RESOLUTION NO. 4586
RESOLUTION GRANTING VARIANCES
FOR A PARKING LOT AT 6615 and 6621 HARRIET AVENUE SOUTH
BE IT RESOLVED by the City Council of the City of Richfield, Minnesota ,
as follows:
1. The council herewith finds and determines:
A. Section 4.05, Subdivision 8, Item 1 provides in -substance that
a parking lot adjoining or adjacent to any residential or~multiple residential property
must have rear and side yard setbacks of at least 15 feet and that this setback area
must be maintained free of parking, dust, mud and refuse at all times .
B. An application has been made for variances from this ordinance
provision fora 15 foot variance ffom the side yard setback at the South end of the
proposed parking lot, and fora 12 foot variance for a rear yard setback at the East
end of the parking lot.
C. The property adjoining the land where the applicant wishes to
construct a parking lot is residential or multiple residential and therefore a variance
is required.
D. The applicant has adequately presented his case for the variances
to the City Council including an explanation of the proposed construction.
E _ The application of the provisions of Section 4.05, Subdivision 8,
Item 1 to the site in question would cause undue hardship to the applicant and owner
of the subject property.
F. There are circumstances unique to the subject property which
cause undue hardship to the applicant or the owner of the property justifying the
granting of the variances from the literal provisions of the ordinance.

G, To grant the variances applied for in this instance would be in
keeping with the spirit and intent of the zoning ordinance of the City.
H. There are_special circumstances and conditions affecting the
particular land involved in the application, not common to other properties in this
or similar districts which would justify the granting of the variances.
~C. The granting of the variances applied for is necessary for the
preservation and enjoyment of substantial property rights.
J. The granting of the variances applied for will not materially and
adversely affect the health or safety of persons residing in the neighborhood of the
applicant and will not be materially detrimental to the public welfare or injurious to
property or improvements in the neighborhood .
2. The application for variances from the provisions of Section 4.05,
Subdivision 8, Item 1 of the ordinance code of the City of Richfield to construct a
parking lot with less than the required setback are therefore granted.
Passed this 28th day of June, 1971 by the City Council of the City of
Richfield, Minnesota.
