STAFF REPORT NO. 148 CITY COUNCIL MEETING 10/22/2024 REPORT PREPARED BY:Julie Urban, Asst. Community Development Director DEPARTMENT DIRECTOR REVIEW:Melissa Poehlman, Community Development Director 10/14/2024 OTHER DEPARTMENT REVIEW: CITY MANAGER REVIEW: Katie Rodriguez, City Manager 10/15/2024 ITEM FOR COUNCIL CONSIDERATION: Consider awarding American Rescue Plan Act funding to non-profit organizations to provide services and activities that aid in the recovery of Richfield community members negatively impacted by the COVID-19 pandemic. EXECUTIVE SUMMARY: In 2022, the City designated $420,000 in American Rescue Plan Act (ARPA) funds toward social services that would help to mitigate the negative impacts of the COVID-19 pandemic, especially for those residents disproportionately impacted, including households with low incomes and those residents who are Black, Indigenous and People of Color (BIPOC). The City committed $264,700 of these funds to organizations in 2022 and 2023. Earlier this year, the City committed an additional $60,000 to assist homeowners with the clean-up of homes affected by clutter and hoarding issues. The remaining $94,881.06 was made available in a Request for Proposals (RFP) issued on September 12. Six organizations submitted proposals, and staff recommends the following five organizations be awarded funds: Organization Request Recommended Amount Type of Service VEAP $ 47,600 $41,576.06 Case management, referrals, food (based in Richfield) Tapestry $ 8,305 $ 8,305 Community meals/language classes Reach for Resources $ 11,489 $ 5,000 Recreation/social activities for people with disabilities Cornerstone $ 75,628 $ 20,000 Advocacy/emergency shelter for victims of domestic violence Senior Community Services $ 20,000 $ 20,000 Chores and maintenance/Technology for seniors TOTAL $ 192,757 $ 94,881.06 The terms of the Agreements will run from November 1, 2024, through October 31, 2025. All ARPA funds must be expended by the end of 2026. RECOMMENDED ACTION: By motion: Approve a resolution awarding $94,881.06 in American Rescue Plan Act funding to five non-profit organizations aiding community members negatively impacted by the COVID-19 pandemic, and authorizing the Mayor and City Manager to execute Professional Service Agreements with the organizations. 19 Mayor and City Manager to execute Professional Service Agreements with the organizations. BASIS OF RECOMMENDATION: A.HISTORICAL CONTEXT The City was allocated $3.972 million in Coronovirus Local Fiscal Recovery Funds under ARPA in 2021 to assist the City in the recovery from the COVID-19 pandemic. In 2022, the City utilized $1.296 million in ARPA funds for a variety of immediate needs, including an award of $100,000 to VEAP to provide emergency rent assistance and $20,000 to Cornerstone Advocacy Services for domestic violence-related services. On September 13, 2022, the City Council adopted a plan for spending $2.6 million of remaining ARPA funds on a variety of activities, including $300,000 in funds to social services agencies for direct service to community members. The COVID-19 pandemic has had a negative economic impact on members of our community, especially those with lower incomes and those who are BIPOC. An initial RFP was issued in 2023, and the Council awarded $160,000 to seven organizations on March 14, 2023. A report on those activities is attached to the Council report. A second RFP was issued on September 12, 2024. Six proposals were submitted, and five are being recommended for funding. The sixth proposal was submitted by Richfield Dual Language School Foundation requesting funds for a playground sun shade feature; however, this is a capital cost which is an ineligible expense as defined by the RFP. Funds are intended to fund services and activities that help economically disadvantaged Richfield community members and mitigate the negative impacts on these communities. Several priorities are identified for the funds, including: promoting housing security and stability, promoting healthy childhood environments, promoting healthy and safe living environments, promoting economic stability, improving healthy food access, building strong communities, and reducing racial disparities. B.EQUITABLE OR STRATEGIC CONSIDERATIONS OR IMPACTS The services are consistent with the City's Strategic Plan initiatives advancing Community Development and Equity and Inclusion. The organizations funded in 2023 provided services to people disproportionately impacted by the pandemic, including people with low incomes (100%), people who are Black, Indigenous and People of Color (BIPOC) (26%), and those who are Latine (38%). C.POLICIES (resolutions, ordinances, regulations, statutes, exc): The final ARPA rules provide flexibility to the City in determining how