RESOI.~UPION PROHIBITING AND ELII~LIN~TING ENCR~CH~IENT

WF~REAS, the Village of Richfield has. approved the plans and specifica-
tions for the improvement of that part of Trunk Highway No. 52 renumbered as
Trunk Highway No« 100 within the corporate limits of the Village of Richfield
from Penn Avenue to Lyndale Avenue; and
WHEREAS, in order to obtain Federal aid in the construction of said
Trunk Highway No« 52 renumbered as Trunk Highway No•. 100 the Bureau of Public
Roads requires the assurance that the Village of Richfield t~.]1 not suffer any
encroachment of any nature or kind whatsoever on the right of way of said
Trunk Highway No•. 52 renumbered as Trunk Highway No. l00 within the corporate
li~nri.ts of the said Village of Richfield; and
WHFRF,AS the Coiranissioner of Highways desires in the interest of public
safety that alli parking of vehicles on said trunk highway be parallel with the
curb and at least 20 feet from any crosswalk..
NOW, THEN, BE ]T R~OIVID that said Village of Richfield does hereby
agree and covenant that it will never permzt,or suffer, within its corporate
limits, any encroachment of any kind whatsoever, including curb gas pumps and
gas stations billboards or other structures of any kind whatsoever, upon the
right of way of Trunk Highway Number 52 renumbered as Trunk Highway No.. 100
and to the above end said Village of Richfield hereby agrees that it will never
. issue any licenses permit, or grant, or give any leave or liberty or ar~q other
consent of whatever form for the construction or maintenance of any encroach-
ment whatsoever, including curb gas pumps and gas stations,, billboards or other
structures of any kind whatsoever upon said right of way; and that said Village
of Richfield wi11 cooperate insofar as possible to eliminate existing encroach-
ments constituting traffic hazards and wi11 further take any necessary action to
eliminate any encroachment that may hereafter exist on said trunk highway right
of wayy and
BE IT FURT HQ~t RE5 OLVID that said Village of Richfield does hereby agree.
to require the parking of a]1.vehicles on said trunk highway to be parallel with
the curb and at least twenty (20) feet from. any crosswalks on all public streets
intersecting said trunk highway within the corporate limits of said Village of
Richfield.
