1968-3986r RESOLUTION No. 3986 RESOLUTION AUTHORIZING ACQUISITION OF HIGHWAY SERVICE DRIVE RIGHT-OF-WAY -- HIGHWAY 494 and PENN AVENUE. WHEREAS, it is proposed to relocate the north service drive of Interstate Highway No. 494 at Penn Avenue so that such service drive enters on Penn Avenue at a point further north than the present point of entry, and WHEREAS, to accomplish this it is necessary to obtain certain highway right-of-way for such relocated service drive from Shell Oil Company, among others, and WHEREAS, Shell Oil Company has agreed to provide such right-of-way provided that certain payments are made to it by the State o£ Minnesota and the City of Richfield, and WHEREAS, the sum payable by the City of Richfield to effect the acquisition of such right-of-way from Shell Oil Company is the sum of $10,000, and WHEREAS, other property owners in the vicinity have contributed this sum of $10,000 to the city and have indicated their willingness to permit such sum to be paid to Shell Oil Company for the purpose of making a payment toward the cost of such right-of-way, and i WHEREAS, the other necessary right-of-way has already been obtained or has been promised to the city by the owners of the other properties involved, and WHEREAS, if such right-of-way is acquired, Shell Oil Company will revise the layout of its service station at the northeast quadrant of the intersection of Highway 494 and Penn Avenue, and WHEREAS, the layout of such service station, as so modified, has been reviewed by the city and has been found to be acceptable, NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Richfield as followsc to The mayor and manager are hereby authorized and directed to enter into a memorandum of agreement with Shell Oil Company agreeing to proceed with the ac- quisition of such right-of-way from Shell Oil Company and the payment to Shell Oil Company of $10,000 as a contribution toward the cost thereof as hereinbefore set forth. 2. The payment for such acquisition of right-of-way shall be made from the sums received by the city from the aforesaid owners of properties in the vicinity of such project so that such right-of-way acquisition shall be without expense to the city. 3. Such right-of-way shall be granted to the Highway Department of the State of Minnesota. ~~~.~ _ - 2 - I 1 4.