to spend the funds, and the Council determined that it was important to provide some direct support to the community and to those community members disproportionately impacted by the pandemic. D.CRITICAL TIMING ISSUES: ARPA funds must be obligated by December 31, 2024 and spent by December 31, 2026. Agreements require expenditures by October 31, 2025. E.FINANCIAL IMPACT: Staff is recommending that the remaining $94,881.06 in social services funding be awarded to five organizations. Grant recipients may spend up to 10% of the grant on administrative expenses. City legal expenses have been deducted from the total available and a small amount of funds committed but not spent from the original RFP round have been added to the total funds available. F.LEGAL CONSIDERATION: The proposed uses are consistent with guidelines for federal ARPA funds. The City Attorney prepared the Agreements for ARPA awards. ALTERNATIVE RECOMMENDATION(S): Decide not to allocate ARPA funds to these organizations at this time. PRINCIPAL PARTIES EXPECTED AT MEETING: Representatives from the organizations may be in attendance. STAFF REPORT NO. 149 CITY COUNCIL MEETING 10/22/2024 REPORT PREPARED BY:Jamie Haefner, Human Resources Manager DEPARTMENT DIRECTOR REVIEW:Sack Thongvanh, Assistant City Manager 10/14/2024 OTHER DEPARTMENT REVIEW: CITY MANAGER REVIEW: Katie Rodriguez, City Manager 10/22/2024 ITEM FOR COUNCIL CONSIDERATION: Consider adoption of a resolution designating the City's contribution towards health, dental, term life, and disability insurance premiums for 2025. EXECUTIVE SUMMARY: The City contributes to the cost of premiums for four tiers of health insurance available to City employees. The full-time employee contributions are discussed within this staff report as well as contributions toward health insurance for part-time regular employees. This year's increase is 12.9% and is based on moving to a higher band level. The band levels are established by HealthPartners, Gallagher and LOGIS and are based on claims. There are no changes to Dental, Life Insurance or Long Term Disability for 2025. RECOMMENDED ACTION: By motion: Adopt a resolution designating the City's contribution toward health, dental, term life, and long term disability insurance premiums for 2025. BASIS OF RECOMMENDATION: A.HISTORICAL CONTEXT The first type of insurance coverage available to employees is group health coverage. The City will continue to offer plans through HealthPartners (HP). In 2025, the City will continue to offer employees a choice of three HP plans, with the choice of three networks for all plans. The plans include three high deductible plans with a Health Savings Account (HSA). Employees can choose between the Open Access, Perform, and the Achieve networks. The Perform network is slightly less costly because it does not include Mayo as an in-network provider, and the Achieve network is up to six percent less than the other networks because it includes only the HealthPartners and Park Nicollet Care Systems. In an effort to remain flexible and keep rate increases as low as possible, LOGIS will continue to offer a four-tier system, giving employees the choice of employee only, employee plus spouse, employee plus child(ren) and family option coverage. By providing this four-tier rating system, some employees are able to benefit by choosing the employee plus spouse option or employee plus child(ren) option. HEALTH INSURANCE FOR FULL-TIME EMPLOYEES (30 hours or more weekly) For the employee only tier, the City will continue to pay the full employee premium, between $880.00 and $1,059.00 per month, as well as an HSA contribution with a maximum of $200 per month. Staff propose splitting the 12.9% insurance premium increase between employees and the City for all other coverage tiers. The City will 28 contribute between $1,572.63 and $1,642.38 per month for the employee plus spouse and employee plus child(ren) tiers and between $1,839.84 and $1,922.84 per month for the family coverage tier. The 2025 monthly premium costs of the three offered health plans are dependent on the type of network selected. Employees have the option to waive health insurance coverage through the City. HEALTH INSURANCE FOR PART-TIME REGULAR EMPLOYEES (20-29 hours weekly) The City will contribute between $782.13 to $914.00 per month towards employee only tier premium, between $815.46 and $885.21 per month for the employee plus spouse and employee plus child(ren) tiers, and between $910.82 to $993.82 per month for the family coverage tier. DENTAL The second type of insurance provided to full-time employees is a self-funded group dental insurance. In 2024, the City contributed $60.25 per month per employee for the total cost of employee (not dependent) coverage. For 2025, the City’s