1958-1519r RESOLUTION NO . mss' -RESOLUTION RELATING TO THE ACQUISITION OF LAND, VICINITY 0 F 77TH STREET AND 17TH AVENUE ~~~ BE IT RESOLVED By the Village Council of the Village of Richf ie ld , Hennepin County, I~iinnesota, as follows: 1. It is hereby determined to be necessary and expedient to the public health, safety, convenience, prosperity and general welfare to ac- quire for public purposes and particularly for park purpose, the following described tract of land (comprising approximately 3.65 acres), to wit: That part of the Southeast Quarter {SE4 of the Southeast Qua rter (SEA) of Section 35, Township 28 North, Range 24 WGom~ except the north 10 acres thereof, described as follows: mencing at the intersection of the south line of the north 10 acres of said Southeast Quarter (SE4) of the Southeast Quarter (SE4) with the east line of the- west 3/8 of said Southeast Quarter {SE4) of the Southeast Quarter (SE4), thence south ala~g said east line to the .north line of East 77th Street as now opened aid established; thence east along said north line of East ?7th Street to its intersection with the extension southerly of the east line of 18th Avenue South, as laid out in the plat of Carson's South View Gardens Second Addition; thence north along said east line of 18th Avenue extended to t~}e ,south line of said north 10 acres of said Southeast Quarter (SE4) of tl~e Southeast Quarter '(SE4); thence west along the ' south line of said north 10 acres of said Southeast Quarter (SEA) of the Southeast Quarter (SE4) to the point of beginning, containing 3 3/4.acres, more or less. 2. It is hereby determined that the offer of the owner of said roperty to sell the same to the Village of Richfield for the sum of 4,500 per acre ~s a fair and reasonable off er and the same is hereby accepted in accordance with a proposed earnest money contract which is hereby gieen clerk's file No, 4„ss,~,_ and ordered to be p~.aced on file. 3~ The Mayor, Manager, Finance Officer and Attorney are hereby authorized and directed to. take any and all steps necessary to execute said agreement and to effect a purchase of the above descr~.bed property in accordance -with the terms of such agreement. 4. It is hereby determined to be necessary and expedient to the public health, saf ety, convenience, prosperity and general welfare to acquire for public purposes and particularly for park purposes, the fol- lowing described tract of land (comprising: approximately 3.82 acres ) to wit: That part of the north 10 acres of the Southeast Quarter (SE4) of the Southeast Quarter (SE4) of Section 35, Township 28 North, Range 24 West, lyipg east of the west 3/8 thereof and west of the ~ extension southerly cif the .east line of 18th Avenue South as now' 1a id out in the plat: of Larson' s South View Gardens Second Addition to the south line of said north YO acres, con- taining 3 3/4 acres, more or less s.'~J1:_..Y _._:: .~:_ 5. It is hereby determined that the offer of the owner of. said roperty to sell the same to the Village. of ,Richfield for the sum of. $4,000 per acre is a fair and reasonable offer and the. same is hereby accepted in accordance with a proposed earnest money contract--wh-i~ch is hereby given clerk's file No. 48_ and ordered to be placed on file. 6. 'The Mayor, Manager, Finance Officer and Attorney are hereby authorized and directed to take any and all steps necessary to execute said agreement and to effect a purchase of the abovs describe.cl property in accordance with the. terms of such agreement. The purchase prices of the tracts hereinabove mentioned and all costs and expenses incident to the acquisition of said ttacts in accor- dance with the terms of this resolution shall be paid from the Park Fund to be covered by permanent transfer of funds from suprlus monies cf the Liquor Store Fund.
