RESOLUTION At3TH~IZING REIMBURSEMENT TO
POLICE C~'FICER FOR SNTTIE1JiE1t1T C~' JUDGMENT
WHERF~iS, On January 10th, 1955, Roger Osberg, a police officer of
the Village of Richfield, in the pursuit of his duties as a police officer,
caused damage to the property of Mr., Lawrence C. Seims at 5109 @ueen f~venue
South, 1linneapolisz Minnesota. and to the property of Arthur H. Peterson at
5415 Queen.~venue South, Minneapolis, Minnesota, and
TrdHEREd1S, Said persons instituted legal action against said officer
and obtained judgments against him in the Conciliation Court of the City
of Minneapoldis in the amounts of X39.63 and X36.00, respectively.
NQnT, THEREFORE, BE IT RESOLVED By the Village Council of the
Village of Richfield as follows:
l~ That it i.s hereby determined that the liability which was in-
curred by said Officer Roger Osberg, was so incurred while he was acting
in a matter in which this municipality had an interest, i.e, in the pursuit
of a stolen car; that he was then acting in discharge of a duty imposed and
authorized by law; and he was acting in good faith.
2 a That by reason of the foregoing determination it is in the best
interest of the municipality in securing the public health, safety, conven~
fence and general welfare, to reimburse said officer for the liability which
he has incurred..
3. That said reimbursement shal3. be made to said Roger Osberg or
upon receipt of his written authority, to the Conciliation Court of the
City of Minneapolis on his behalf.
~.. That the sum necessary for such reimbursement shall be paid out
of the budget of the Legal Department as an item in the nature of a settle
claim.
5. That the Mayor, Manager, Finance Officer and Attorney are here-
by authorized and dixected to take such action as is nedessary to effect
such reimbursement.
