1970-4330r~a RES®LUTION N(9. 4330 ~1 I ~ 1 RES®LU?'ION RE~;~lGNI2ING THE NEED F®R UNIFORM SNCWMOBII,E REGUI~ TIONS WITHIN T€€E MUNICIPALITIES OF HENNEPIN COUNTY WHERE.9S, the operation of snowmobiles has become a rapidly growing re- creational activity throughout the State of Minnesota; and, WHEREAS, the State Legislature in Minnesota Statutes 1967 Section 84.86 Subdivision 1 has state~39 in effect, that the public policy of the State of Minnesota sha11 be to achieve maa~imum use of snowmobiles; and, WHEREAS, the incidence of snowmobile operations has increased substan- tially in urban areas of the State during the past few years, and in particu- lar throughout Hennepin County; and, WHEREAS, the extent of snowmobile activity, the nature of the vehicles, and the e~:istence of a small proportion of irresponsible operators have com- bined to create a threat to the health, safety and general welfare of citizens of certain municipalities with Hennepin County; and, WHEREA59 the several municipal councils have enacted variously, the re- gulatory ordinances deemed in the best interest of their respective municipal- iti~u°y and, WHEREAS, the variations among municipal ordinances within Hennepin County are difficult if not impossible to discover and interpret by snowmobile opera- tors who plan trips crossing several municipal boundaries; and, WHEREAS, some variations may be viewed by snowmobile operators as dis- criminatory in nature and thus unconstitutional or unreasonable; and, WHEREAS, such claims of unreasonableness may cause the State Legislature to pass uniform snottmobile regulations on a state-wide basis which-are adverse to the metropolitan area municipalities, thus pre-empting the municipalities from controlling their environment: NOW, THEIt'EFOi2E, BE IT RESOLVED by the City Council of the City of Richfield tha'~ uniformity in snowmobile regulations throughout Hennepin County is a dust and reasonable goalo ~BE I1' FURTHER RE90LVED that Arthur P.
