg Parts would be an ideal spot for the building. Sixty per cent 'of the building could be financed. At any time after said three day period, said poundkeeper may cause such dog to be killed and shall properly dispose of the remains thereof and such poundkeeper shall account for and pay over monthly to the Village Treasurer all money received by him on behalf of the Village, by reason of sales and licenses. Said poundkeeper shall also keep an accurate account of all licenses issued by him, all fees collectedy all sales made, all dogs received at the dog pound and all dogs killed or released therefrom and sha11 submit such account monthly to the Village. The Village Council may designate as the official dog pound of this Village, a kennel that is located in or near this Village and may contract with the owner of such kennel for such services as may be necessary to carry out the grovisions of this ordinance. Dogs impounded pursuant to the provisions of` this ordinance shall not be included in the limitation imposed by Section 17-8 of this ordinanc®. 19• Arty person violating any of the provisions of this ordinance shall be guilty of a misdemeanor. The following members were present: Mayor Christian, Councilmen Walters and Littlejohn, and the following were absent: Councilmen Bowen & Iverson. This beiisg the time and place set for public hearing on the construction of a general system of storm sewers,~including the necessary outlets for Storm Sewer District F, the Clerk presented affidavits showing due publi~ cation of the notice of public hearing as to such improvement which was examined, found satisfactory and ordered placed on~file. The Mayor then announced that this was the time and place for the public hearing and that the Council would hear all persons that cared to be heard for or against the proposed improvement for Storm Sewer District F. The file contained two petitions; one with 22 names opposing the installation of the storm sewer and the second petition containing 29 names in favor of the storm sewer. It was noted that many of thenames proposing the installation were listed as Mr. ~ Mrs. These were counted as one signer. Councilman Tom Wafters asked the Village Engineer his opinion as to what solu- tions were possible to solve the water condition in this area. The Village Engineer stated that in his opinions a storm sewer was the on~yepermanent solution. After the Council had heard all persons that cared to be heard for or against the proposed construction of storm sewers for Storm Sewer District F~ upon motion duly made sedonded and unanimously adopted the hearing was declared terminated with further action by the Council to be taken at the regular meeting to be held June 11, 1951 at 7:~ o~clock PM. ~ &~. The Council next .took up the hearing on the proposed street improvements ~ blacktopping of the said streets and conducted hearings on the proposed improvements ~lOl~ thru,~`107.. The following people appeared and presented evidence in blacktopping of the street improvement X111 for blacktopping Newton between ~Znd and 73rd; D. C. Sham - 7226 Newton ft.S.Hanning - 7238 Newton B.Trewhella 7220 Newton These gentlemen expressed their opinion that the street was not to a proper grade and desired the street to be put in proper condition before blacktop is applied. The State Commissioner informed the Council that the street was to grade and that in .this particular block the fall was only It from one end of the block to the other and that adequate drainage would not be obtained until curb and gutter had been installed on this street. He also stated that in his opinion the blacktopping would improve the present drainage but he could not guarantee good drainage with just blacktopping. The Mayor presented the file from the Consulting Engineers Mc Gregor and Davis stating that they had checked this street and found it to be to proper grade. It was moved by Council~an Walters and seconded by Councilman Littlejohn that the matter be referred to the Village Engineers for further study.Carried. It was moved by Councilman Walters and seconded by Mayor Christian that action on these improvements be postponed until the regular meeting on Monday, June 11th. Carried. ,~ III. The Acting Village Manager, LeRoy Harlow presented a letter from Mr. J Iverson requesting that his resignation from the Zoning Commission be accepted. The letter was accepted and ordered filed. _ ~/ IV. The Acting Village Manager stated that the present ordinance covering dogs in the Village was creating a hardship on owners of female dogs in that it required an affidavit from a veterina rian stating that the female for which the owner is applying for a ense had been properly spaded. Due to the fact that many of these dogs are brought in from out of toim, it was diffucult to obtain such an affidavit. It was the opinion of the Council that the present ordinance would allow such owners to present to~the Village an affidavit. stating that the dog in question had been properly spayed. ~ V. The Acting Village Manager asked the Council for a statement of policy on carrying ]3ability insurance on the Ball Park.