contribution will remain the same. Employees who desire family or employee plus spouse coverage must pay the full cost of the additional premium, which will be the same rate as 2024. LIFE The third type of insurance provided to full-time employees is a $35,000 term life insurance policy. The City pays the full premium for this insurance. The overall cost to the City for this service is anticipated to stay the same in 2025. LONG-TERM DISABILITY (LTD) The fourth type of insurance provided and fully-funded by the City to all full-time employees in all employee groups is long-term disability insurance (LTD). LTD is provided through a group policy secured by the City. Madison National/Ochs has a premium rate of $0.18 per $100 of covered payroll for a two-year period, which began in 2024. B.EQUITABLE OR STRATEGIC CONSIDERATIONS OR IMPACTS The City’s recommended benefit plans directly align with our Strategic Plan priority for a stable and high-quality workforce, which includes attracting new employees and increasing employee retention to be at full authorized strength. C.POLICIES (resolutions, ordinances, regulations, statutes, exc): The City continues to provide adequate insurance protection for its employee groups, which are comparable to employees performing similar jobs in similar communities. D.CRITICAL TIMING ISSUES: The Council needs to approve the City premium contributions in order to implement open enrollment for staff which is scheduled to begin October 28, 2024. E.FINANCIAL IMPACT: The estimated funding to provide for the recommended City premium contributions are accounted for in the 2025 Budget. Final costs will depend on the employees selection of health insurance plans: insurance fund reserves are available to cover actual costs that exceed the budget. F.LEGAL CONSIDERATION: In order to provide the requested insurance benefit changes, the City Council must approve the resolution designating the City's contribution toward health, term life, long-term disability, and dental insurance premiums for all employee groups. ALTERNATIVE RECOMMENDATION(S): The Council may decide to adjust the City's contribution to dependent health insurance by an amount other than the proposed increase per month. For part-time employees working 20-29 hours weekly, the City shall contribute between $782.13 to $914.00 per month towards individual health insurance, $910.82 to $993.82 per month towards family coverage and $815.46 to $885.21 for dependent coverage. Actual City contribution will be dependent on the plan selected by the employee. STAFF REPORT NO. 150 CITY COUNCIL MEETING 10/22/2024 REPORT PREPARED BY:Chad Lunder, Chief Building Official DEPARTMENT DIRECTOR REVIEW:Melissa Poehlman, Community Development Director 10/14/2024 OTHER DEPARTMENT REVIEW: CITY MANAGER REVIEW: Katie Rodriguez, City Manager 10/15/2024 ITEM FOR COUNCIL CONSIDERATION: Consider a request to authorize the Minnesota Department of Labor and Industry to assume the responsibilities for electrical inspections in the City of Richfield. EXECUTIVE SUMMARY: The City has conducted its own electrical inspections since 1955. Historically, we have entered into private contracts with electrical inspectors to do this work. One of our two inspectors retired this past summer and our second inspector will be leaving us in December of this year to work full time for the Minnesota Department of Labor and Industry (DoLI). There is a significant shortage of inspectors of all kinds, and we have been unable to find electrical inspectors to fill the role. While we would prefer to continue to offer residents and businesses local inspections, our only viable option is turn to DoLI for inspections. The City does not have enough work to justify the cost of a full-time employee for an electrical inspector role. A resolution authorizing DoLI to assume this responsibility is required. RECOMMENDED ACTION: By motion: Approve the resolution to authorize the Minnesota Department of Labor and Industry to assume responsibility for electrical inspections in the City of Richfield. BASIS OF RECOMMENDATION: A.HISTORICAL CONTEXT See Executive Summary. B.EQUITABLE OR STRATEGIC CONSIDERATIONS OR IMPACTS N/A C.POLICIES (resolutions, ordinances, regulations, statutes, exc): N/A D.CRITICAL TIMING ISSUES: A resolution must be adopted no later than December 1, 2024 because current inspector John Thompson will be starting his new position with the DoLI and will no longer be able to provide inspections for the City. E.FINANCIAL IMPACT: Electrical inspections generate approximately $100,000 in revenue annually; however, this money is used to pay the contract inspectors and administrative staff, and for the software involved. There is no cost to the City to have DoLI conduct electrical inspections in