1970-4354rRESOLUTION Noe 4354 RESOLUTION ON POLICY FOR ANNUAL STREET IMPROVEMENT PROJECTS WHEREAS, it has been the practice of the city to conduct an annual street improvement program for the purpose of improving all streets in the city, and WHEREAS, there has been an effort to improve each street every three to five years, and WHEREAS, the practice has been for the city to levy ~a 14~ .fir front foot assessment against all property owners for this improvement; , and ~~"~ WHEREAS, it is the opinion of the city council that this practice should be changed and that an assessment should be made against only those properties fronting on the improvement; '.~ NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Richfield that the city adopt the following general policies for the annual street improvement program: 1. That the total cost of this improvement, including material, manpower, equipment, financing, and administrrative over-head required for the special assess- ment procedure and performance of this work, be assessed against only those pro- perty owners abutting on the improved street, 2, That the assessment for strreet improvements of this type be determined by totaling the cost for all streets improved duffing the year and then dividing by the number of assessable feet of abutting properties affected to determine a cost per foot, Said cost would be assessed against the number of feet on the front, of the lot or the short side of the lot whichever is less. Corner lots would be assessed for improvements made along the long side of such lots as well as for im- provements made along the short side, with the short side dimension used for computing benefited frontage in either case . 3. That the assessment for any alley improvement be determined by totaling the cost for all alleys improved during the year and then assessing at a cost per foot against abutting properties on both sides of the alley. 4. That the assessment for this improvement be spread over a three year period and that the interest rate for those property owners electing to pay over the three year period would be 8%. Property will not be assessed any more frequently than every three years for improvement of the same street. 5. That the cost of the street improvement torn up for storm sewer or other major utility installations be included as part of the utility installation contract and not be assessed against the abutting property owner, unless the- street in question has not been improved for a period of four years prior to the construction work in which case the normal assessment will be made against the abutting pro- perty owner. 2 - 6o That the normal assessment would be made against any governmental property or otherwise tax exempt propertyo 7 o That the foregoing general po3.iciss shall be subject to modification if necessary in individual cases if. the council determines that the assessment or assessments resulting from the application of the policies will exceed the benefits received o Passed by the City Council of the City of Richfield this 13th day of April, 1970° ~< Stanley W o Olson Mayor Attest: ~~~ ~ ~ Thomas ja oran Clerk
