1957-1263r~~~ RESOLUTION NO« 1263 RESOLUTION RELATING TO THE DIVTwION AND AD,jUSTA1BNT OP SPECIAL ASSBScP.fBNT5 BB IT'RBSOLVED by the Village Council of the Village of Richfield, Henne- pin County,, Minnesota as follows: The Village Manager is hereby authorized and directed to make divisions and adjustments of special assessments for public improvements in the follow- ing situations in accordance with the followings 1. A parcel of land is located on a corner. Either a trunk sanitary sewer or a lateral sanitary sewer are constructed along one side of the par- cel, resulting in a lateral assess~hent. Later a lateral sewer is constructed along the other side of the parcel, resulting in a lateral assessment. The second lateral assessment shall be computed by using the number of frontage feet which remain after subtracting the number of feet which were considered benefited in the first assessment, Tf the tract is divided after the first assessment, the front footage nearest the street in which the first sewer was constructed shall be deemed to be the frontage against which the first assessment was made. 2. A parcel of land is privately owned and is assessed for a public improvement. Later ail or a part of the parcel is acquired by the Village for purposes other than for streets. The assessment against the parcel or part thereof so acquired shall be cancelled, to the extent unpaid. 3. A parcel of land is assessed for public improvements. L,a.ter a part of the parcel is taken'by the State of Minnesota for highway purposes. Be- fore making a division, the village shall be paid that p roportion of the assessment which is equal to the proportion of land taken. The balance of the sanitary sewer assessment shall be allocated proportionately against the land remaining after the taking. 4. A parcel of land zoned other than residential is assessed for a public improvement. Later fractional parcels are conveyed for street widen- ing easements. No adjustment shall be made in the special assessments by reason of the street easements. 5. A parcel of land is assessed for sanitary sewer trunk line on an acreage basis. The parcel is later divided. The assessment shall be divided proportionately2t~'~ng-the several resulting parcels. 6. A parcel of land is assessed for only one sanitary sewer stub line. Two were installed. The parcel is large enough to be divided into -two so that one stub may serve each resulting parcel. The cost of the omitted stub shall be added to the original assessment. The amount of installments pre- viously paid shall be deducted from the new total assess~ent, and the balance shall be assessed proportionately, accordi ng to frontage, between the two resulting parcels for the balance of the assessment term. -2- Resolution # 1263 ?. A parcel of land is assessed for two sanitary sewer stub lines. (~iy one is actually ir-stailed. The assessment as to one stub shall be cancelled. The parcel is divided into lots of appronimately ec}ual size. As to the lot actually served by the stubs this idt shall be assessed for the cost of the stub. Ta compu~ing this assessment, credit shall be given for the install- ments already paid for one stub.. As to the lot not served by the stub, a re- fund shall be given for any installments already paid for a stub. 8. A parcel of land is located on a corner. The parcel is assessed for lateral sanitary sewer by reason of being adjacent to a trunk surer main. Latar.a lateral sanitary sewer is constructed along the other side of the par- celp and an assessment is made for this lateral sewer acing the full frontage of the parcel as a basis for computing the assessment, The second assessment shall be reduced by the number of frontage feet arhich were considered ~nefited by the first ~!sressment, and a refund made on any overpayments made on the second assessment. 9. A lot is assessed for a sanitary sewer stub line serving the lot. Later the lot is divided and combined to adjacent lots s~ that the stub line is not likely to be used.
