RESOLUTION REL~TTNG TO SETTLEMENT C~
HAVERSTOCK V. RICHFIELD
WHERE~aB, the Village Council of the Village of Richfield in l~l author-
i~ed an offer to purchase Lots ~, 6, 7, 8, 9, 10 and 11, Block 2, Rayts
Lynnhurst Addition for the sum of ~1,l~OOs00, and
WHEREAS, the Village was thereafter advised of the actual and potential
claims of the State of Minnesota to said lots by reason of their being part
of the bed of a public lake, and as a consequence did not purchase said
lotss and
WHEREAS, the person claiming to own said lots thereafter brought legal.
action aginst the Village seeking to compel such purchase, or for damages,
and
WHEREAS, the said legal action wises doubtful questions of law and
facts ggi.ving rise to possible prolonged litigation of uncertain xesult, and
WHEREC~S, the said alleged owner has now offered and agreed to dismiss
said legal action and convey said lots to the Village for the sum of
X635.00, subject to the rights of the State of Minnesota:, and with the
Village assuming accrued taxes and recording expenses, and
W.EIERF,~S, said offer appears to be a fair ax~1 reasonable offer;
NOW THEREF~tE BE TT RF~OLVED, that said offer be and is hereby' accepted,
and that the Mayor, Manager, Finance =~3fficer and Attorney are hereby author-
ized to take such steps asmay be necessary to effect said settlement.
