A RESOLUTION PROVIDING PROCEDURES
FOR HARTDLING ZONING PETITIONS
BB IT RESOLVED, by the Village Council of the Village of Richfield, that until
further action of this Council, the following practices shall be observed in the
processing of rezoning and special use permit petitions:

by the owners of not less than fifty percent of the land proposed to be re$one
and by the owners of at least fifty percent of the land within 300 feet of any part
of the land proposed to be rezoned. A petition fora special use permit shall be
signed by the owners of the land upon which the permit is sought, but need not be
accompanied by the signatures of owners of land within 300 feet.
2. Such petition shall~prov.ide the following information:
A. The legal description of the property in question.
B, The present zoning classification of such property and the proposed zoning
or use of the property.
C. The names and addresses of all persons or parties having an interest in
the land in question.
D. If the petition is for rezoning, the legal description of each lot, piece
or parcel of land, the o~rners of which are joining in the petition. Such
legal descriptionsola~ whereasuchsowners have signed thelsamepear on the

E. If the land in question is open development land and rezoning is sought,
or if a special use permit is sought, the petition shall state the par-
ticular use proposed to be made of the property and the petition shall
be accompanied by such other information as the Village Engineer may
reasonably require concerning the manner in which the property is to be
improved and used.

3. Any such petition shall be accompanied by a fee of hand such other ex-

~. Such petition shall be filed with the Chief Inspector who shall refer the
same to the Engineers and the Village Engineer shall take the following
action with respect thereto:
A. A plat of the property in question and of the area within 300 feet sha71
be prepared, showing the o;Amership of each of the individual parcels of
land within 300 feet as indicated by the records of the Village Assessor;
'provided that the area within 300 feet need not be shown on~a plat re-
lating to a special use permit unless deemed advisable by the Vi].1age
Engineer.
B, The zoning of the area shown on the plat shall be noted.
C. On the rezoning plat the percentage of land within 300 feet of the land
in question, the owners of which have joined in the petition,~shall be
computed and noted. Public land shall not be included in such computation.

D. If it is recommended that conditions be imposed upon the granting of the
permit, such conditions shall be noted.
E. If it is determined that the petition is adequate to meet the foregoing
requirements it shal]. be referred to the Village Manager who shall cause
a notice of hearing to be prepared, including a proposed date of hearing on
the petition.
F. If the Vil7.age Engineer shall determine at the outset that the petition
lacks sufficient signers he shall so inform the Village Manager, and shall
take no further action with respect thereto. The Manager shall thereupon
notify the petitioner-owner of the land in question and the. Council, of
the insufficiency of the petition.
5,. After compliance with the foregoing, the pErfected petition and the in-
formation and recommendations relating thereto, shall be presented to the
council and a public hearing shall be held thereon.
6. after public hearing, if the petition is to be granted conditionally, all
such conditions shall be reduced to writing and agreed to by the owner of
the land in question before the petition shall be granted by the council.
7. Rezoning shall be effective only upon publication of the ordinance ef-
fecting such change.
8. A special use permit shall be effective only when authorized by the co~cil
reduced to writing and signed by the Mayor and Manager.
9. If any such petition be denied, a letter to the owner of the land in
question informing him of such fact, shall be sent by the Village Manager,
whenever practicable.
10. Notwithstanding the foregoing, rezoning proposals may be initiated by the
council as provided by ordinance. In such event the foregoing procedures
shall be followed insofar as the same are applicable.
11. The foregoing procedures shall be under the supervision and direction of
the Village Manager.
