RESOLUTION AU'PHORIZING SETTLEMENP OF
CONDEMNATION PROCEEDING
. WHEREAS, this Village has instituted eminent domain proceedings against
certain proper~Ly, hereinafter described, belonging to Fred H. Buttell and
Anne V~ Buttell, to acquire a ~.ght of way between 5th Avenue and Portland
A~tenue eri 2bth Street, as part of Village Project No. 19l~, and
WHEREAS, the condemnation commissioners have mgde an award of X1,050
for the land so taken, and
WHEREAS, an appeal from this award has been taken by the said owners
of said land, and
WHEREAS, the owners of said land have now indicated a willingness to
convey said land to the Village of Richfield for the sum of $500 upon -the
condition that there b e no special assessment levied against the abutting
property of said persons .by reason of the making of said Village Project
No. 194, and that the tool shed and swing on said right of way be moved by
the Village, to a location on their abutting property, arxi
WHEREAS, it appears that said offer is a fair and reasonable one and
should be accepted on behalf of the Village of Richfield
NOGJ THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Richfield, Hennepin County, Minnesota, as followsg
1. That the Village Mayor, Manager, F~,nance Officer and Attorney
are hereby authorized to take such action as mar be necessary to complete
a purchase pf ~a3d r3.ght of war on the aforementioned terms, said proper~r
being legally described a~ follows, to.,wts
The North Thirty (30) feet of the East One-half (E2~ of the
North Three (N9) acres of the Southeast quarter (SE4)of the
Southeast quarter (SEg) of Section 3l~, Township 28, Range
24, except the West One Hundred SiXty-four and two tenths
(GJ' 164;.2 feet thexeof, according to the Government Survey
of said Sections Township and Range.
