RESOLUTION NO . 14~
RESOLUTION RELATING TO LEGAL DESCRIPTION ON SPECIAL
USE PERMIT
WHEREAS, the Village of Richfield, on February 14, 1955, by authority of
the Village Council granted a special use permit to Alex Leitchman for
operation of a trailer court on certain property located on Cedar Avenue
between East ?6th Street and East ?7th Street extended and known as Par-
cel 5100, Plat No. 448361, which special use permit was granted in a
Special Use Permit Agreement executed between Alex Leitchman and the
Village of Richfield dated February 14, 1955; and
WHEREAS, it appears that application for said special use permit waa duly
filed with the .Village Clerk by Alex Leitchman, which application was pre-
sented to the Council on August 9, 1954, and that said property was cor-
rectly described is said application as follows:
South 1/2 of the North 1/2 of the S.W. 1/4 of the S.w. 1/4
of Section 36, Township 28, Range 24; and
WHEREAS, it appears that subsequent to the filing of said app]~ication,
through inadvertence, mistake and typographical error, the property was
thereafter sometimes described as being located in nSection 26~~ instead
of nSection 36n, and that in said special use permit agreement dated
February 14, 1955, said real property was also incorrectly described as
The South One-Half (S2 of the North One-Half (N2 ) of the
Southwest Quarter (SW~ •of the Southwest Quarter (SW~) of
Section Twenty-six (26 , Township~Twenty-eight (28), Range
Twenty-four (24), according to the U. S. Government Survey
thereof ; and
WHEREAS, it further appears by the minutes of the Council meetings and
otherwise, that at alI times herein the Village Council aqd all Village
Officers concerned fully understood the correct location of the property
for which said special use permit was to be issued, and,was issued, and
understood that the property concerned was located on Cedar Avenue between
East 76th Street and East ?7th Street extended, and that it was also known
as Parcel 5100, Ylat No. 44836, and that throughout the council proceedings
with respect to said application, the property was correctly described and
referred to as being located on Cedar Avenue between East ?6th Street and
East 77th Street extended, and that sketches showing its proper location
were at various times referred to and made a part of the application, and
that in truth and in fact said property for which said use permit was
granted and intended to be granted, is correctly described as being lo-
cated in Section 36,
NOW, THEREFORE, BE IT RESOLVED, that in all instances in the files aad
records of the Village of Richfield concerning the application for said
special use permit, the action taken thereon, and the granting thereof,
where in the legal description of said property, the same has been
described as being in nSection 26n, that said records be, and hereby are
amended so that the same shall be correctly referred t.o as located in
"Section 36rt.
BE IT FURTHER RESOLVER, that -the des.c,ription of the property as it ap-
pears in ~ the s pecia,7- us.e per~att .contained in the agreement dated February
14, 1955, between .the Village of .Richfield andAlex Leitchman be, and
it hereby is .amended ,so that the same shall ,dread as follows:
