It is hereby determined that on June 21, 1954, a tor- rential rainfall of unuse~all~r heavy intensity occurred in :lichfield and the surround in area; that the run off of sur- face water resulting from this downpour created a serious pooling anti flooding of water in tae vicinity of 71st Street aad Chicago Avenue, resulting in this damage •~o a number of residences and the collapse of several house foundations; that village employees were called out to deal with this emerggency and that such effiployees removed manhole covers on the 42ot sanitary sewer main on Chicago Avenue and drained storm surface water into the sanitary sewer line as an emer- gency measure to relieve the flooding problem; that of ter the storz~ waters receded, an investigation was made which showed that some of the joint filler compound between sections of the sanitary sewer in that vicinity was pulled out, rubber gaskets wero displaced and an accumulation of sand had been•• deposited in the sanitary sewer pipe; that rhelps drake Co., Inc..wlaieh was then engaged in tbie construction of sanitary sewers in the village of Richfield, was ordered by village officials to clean out the sanitary sew~t line and repair the same as an emergency measure in order to avoid an immediate health and sanitary hazard. 2. That the claim of Phelps-~7rake Co., Inc. in the amou~at of $2,055.1? for such emergency work, which has been presented to this council. in the form of a verified claim, is a just claim for ~:mergency services Rnci the same is hereby allowed. 3.
