1971-4510r~~ RESOLUTION NO. 4510 RESOLUTION OF INTENT REGARDING THE 1971 AND 1972 COMPENSATION AGREEMENT FOR MEMBERS OF THE INTERNATIONAL UNION OF OPERATING ENGINEERS LOCAL 49 WHEREAS, the Metropolitan Area Management Association, representing approximately thirty suburban communities in the Twin City Metropolitan area, did through its negotiating committee enter into discussion with the International Union of Operating Engineers Local 49 in accordance with Section 179.50 of the Minnesota Statutes , and WHEREAS, the discussions between the negotiating committee of the Metropolitan Area Management Association and the representatives of the International Union of Operating Engineers Local 49 have resulted in agreement, and WHEREAS, the Metropolitan Area Management Association has recommended to all of the communities it represents that the agreement be implemented, and WHEREAS , such an agreement between the negotiating committee of the Metropolitan Area Management Association and the International Union of Operat- ing Engineers Local 49 must be approved by the City Council-before the agreement can become effective, and WHEREAS, the City Council has thoroughly reviewed the items contained in this agreement and wishes to approve the agreement reached by the negotiating committee of the Metropolitan Area Management Association with the International Union of Operating Engineers Local 49; NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Richfield that it is the intent of the City Council to provide for the following: 19 71 Agreement 1. A salary rate of $768 per month for the top salary step for the Equipment Operator I and $838 per month for the top salary step for the Equipment Operator TT. The Jacobs Company recommendations for salary structure and percentage relationships between positions would be followed in establishing the rates for other position classifications within the Inter- national Union of Operating Engineers Local 49. Those employees who receive less than sixty dollars according to the Jacobs recommended salary structure shall be granted a maximum increase equal to sixty dollars with the provision that the rate is frozen until the employee leaves the position or the pay grade is raised to cover his present rate. ~ ~s €_ t. 1971 Agreement (Continued). -20 2 , The new salary rates for 1971 to become effective on the first day of the pay period closest to January 1, 1971 (December 28, 1970), 3, Adoption of the Federal and State holiday schedule which provides for nine guaranteed holidays . 4. The city claims the authority to schedule employees work. A normal work day for employees shall be 8 hours between 8:00 a.m. and 4:30 p.m. The normal work week shall be Monday through Friday. Tt is recognized by the parties that service to public may require the establishment of regular shifts for some employees on a daily, weekly, seasonal, or annual basis other than the normal 8 to 4:30 day. The employer will give advance notice to the employees affected by the establishment of work days different than the normal employees' work day, In the event that work is required because unusual circumstances such as (but not limited to) fire, flood, snow, sleet, breakdown of municipal equipment or facilities, no advance notice to the employees need be given. It is not required that an employee working other than the normal work day be scheduled to work more than 8 hours, however, each employee has an obligation to work overtime if requested unless unusual circumstances prevent him from doing so, It is also recognized by the parties that service to the public may require the establishment of regular work weeks that schedule work on Saturdays and/or Sundays , Employees who are regularly scheduled to be on duty Saturday and/or Sunday will be granted two consecutive days off in lieu of Saturday and/or Sunday. 5. The city shall defend employees facing legal charges as a result of their job performance when they are proceeding under their supervisor's direct orders. Employees involved in litigation because of negligence, ignorance of laws, non observance of laws or as a result of an employee'"s judgmental decision on the job will not require legal protection from the city. 6 , A Master Work Agreement shall be written to cover basic work conditions of employment in all municipalities for members of the International Union of Operating Engineers Local 49. 7 , The city will continue to pay the full cost of the employee health insurance premium , 8. All other fringe benefits established by the personnel ordinance will remain unchanged for 1971. er -3- 1972 Agreement 1. A salary increase. effective the first day of the pay period closest to January 1, 1972 equal to the percent of increase in the Twin City area cost of living for October 1970 to October 1971 or a $50 increase, whichever is greater. 2 , The city will continue to pay the full cost of the employee health insurance premium; all other fringe benefits established by the personnel ordinance will remain unchanged for 1972.
