UE IT ~~,.SOLVED BY T~~E VILLAGE COUPICIL of the Village of
Richi field, iiennepin County, Minnesota, as follows:
1. Axel ~~:ieisen and Vera Nielsen, residing at 1415
'.hest 76th Street, Richf field, Y°innesota, having instituted
an action against the Village for damages alleged to have
occurred to their property by reason of the construction
of sanitary sewer and regrs.ding of ?6th Street adjacent
to their property and said ;persons having now agreed to
dismiss their action against the iTillage t~~ith prejudice '
anci to provide the Village with a release from all claims
arisin; out of such work by the payment of $3,700.00, it
is hereby f aund and determined that said offer affords a
reasonable basis for the settlement ~a.nd disr~~issal of a
claim against the Village ana such offer is hereby accepted.
2. The ~Jillage i~iayor ~ Manager, Finance Officer and
Attorney are hereby s.uthorized and directed to tal.d such
steps as Wray be necessary to effect such settlement and
dismissal on the aforementioned basis and to execute such
docur:.ents as may be necessary in connection therewith.
3. The aforementioned sum is hereby found and de-
terr~ined to be an expense, incurred as rho result of and
by reason of the construction of the intercer5tor sanitary
sewer system of this Village and said sum shall therefore
be charged against and paid out of the Sanitary Sewer
Improvement No. 1 Fund.
