RESOLUTION AUTHORIZING EXECUTION OF
STIPULATION FOR SETTLENIDNT OF MAC GRBGOR AND DAVIS
AGAINST THE VILLAGE OF RICHFIELD, MINN.
BE IT RESOLVBD BY the Village Council of the Village of Richfield,
Hennepin County,. Minnesota as follows:
1, A proposed Stipulation between MacGregor and Davis, Archie
tects and Engineers and the Village of Richfield providing for the
settlement of the la~rsuit pending between such parties and the
Village of Richfield, is hereby given Clerk's Pile No. 4323 and
ordered to be placed on file.
2. Said proposed stipulation is hereby approved and adopted
by this Council as a fair and reasonable dispositiorn of such litiga-
tion and of all other outstanding claims or portion of claims exist-
ing between the parties th@reto and the attorneys representing the
village s.n such litigation, the village mayor, manager, finance of-
ficer and attorney are hereby authorized and directed to take what-
ever steps map be necessary to effect such settlement in accordance
with the terms of said proposed stipulation«
The sum of $76,000 which is payable by the Village of Richfield
pursuant to said stipu2a.tion is hereby determined to be properly
chargeable against and payable out of the following funds in the
following amounts:
General Pund - Contingency Appropriation $35,017.56
Sanitary Sewer Improvement 1Vo. 1 Pund 40,982.44