the City. 32 F.LEGAL CONSIDERATION: The City Attorney's office prepared the attached resolution. EXECUTIVE SUMMARY: The properties within the 6300 and 6400 blocks between 16th Ave S and Richfield Parkway have been redeveloped to construct two multi-unit apartment buildings and sixty four townhome units. The construction includes site improvements on both public and private property. The City has worked with the developer to draft a Construction and Maintenance Agreement (the "Agreement") that defines ownership and maintenance responsibilities for the site and public improvements constructed during the redevelopment project. These improvements and responsibilities include: Sidewalk and sidewalk snow removal Landscaping and irrigation Boulevard trees Roadway and pedestrian lighting Stormwater control devices Maintenance and cost responsibilities for the individual property owners are defined by a Reciprocal Easement and Cost Sharing Agreement, which is included as an exhibit in this Construction and Maintenance Agreement. BASIS OF RECOMMENDATION: A.HISTORICAL CONTEXT The City required the redevelopment to provide stormwater quality treatment before stormwater enters the City system. The onsite treatment system will help remove pollutants and particles before the water enters the public system. In order for the treatment system to function as designed, it must be inspected and cleaned regularly. 35 Drainage improvements are also being constructed on the site and include an underground stormwater detention system, a surface pond, and outlet control structures which temporarily store stormwater on the property before delivering it to the public system. In order for the drainage systems to function as designed, they must be inspected and maintained regularly. The Agreement provides direction on inspection, repair, replacement, and maintenance of the detention system, and the public improvements, in addition to the remedies for the failure to comply with the provisions of this agreement. B.EQUITABLE OR STRATEGIC CONSIDERATIONS OR IMPACTS Approval of such agreements constitutes regular City business as part of the redevelopment process. C.POLICIES (resolutions, ordinances, regulations, statutes, exc): The City requires a Construction and Maintenance Agreement for redevelopment projects containing public improvements and/or stormwater treatment structures. D.CRITICAL TIMING ISSUES: The redevelopment project is complete and approval of the Agreement is timely. E.FINANCIAL IMPACT: The Agreement requires the property owner to cover all costs related to inspection and maintenance of its stormwater detention system. The Agreement requires the property owner to reimburse the City for any costs incurred in performing activities identified as the responsibility of the property owner. Financial responsibilities of other items varies per the agreement. F.LEGAL CONSIDERATION: The City Attorney was consulted during the negotiations of terms and has reviewed the agreement. Owners must submit a certificate of insurance to the City in form and substance that is acceptable to the City Attorney. The policy must include minimum limits of $1,000,000 per occurrence and $2,000,000 annual aggregate. To meet these requirements, the Owners may use a combination of excess and umbrella coverage. 40 5 The City must be named as an additional insured on the policy. b.Indemnity. The City shall indemnify the Owners against any and all damages, losses, and liabilities arising out of the negligence or willful misconduct of the City’s employees or outside third party directed or hired by the City to perform activities under this Agreement. This Agreement shall remain in full force and effect until terminated by the mutual written agreement of the parties. If the use of the Property changes so that the Stormwater Improvements and Public Area Improvements are rendered as unnecessary, or are replaced by other facilities approved by the City, a termination of this agreement must be consented to by both parties and shall be filed with the County. d.Binding Effect. All duties and obligations of the Owners under this Agreement shall also be duties and obligations of the Owners’ successors and assigns. The terms and conditions of this Agreement shall run with the land, be binding on subsequent owners, and shall be recorded with the property records of Hennepin County, Minnesota. In the event an owner of any portion of the Property conveys any portion of the Property to a subsequent owner, such conveying owner’s obligations hereunder with respect to such portion of the Property will terminate as of the date of such conveyance. Notwithstanding anything in this Agreement to the contrary, if any portion of the Property is owned by a condominium or homeowners association