'IITLED: ~~KEt~ ET AL V. THE VILLAGE tB' RICHFIELD."
~iIHEREAS, Theodore Kemp and his wife, Nellie F. Kemp,, have instituted legal
action against the Village of Richfield for damages to their property, in two
separate l.~rsuits against the Village, for changes in the grade of 71~th Street
at its intersection .with 1~th l~venue in 1947 and again in 19?~9, and
6~RElbS, the Village of Richfa:eld~has~ had its appraisal of the damage to
said property made on behalf of the Village, and
'WHERE~.,y it has. been determined by a court of competent jurisdiction
that there is damage as a consequence of the 1949 street regrading in the
amount of $750, and '
WHEREl~, the said parties have offered to accept the sum of $950 in full
and complete settlement of all claims against the Village by reason of such
street regrading, and
'WHEREIN, this• Council is advised and believes that this would provide a
just and equitable settlement of the claims of said persons;
NO~d THEREFORE, BE IT RE5OLVED by the Village Council of the Village of
Richfield, Hennepin County, Minnesota, as follows:
1. That it 3s hereby determined that the payment of the sum of $950.00
to Theodore B. Kemp and Nellie F. Kemp for the settlement of their claims
against the Village of Richfield as. aforesaid. is a fair and equitable settle-
ment and the same is hereby accepted.
2. That the Village Manager, Mayor, Finance Officer and attorney are hereby
authorized and directed to effect such settlement aud•-to ado ~uch,.aets and execute
such instruments as may be necessary to effect the same
