1965-3436r~~~ RESOLUTION No. 3436 ~~ RESOLUTION RELATING TQ EASEMENT IN VICINITY t?F HOPE PRESBYTERIAN CHURCFI WHEREAS, by an instrument dated October 1, 1963, The Presbytery of Minneapolis, Inc. granted an. easement to the Village. of Richfield over certain property in the vicinity of 5th Avenue South between 71st and 72nd Streets, and 1~1HEREA5, Hope Presbyterian Church now. desire to build a building over the area of such easement, and 'WHEREAS, The P esbytery of Minneapolis, Inc. is willing to provide a new easement for ci~y owned utilities and. other public utilities and is willing to bear the expense of relocating .any such utility installations in such new easement area so as to facilitate the building of the new structure; NOW THEREFORE, BE IT RESOLVED by the Gity Council of the City of Richfield, Minnesota, as follows: 1. The Mayor and Manager are hereby authorized and directed to c:~zi.: quit claim to The Presbytery of Minneapolis9 Inc. the area des- scribed in the aforesaid easement of. October 1, 1963, so as to relinquish such easement. 2. Such quit. claim sha11 be in exchange for a new easement to be provided by The Presbytery of Minneapolis, Inc., t©gether with an agreement it writing on the part of Hope Presbyterian Church or The Presbytery of Minneapolis, Inc. that all municipality owned public utility lines will be relocated in such new easement area without expense to the city.