or other similar entity (including, without limitation, the Association), the owner of such portion of the Property will be bound by and will cause the obligations of this Agreement to be performed in accordance with the governing documents of that organization. e.Recording. Aboveground Dry Pond – Shall be inspected twice yearly (after final snowmelt and following leaf fall) The purpose of the aboveground dry pond is to act as a rate control device for stormwater runoff generated from the site’s impervious surfaces. The pond receives stormwater runoff from the center driveway area, southern apartment building, and southern townhome building roofs and driveways. An outlet in the eastern end of the pond outlets stormwater slowly downstream into the city’s storm sewer system. A regional pond to the northeast of the Home Depot site provides water quality treatment consistent with the requirements of the City of Richfield and Minnehaha Creek Watershed District. The outlet structure of the aboveground dry pond consists of three parts: a primary 4” drain at the bottom of the pond (elevation 841.00), a 12” secondary, or overflow drain at elevation 844.00, and an emergency overflow (EOF) at elevation 845.30. The 100-year high water level (the peak water level elevation in the pond during a 100-year storm) is 845.29. The pond is designed to contain and slowly outlet any storm less than the 100-year storm provided the primary and secondary drains are free of obstructions. Any obstructions noted in the pond drains should be removed immediately. Storms larger than the 100-year storm will utilize the EOF. The inspection and maintenance checklist for the aboveground dry pond can be found on the next page. Inspections and necessary maintenance shall be carried out twice yearly (in spring following final snowmelt, and in autumn following leaf fall). 91 INSPECTION DATE: / / 20 INSPECTION ACTIVITY OBSERVATIONS/ MEASUREMENTS MAINTENANCE MAINTENANCE REQUIRED ACTIONS REQUIRED/DATE COMPLETED/RESPONSIBLE FOREMAN CONTRIBUTING AREAS: Inspect contributing areas (parking lots, roadways, sidewalks, catch basins, etc.) for erosion (bare dirt), trash, leaves, salt and sand. Inspect the pretreatment sump manhole immediately upstream for sediment accumulation. Notify appropriate maintenance staff or owner of need to sweep and or remove litter/debris. For erosion, seed and water bare ground to match surrounding plant material. Remove sediment accumulations in the sumped manhole immediately upstream of the inlet. Y / N / /20 Responsible Party: STRUCTURAL COMPONENTS: Stormwater inlets/outfall trash grates, manholes including castings, rings, pipe connections and risers. Maintenance staff shall investigate and repair any damaged or deficient structural components or blockages to pond inlet and outlets. Y / N / /20 Responsible Party: VEGETATION: Visual inspection of edge, pond slopes, and all landscaping adjacent to the basin. Report any observed problems or deficiencies to owner and landscape contractor for repair. Note if pond has used emergency overflow in recent storms. Reinforce turf if erosion has occured in emergency overflow location. Y / N / /20 Responsible Party: SURFACE/PIPE OVERFLOWS: Visual inspection of outlet structures and overland emergency overflow. Debris that is plugging or obstructing the overflows must be cleaned and removed. Note if water in recent storms has exceeded pond limits and used emergency overflow. Y / N / /20 Responsible Party: SEDIMENT ACCUMULATION: Annually or at the direction of city, measure sediment accumulation within the pond. Document accumulation near inlet location. Average depth of sediment: If sediment has reached 3" of depth or more at any location, remove accumulated sediment from pond to prevent washing downstream to regional water quality pond. Y / N / /20 Responsible Party: ABOVEGROUND DRY POND INSPECTION & MAINTENANCE CHECKLIST INSPECTOR: 92 b. Underground Detention Basins – Shall be inspected twice yearly (after final snowmelt and following leaf fall) The purpose of the underground detention basins is to act as rate control devices for stormwater runoff generated from the site’s impervious surfaces. The basins receive stormwater runoff from the center driveway area, the northern apartment building, and the northern townhome buildings and their driveways. Outlets at the northern ends of both basins slowly outlet stormwater downstream to the city’s storm sewer system and into the regional water quality basin which provides quality treatment consistent with the requirements of the city and watershed district. Access to the basins is provided from access risers in the pavement. It should be noted that all inspections of the basins should be performed from the pavement level. Do not attempt to climb