1955-778r46 RESOLUTION N0. 778 RESOLUTION AUTHORIZING C ONDEMIV~-TT ON {~' CERTAIN LAND F ~ STREET PURPC6ES (WEST 66TH ST . ~,.-PLF~+SAIVT T 0 PILLSBURY) BE IT RESOLVED BY THE VILLAGE COUNCIL of the Village of Richfield, Hennepin County, N~nnesota, as follows: 1. It is hereby determined to be necessary and expedient to the public health, safety, convenience and general. welfare to .acquire for street purposes, the following described parcels of land in the Village of Richfield, Hennepin County, State of N~.nnesota, to wit: T he Northerly 10 ft, of the S t ly 1i.3 feet of the following; That part of the south 53 1/3 rods of the SE4 of the 114 of Sec.. 27, Twp. 28, R.. 24, Hennepin County, l~ii.nnesota, described as follows ; Go~nenci.ng at a point on the south lcine of the above described. tract, which is 25 ft« east of the SW corner thereof; thence north parallel with the west line of the above described tract 660.0 feet; thenoe East parallel with the north line of said tract 303«7 ft; thence soutd~ 660,0 ft. to a point in the south line of said tract which i.s 302.9 ft. east of the point of beginning; thence west 302.9 ft. to the point of be- ginning, except the north 175«0 ft.i according to the U. S. Govt. sur~tey thereof. 2. That the Village Attorney, Mayor, N6anager• and Finance Officer are hereby authorized and directed to take any and all steps necessary to ac- quire aneasement for street purposes over and across said parcel of land by eminent domain proceedings. 3. That all costs, expenses and awards. in connection therewith shall be paid out of the Construction Fund, V.. P~ X250. ~.. In the event that a voluntary purchase of that part of the above described. property which is occupied by the Clark Oil and Refining Corporation can be effected, the aforementioned officers are hereby authorized and directed ~ effect such purchase on the following basis: a) The Clark Oil and Refining Corporation shall be entitled to revise the building plan, reconstruct and r esurface their service station in accordance with the blueprint entitled; ~~Clark Service Station - W. 66th St. Fr. Pillsbury live., Richfield, Maxinesota~~, copy of which is on file and of record i.n the office of the Village Clerk. C-308t~ b) Two approaches from West 66th St. into the station shall be per- mitted to have a width of 1~0 feet; one approach into the station from Pillsbury Avenue near the front of the property, as shown on said blueprint may be as'much as !~0 feat i.n width. _ 4`7 Resolution IVo. 7?8 ~•ge c) The concrete paving traffic divider shall contain a cross over so as to ~rmit a West approach into said stat3.on for East bound traffic, such cross over to be approximately the saw width a~ the approach into the station and 10- cated directly in front of it. d) For the cast of remodeling said station, including only such charges as are attributable to the change in the width of the street as re~u•ssted by the Villa.Je of Richfield, the Clark Oil and Refining Corporation sha11 be reimbursed in the amount of ~1~, 785 a00. e) For the purchase of the land, the owners thereof sha11 be paid in tY~a sum of ~p3, QO0.00. 5a In the event a voluntary purchase of the right of way as specified in p~~-agraph ~. is effected, the Village Manager„ Finance Officer, N~ayor and Village Attorney axe authorized and directed to take any and all. steps necessary to effect such purchase. The payment of the purchase price, aJ_l.- costs and ex- pens:.s in connection therewith shall be paid from Villa ge Project No. 250 Construction Fund 6.
