RESOLUTION RELATING TO FENCE ON PUBLIC
RIGHT-OF-WAY - 6432 21ST AVENUE SOUTH
WHEREAS, Mr. Americo DiCicco of 6432 21st Avenue South has requested
permission from the city council to allow a decorative cedar split rail
fence to remain on a public street right-of-way, said fence being located
8 feet into the boulevard and 4 feet from the street, and
WHEREAS, Ordinance Code No. 3.39, Subd. 2, Yards (e) reads as follows:
".....No walls, fence, or hedges shall be constructed or permitted on
any boulevard area or public right-of-way."
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Richfield, Minnesota, as follows:
1. Permission is hereby granted to allow a decorative cedar split
rail fence to remain on public right-of-way at 6432 21st Avenue South with
the stipulation that if at any time in the future the city finds it necessary
to use this right-of-way the property owner will be required to remove the
fence.
Adopted by the City Council of the City of Richfield this 12th day of