into the basins without proper confined space training and equipment. The basins operate much like the aboveground dry pond with the exception that they are made of Corrugated Metal Pipe (CMP). One of the basins is made of 120” CMP, with the other being 42” CMP. Primary outlets at the bottom of the northern end of each system outlet stormwater slowly downstream. Secondary outlets are located higher than the primary outlets. See the utility plan for the outlet sizes and elevations. The basins are designed to contain and slowly outlet storms as large as the 100-year event, provided the primary and secondary outlets are free of obstructions. Any obstructions should be removed. If the outlets are obstructed, large storms may cause flooding and will outlet from nearby catch basins and manholes. The inspection and maintenance checklist for the underground basins can be found on the next page. Inspections and necessary maintenance shall be carried out twice yearly (in spring following final snowmelt, and in autumn following leaf fall). 93 INSPECTION DATE: / / 20 INSPECTION ACTIVITY OBSERVATIONS/ MEASUREMENTS MAINTENANCE MAINTENANCE REQUIRED ACTIONS REQUIRED/DATE COMPLETED/RESPONSIBLE FOREMAN CONTRIBUTING AREAS: Inspect contributing areas (parking lots, roadways, sidewalks, catch basins, etc.) for erosion (bare dirt), trash, leaves, salt and sand. Inspect the pretreatment sump manholes and catchbasins immediately upstream of the basins for sediment accumulation. Notify appropriate maintenance staff or owner of need to sweep and or remove litter/debris. For erosion, seed and water bare ground to match surrounding plant material. Remove sediment accumulations in the sumped manhole immediately upstream of the inlet. Y / N / /20 Responsible Party: STRUCTURAL COMPONENTS: Inlets, manholes including castings, rings, pipe connections and risers. Maintenance staff shall investigate and repair any damaged or deficient structural components or blockages to basin inlet and outlets. Remove debris with vacuum truck. Y / N / /20 Responsible Party: OUTLETS: Visual inspection of outlet pipes. Visual inspection for standing water anywhere in the system. Debris that is plugging or obstructing the outlets must be cleaned and removed to prevent standing water. Note if water in recent storms has exceeded system and overflowed nearby catch basins. Remove debris with vacuum truck. Y / N / /20 Responsible Party: SEDIMENT ACCUMULATION: Annually or at the direction of city, measure sediment accumulation within the basins. Document accumulations. Average depth of sediment: If sediment has reached 3" of depth or more at any location, remove accumulated sediment from basin to prevent washing downstream to regional water quality pond. Y / N / /20 Responsible Party: INSPECTOR: NOTE: VISUAL INSPECTION SHOULD ONLY BE FROM SURFACE INLETS OR MANHOLES. ONLY ATTEMPT TO CLIMB DOWN INTO UNDERGROUND BASINS IF ALL CONFINED SPACE PRECAUTIONS (INCLUDING TRAINING, SUPERVISION AND EQUIPMENT) ARE FOLLOWED. 94 Underground stormwater detention and infiltration systems must be inspected and maintained at regular intervals for purposes of performance and longevity. Inspection Inspection is the key to effective maintenance of CMP detention systems and is easily performed. Contech recommends ongoing, annual inspections. Sites with high trash load or small outlet control orifices may need more frequent inspections. The rate at which the system collects pollutants will depend more on- site specific activities rather than the size or configuration of the system. Inspections should be performed more often in equipment washdown areas, in climates where sanding and/or salting operations take place, and in other various instances in which one would expect higher accumulations of sediment or abrasive/ corrosive conditions. A record of each inspection is to be maintained for the life of the system. NOTHING IN THIS CATALOG SHOULD BE CONSTRUED AS A WARRANTY. CMP MAINTENANCE GUIDE 10/19 PDF © 2019 CONTECH ENGINEERED SOLUTIONS LLC, A QUIKRETE COMPANY ALL RIGHTS RESERVED. PRINTED IN USA. Maintenance CMP detention systems should be cleaned when an inspection reveals accumulated sediment or trash is clogging the discharge orifice. Accumulated sediment and trash can typically be evacuated through the manhole over the outlet orifice. If maintenance is not performed as recommended, sediment and trash may accumulate in front of the outlet orifice. Manhole covers should be securely seated following cleaning activities. Contech suggests that all systems be designed with an access/inspection manhole situated at or near the inlet and the outlet orifice. Should it be necessary to get inside the system to perform maintenance activities, all appropriate precautions regarding confined space entry