The council herewith finds and det~:rmines: a . Riohfield City Code Sec~:iors 11.02 , subdivision 3 , tai ovides in substance that a license is required for the salty of non-intoxicating malt liquor. b. An application has been made for a permit to ali::vv the r~9tail sale of non® intoxicating malt liquor, on4sale and off-sale, at 1120 East 00th Street. c. The property for ~rrhich the license is sought previously operated as a rest~:ur- ant without having a license to sell a-~c~~~-intoxicating malt liquor on sale or off sale. d. The restaurant building is located in exceptionally close proximity to neigh- boring residences. The sale of non-intoxicating malt liquor on the premises would create potential problems for and might have a disruptive and deprecl,ating infl~:~F~nce upon the neighborhood in which the subject premises are located. e. The restaurant is located near the municipal swimming pool and l.ce arena. Large numbers of young people go to and from these facilities, past the subject property. f. At the city council meeting of September 24, 1973 residents in the vicinity of the subject premises came to the city council, opposed the granting of the license. g. There are other establishments in the general area of. the subjeot property where non-intoxicating malt liquor is being sold and, from the standpoint of availability of various retail services, there is no need for another estab'aisl~ment in this general vicinity where non-intoxicating malt liquor is sold. h. It is the further judgment of the council that no a~'ditional licenses should be granted in the general area of the subject property, for the sale of non-intoxicating malt liquor at on-sale and off-sale .and that the granting of an addit~.c~n.ai license at the subject property at this time would be or waould tend to be contx°ary to thk pu4~lic health, safety, morals and general welfare. 2. The application for a lice?~~se to sell non-intoxicating rr~alt liquor at a restaurant located at 1120 East 66th Street is ¢h~refore denied.
