1956-1136rRESOLUTION N0. 113b "r: 'r RESOLUTION AUTHORIZING PURCHASE OF RIGHT OF WAY FOR EAST 77th STREET FROM THIRD AVENUE TO PORTLAND. BE IT RESOLDED Hy the Village Council of the Village of Richfield, H,annepin County, Minnesota as follows: I. Tt is hereby determined to be necessary and expedient to the public health, safety, convenience and general welfare to acquire for street purpos3s, easements across the following described tracts of land in the Village of Richfield, to wit; The South Thirty (30) feet of the North half (I~~) and the North Thirty (30) feet of the South half (S~) of the Southeast Quarter (SE~) of the Southeast Quarter (SE~) of Section 3t~, Township 28, Range 24, and That part of the South half (S~) of the Southeast Quarter (SEA) of the Southeast Quarter (SE~) of said Section 3li, which is North of the South Thirty-six (36) rods thereof between the East and West right of way lines of Fourth Avenue extended S^uth from Nicollet Garden Lots Third .Addition, t and That part of the South half (S~) of the Southeast Quarter which is Northoofhthe South Thirty~sixf(36) roedstther®of between the East and West right of way lines of Fifth Avenue extended North from Ranft~s Addition. 2. The owner of the above described tracts having offered to convey such easements to tl~s Village of Richfield for the sum of $8,000, said offer is hereby determined to be a fair and reaso~iable offer and. the same is hereby accepted. ' 3. The Mayor, Manager, Finance Officer and Attorney are hereby authorized and directed to take such st®ps as may }~ necessary to effect the purchase of the aforementioned easements in accordance with said offer. !~. AlI costs and expenses incident to the purchase of said easement shall, be charged against the Village Pro~eet No. 329 Construction Fonda 5. In addition to the aforementioned compensation for the acquisition of easements, the village may make provision for the payment of damage to crops which are destroyed in the event that the village enters upon the premises before such crops are harv~-stsd.