and OSHA regulations should be followed. Annual inspections are best practice for all underground systems. During this inspection if evidence of salting/de-icing agents is observed within the system, it is best practice for the system to be rinsed, including above the spring line soon after the spring thaw as part of the maintenance program for the system. Maintaining an underground detention or infiltration system is easiest when there is no flow entering the system. For this reason, it is a good idea to schedule the cleanout during dry weather. The foregoing inspection and maintenance efforts help ensure underground pipe systems used for stormwater storage continue to function as intended by identifying recommended regular inspection and maintenance practices. Inspection and maintenance related to the structural integrity of the pipe or the soundness of pipe joint connections is beyond the scope of this guide. STAFF REPORT NO. 152 CITY COUNCIL MEETING 10/22/2024 REPORT PREPARED BY:Sam Crosby, Planner II DEPARTMENT DIRECTOR REVIEW:Melissa Poehlman, Community Development Director 10/14/2024 OTHER DEPARTMENT REVIEW: CITY MANAGER REVIEW: Katie Rodriguez, City Manager 10/15/2024 ITEM FOR COUNCIL CONSIDERATION: Consider a second reading of an ordinance amendment establishing zoning regulations for cannabis businesses. EXECUTIVE SUMMARY: Last year, the state legislature legalized adult-use cannabis, established the Office of Cannabis Management (OCM), and laid the groundwork for what will be a highly regulated new industry. Local authorities have until the end of this year to establish local regulations governing cannabis businesses. The City of Richfield’s regulations will be adopted in two separate ordinances – zoning regulations and registration regulations. The proposed zoning ordinance generally divides the new types of cannabis businesses into two main categories - retail businesses and non-retail businesses. Retail businesses (including medical marijuana sales) would be allowed in certain commercial districts as permitted uses, subject to distance separations from schools, parks, treatment facilities, and each other. The non-retail businesses would be allowed as conditional uses in the I (Industrial) district. The remaining cannabis business types that do not neatly fit into either of these categories are addressed as follows: Cannabis Delivery Business – Allowed as an accessory to a cannabis retail business. Cannabis Event Organizer – Allowed as an office use. Cannabis Transporter – Not included due to the City not allowing any other transportation or distribution business in the City. Cannabis regulations further address home occupations, and signage. The proposed ordinance also includes a few minor modifications regarding micro production facilities. Issues such as registration fees, the maximum number of retail locations, hours of operation, and low potency hemp edibles will be addressed by the registration ordinance. The Planning Commission held a public hearing on September 23rd. No one commented on the item. The Commission recommended approval of the ordinance as presented. RECOMMENDED ACTION: By motion: 1. Approve a second reading of an ordinance amendment establishing zoning regulations for cannabis businesses. 117 2. Approve a resolution authorizing summary publication of said ordinance. BASIS OF RECOMMENDATION: A.HISTORICAL CONTEXT Medical marijuana dispensaries have been allowed since 2015 as conditional uses in the C-2 zoning district only. Currently, they must be at least 1,000 feet from a public or private school, 1,000 feet from another medical marijuana dispensary, and 250 feet from residential property. As such, there are few available locations within the City. The City Council held a preliminary work session focused on edibles in September of 2022. The Minnesota Legislature legalized adult use cannabis in 2023 and made modifications to the law in 2024. It is likely that, like liquor laws, there will be semi-frequent changes to the laws related to cannabis in future legislative sessions. The OCM is currently in the process of drafting administrative rules; therefore, some details may change slightly after this ordinance is adopted, and ordinance updates may be required as the industry becomes established and matures. The City Council held another, broader, cannabis work session in July of 2023. The City Council and Planning Commission held a joint work session, focused on zoning and licensing, on July 9, 2024. In August, the proposed distance separation requirements were shared with the Richfield Public School District and their leadership appreciated the strong buffers between school sites and retailers, and encouraged a similar rigorous perspective in relation to business hours. B.EQUITABLE