RESOLUTION RELATING TO REZONING APPLICATION OI'
SHELTER. DEVELOPMENT CORPORATION
BE IT RESOLVED by the City Cou~aci1 of the City of Richfield, Minnesota, s.s
follows:
The Council makes the following findingss
1. Shelter Development Corporation has requested that certain property
described in proposed rezoning ordinance Bill No. 1972®21 be rezoned to the multiple
residence classification, The property involved consists primarily of single family
residence property, but includes a small area of general commercial propertya

Among these representations are the followings
a) If rezoned as applied for, the property will be developed with a
13-story high-rise building and appurtenant facilities to provide housing
for the handicapped and low and moderate income aged,

b) The pro,~ect will conform with the layout provided in support of the
application, with reference to parking space, green space, vehicular access
to and from Lyndale Avenue only, etc.
c) If the application is granted, the applicar~f :ail1 provide the-city with
a deed to abutting property on the shoreline and in the bottom of Richfi~;ld
Lake so as to assure the city that this area will be preserved for public use
and open space on a permanent basiso
3. The City of Richfield presently contains a large number of multiple resi-
dence units. There is no present shortage of general multiple residence unit
development within the city,
4~ It has been represented to the council, however, and the council finds
that there is a need.. for housing for handicapped and low and moderate income ei.derly
in this community. In order to serve this need, and in reliance upon the applicant's
application herein, the council is giving consideration to the rezoning here applied,
for. The council is giving consideration to the rezoning application in reliance
upon the applicant's representation that the property involved will be developed
to provide housing for the handicapped and low and moderate income elderly. The
property involved would not be suitable for general multiple residence development,
except as a location for housing for the handicapped and low and moderate income
elderly.
S. In the event that the rezoning application is granted the rezoning shall be
deemed to be only for the purpose of making the property eligible for development
as a multiple residence for the handicapped and low and moderate income elderly.
In the event that the property is not so developed commencing during 1973, the council
herewith declares its intent to take whatever action is necessary and appropriate to
rezone the property back to its present zoning. `fie applicant and all other
interested parties are hereby notified that they wi11 x~.ot be just~.fied in relyi~.g~
upon the anultiple residence zoning of the sub~es;t property for any de~elopmex~t
other than that which has been proposed for the property by the applicant.
