1956-1016rRESOLUTION N0. 1016 RESOLUTION RELATING TO ASSIGN~~1T OF PROCEEDS OF TERRY EXCAVATING CO. CONTRACT (Village Projects No.s 26lt, 268, 269, 271, 272, 275 and 290) TO FIRE ASSOCIATION OF PHILADELPHIA WHEREAS, on July 28, 1954, a contract was executed by and between the Village of Richfield and Wm. V. Terry Excavating Co., Inc. for the construction of Richfield Village Projects No.s 264, 268, 269, 271, 272, 2?5 and 290, and WHEREAS, a controversy thereafter arose as to which of several parties might be entitled to certain of the monies payable by the Village of Richfi©ld under said contract, as more fully appears in Resolution~No. 880 of this Council and WHEREAS, pursuant to the. provisions of said Resolution No. 880, the dis- puted funds have-~ been deported in the District Court of Hennepin County and all parties have been notified of such fact as directed by order the said Dis- trict Court, and WHERE~iS, the Fare Association of Philadelphia, one of the claimants of said ~~ funds, now requests the consent of this Council to its assignment, which has heretofore-been designated as Clerk's File No. 3152. -NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Richfield as follows: The Village of Richfield herewith gives its consent to the assignment, known as Clerk's rile No. 3152, as requested by the Fire Association of Philadelphia. Such consent is given, in cooperation with said surety, for whatever legal ef- fect is may have, this Council still being in doubt as to the rights of the several claimants to the aforementioned disputed funds now on deposit with the Hennepin County district Court.