OR STRATEGIC CONSIDERATIONS OR IMPACTS For retail uses, the proposed ordinance includes distance separation requirements from schools, residential treatment facilities, and attractions within a public park regularly used by minors. These setbacks help to protect impressionable youth and vulnerable populations. The ordinance as proposed also includes distance separation requirements between retail locations. This provision helps to disperse sales throughout the community so as to not disproportionately impact one area more than another. As the industry continues to evolve, the City will need to be intentional about any unintended consequences that could arise. C.POLICIES (resolutions, ordinances, regulations, statutes, exc): New definitions for “school” and “residential treatment facility” were added. The definition for school intentionally precludes at-home schooling. The existing references to marijuana will be deleted, but the terminology will be added to the cannabis definitions so they will be subject to the same regulations as cannabis. Cannabis retail businesses would be allowed in the C-2 (General Business), MU-C (Mixed Use Community), MU-R (Mixed Use Regional) and PUD (PC-2 & PMU) districts, subject to the following locational restrictions: a) Along arterial streets only; b) At least 500 feet from any school; c) At least 250 feet from any residential treatment facility; d) At least 250 feet from an attraction within a public park that is regularly used by minors, which are depicted on the “Attractions within Public Park Buffers” map on file with the Community Development Department; e) At least 1,000 feet from each other; See attached “Possible Cannabis Retail Locations” map. Non-retail businesses are allowed as conditional uses in the I (Industrial) district. There are not currently any parcels in the City that are zoned or guided industrial. Consequently, it would take a comprehensive plan amendment, a rezoning, and a conditional use permit to locate a non-retail cannabis business within the City of Richfield. Cannabis event organizers, as an office use only, would be allowed in the S-O (Service Office) and C-1 (Neighborhood Business), in addition to all the same districts as allowed for cannabis retail businesses, listed above (without the locational restrictions). 118 All cannabis businesses are precluded from being home occupations. During work sessions, the Council and Planning Commission had discussed allowing a cannabis event organizer as a home occupation, as it is considered an office use. However, the first round of administrative rules indicates that the OCM will be prohibiting all cannabis businesses from operating out of a dwelling. Therefore, the proposed ordinance was drafted accordingly, and can be revised if rules change. All cannabis businesses are all principal uses, except for cannabis delivery services, which are classified as accessory uses only when subordinate to, under common ownership of, and collocated with, a retail cannabis business. Delivery vehicles cannot occupy required customer parking. All cultivation must be indoors, and transporters are not included. Cannabis businesses cannot be prohibited, however, if the use type (such as outdoor agriculture) is not allowed for any other industry, then it need not be allowed for the cannabis industry. Richfield does not currently allow outdoor agriculture, or any transportation industries, such as shipping facilities, and the proposed ordinance was drafted accordingly. Related to breweries, modifications to production facilities include: consistent with other related definitions, a brewer produces product, a micro-brewery must include a taproom or brewpub, and a micro-distillery must include a cocktail room. D.CRITICAL TIMING ISSUES: An ordinance must be adopted by the end of the year, as the OCM currently expects to issues license pre- approvals in 2024 and licenses in 2025. E.FINANCIAL IMPACT: There is no financial impact related to zoning decisions for cannabis. Public Safety/Support Services will collect registration and renewal fees, as well as a 10% tax from the state. F.LEGAL CONSIDERATION: The City Attorney has been involved in City work sessions and staff conversations to date and will continue to counsel the City accordingly. There is a City-wide moratorium in place on the operation of cannabis businesses until January 1, 2025 or until the City's receipt of an application from the OCM, whichever occurs first. Notice of the public hearing was published in the Sun Current newspaper on September 12, 2024. The Planning Commission recommended approval on September 23, 2024. A first reading of this amendment was held on October 8, 2024. ALTERNATIVE RECOMMENDATION(S): Recommend revisions of the ordinance amendment as proposed.
