1970-4372r9 RESOLUTION No. 4.372 RESOLUTION ON POLICY FOR ANNUAL STREET IMPROVEMENT PROJECTS WHEREAS ® it has been the practice of the city to conduct an annual street improvement program for the purpose of improving non-permanent streets in the City, and WHEREAS, there has been an effort to improve these streets every 3 to 5 years, and WHEREAS, the practice has been for the city to levy a 14~ per front foot annual assessment against all property owners for this improvement, and WHEREAS, the city council on April 13, 197Q, passed a resolution and policy for annual street improvement projects identified as resolution number 4354 and at this time is desirous of changing said policy NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Richfield that the city adopt the following general policies for the annual street improvement program: 1, That the total cost of this improvement include material, manpower, equipment, financing, and administrative overhead required for the special assess® meat procedure and performance of this work and that this cost be assessed against only those property owners with front footage abutting on the improved right-of•~way. 2 , That the term "front footage" shall mean the number of feet on the front or short side of the lot, whichever is less, with the following exceptions: a . That in the case of irregularly shaped lots front footage will be determined by the same formula used for the sanitary sewer lateral assessment policy. b, ~ That in the case of tax exempt property front footage shall include all abutting footage on improved rights-of-way. c. That in the case of properties with the front or short side of the lot abutting permanently improved streets ® front footage shall mean side yard footage in an amount equal to the number of front feeto d. That in the case of alleys front footage shall mean the total number of feet abutting upon an improved alley. Where the property abuts upon more than one alley the shortest side of the prop®rty shall be assessed for all®y improvements . In at~.dition, those properties that abut an alley but rec®iv® no special ben®fit shall not be assess®d for improveiia®nts to the abutting all®y. ~~ Res. 4372 -2-• 3. That the assessment for the annual improvement program on streets shall be 60~ a front foot spread over a three year period with an 8% per annum interest rate for those property owners electing to pay over the three year period, Property will not be assessed any more frequently than once every three years for ian.provemer?.t of the same street. 4. That the assessment for the annual improvement program on alleys shall be at the rate of 20~ a front foot spread over a three year period with an 8% per annum interest rate for those property owners electing to pay over the three years for improve meat of the same alley. 5 < That the cost of annual street improvements for a street torn up for storm sewer or other utility installations be included as part of the utility installation cost and not be assessed against the abutting property unless the street in question has not been improved for a period of three years prior to the construction work in which case the normal assessment will be made in accordance with this policy. 6 < That any street scheduled for improvement but on which work is not performed shall be deleted from the. assessment area. 7 , That the cost of the annual street improvement program which exceeds the total assessment as defined by this policy shall be financed by general city revenue. 8. That the policies contained in this resolution shall be subject to modifi® cation if necessary in individual cases as the city council determines that the assessment or assessments resulting from the application of the policies will exceed the benefits received.
