Highway No.. 5, thrQUgh the Village of Richfield, as- shoat upon the genera. layout
plan which is presented herewith anal made a -part hereof and
WHEREAS, said Commissioner of Highways propose to make certain improveetents
in said trunk highway Through said villas of $i.chfield and is designating the
general layout and point ofaccess to said trunk highway as shown on the. general
layout plan attached hereip, ta~tich said plan is presented herewith and made a part
of this resolut3.on, and
WHEREAS, ss~i.d pm~ect an d said plan, 3n order to participate in federal f~rtds~
require the. approval of the Federal Bureau of I~ablic Roads, gnd
WHEREAS, The Federal-Bureau of Public Roads requires as a condition precedent
to such approval, the assurance and covenant. that the V311age of Richfield will
not lic~tse or permit hereafisr~ say ~croaohment of any aa.tatre~ including curb
• gas pumps or gas stations or 'txi.llboards or other structures of aay kind whatsoever

whatsoever inaluding gas pumps or gas stations or billboards or other structaares of
. any kind whatsoever, now or hereafter existing in or upon t~ said Truak Higlmray
right of ways and
WHEREAS, said C~:ss3.oner of Highways desa.res~ in the interest of public
safety that all parking of vehicles on said Trunk H3.ghway be parall.sl with the
curb and at least 2O feet from any crosswalks at a1.1 public streets intersecting said
Trunk High~,y within the corporate limits of said villages and

vehicles be parallel to the curb;
NO~d, THERF,FORE, BE IT RF5OLVLD, that said general layout plan for ~ locat3.an~
improvement and desigcaation of points of access to said iaunlc high~.y through
said village be and t31e s atae is hereby approved; and
E~ YT ~tIRTHER RESOD that when plus and s~c~.fications of said improve-
marts on Trunk High~y loo. 100-5 have been completed and submi tied to this Council
in accordance with the above proposals the same wall be approved by further
resolut3.on; as to general layout plan for the locat3.ari~ improvement and designation
of access points to said txunk highway provided that detailed design features of
the cros-trzict~.on are sat3.sfactory to the ~urici.l~ arat,
BE IT FURTHER REStl~9ED, that said village does hereby agree and covenant
that it will never permit or suffer, within its corporate lim3.ts, arty. encmach~-ent
of any kind whatsoever, including curb gas pumps and gas stations, billboards or
other structures of any kind whatsoever, upon the right of way of Trunk Iti.gh~ray ~To•
100-5 as shoes cal said plans and that to tie above end said v3.11age hereb3t agrees
that it w3.11 never issue any lioense~ permit, or grant, or give any leave or
liberty or any other consent of whatever form for the eonstau.ct3an or maint~aaee
of any encroachment whatsoever, including curb gas pumps and gas stations, b3.1].boards
or other stsuctaares of an~r kind wha.t~oever, upon said right of may; and that said
village will cooperate insofar as possible tp elim3.nate ex3.st3ng encroachments
const3.tu13.ng traffic hazards and will further take arty necessary action to eliminate
any encroacht~ent that may hereafter e~3.st on said Trtmk Highway right of way; and
BE TT FURTHER RffiOLVED, that said village dc~s hereby agree to requite td~
parking of all icehicles on said Trunk Highway to be parallel with the curb and. at
least 20 feet from any crosswalks at all public sta~eets intereect3ng, said Trunk
Highway within the corporate limits of said village.
