RESOLUTION N0. 5496-
RESOLUTION DENYING GENERAL
AMUSEMENT-LICENSES TO ESTABLISHMENT
AT 611 EAST 77TH STREET
BE IT RESOL~IED by the city council of the City of Richfield,
Minnesota, as follows:
- I. The council herewith finds and determines:
1. Richfield Ordinance Code X5.18 requires that
a license be obtained for each amusement device which
i.s used in the city.
- 2. An application has been made by J. Richard
- Anderson fora renewal•of the amusement device licenses
- first granted him in September, 1975.
3. The amusement devices for which licensure is
- sought are all located at-611 East 77th Street and are
- - used in the operation of an arcade known as the
- - Toy Pony.
4. On February 9, 1976, the City Council after
public hearing voted to deny issuance of the requested
licenses. unless between that date and March 8, 1976 the
ownership of the Toy Pony could satisfy the city that
operation of the machines for which licensure is sought
------cnu-ld-~e-~vnclucted-- in a manner -consistent ~tY~ the public
health, safety, welfare and morals of the community and
within the requirements of Richfield Ordinance Code X5.18.
5. On or about February 1'7, 1976 an employee of
the Police Division of the Richfield Public~Safety Depart-
ment was present on the business premises of the Toy Pony
and while there observed that cardboard signs had been
placed on two pinball machines which read as follows:
"Todays
gets hip
tonight
working
100,000
machine
high score machine. The person who
'hest score on this machine by 9:30
wins $1.00 in cash, the person
must see score to qualify, if over
points, persons working must see
being turned over."
Such a contrivance constitutes a gambling device as
that term is used in Minn. Stat. X609.75.

6. The granting of the requested amusement device License
to t'he Toy Pony would not be consistent with the requirements
- of Richfield Ordinance Code X5.1$ and would be contrary to
- the public health, safety, welfare and morals.
7. The application far licenses to operate amusement .-
~~ devices at Ell East 77th Street is therefore denied and
..the applicant, its agents, employees and owners are directed
.. ~. to immediately cease operating and offering for operation or
- use all amusement devices located on the premises at
Ell East 77th Street.'
