1973-4973rRESOLUTION 11TOa 4973 RESOLUTION SUPPORTING REIMBURSEMENT TO MUNICIPALITIES OF COSTS INCURRED IN RELOCATING UTILITIES ON ALL STATE TRUNK HIGHWAY'S WHEREAS, many municipalities have utilities located in State Highways, and WHEREAS, State Highways have been, and will continue to be upgraded. and changed, thereby making it necessary to relocate the utilities within the l~iighway` and WHEREAS, under the present Minnesota Statutes, municipalities cannot be re~ imbursed for the costs incurred in relocating such utilities g except in connection with routes which are within the N~;~tional System of Interstate Highwayso and WHEREAS, the host of relocating such utilities cannot usually be assessed because the benefitted landowners were previously assessed for the same improvement, with the result that such costs must be paid out of the general funds of the municipality, and WHEREAS, the cost of relocating such utilities should be placed upon the users of the highways because such relocating is attributable to highway construction for the benefit of highway users; and WHEREAS, legislation is being introduced in the Minnesota State Legislature authorizing reimbursement to municipalities of costs incurred in relocating utilities on all state trunk highways and not dust those Highways within the National System of Interstate Highways . NOW, THEREFORE, BE TT RESOLVED that the City of Richfield does hereby support legislation authorizing reimbursement to municipalities of. costs incurred in relocating utilities on a 11 state trunk highways , BE IT FURTHER RESOLVED that copies of this resolution be sent Hennepin County Legislators and the League of Minnesota Municipalities e Passed by the City Council of the City of Richfield this Z3rd day of April, 1973, ren L o Law L ~ Ma yor ATTEST: ~ n Thomas J.
