RESOLUTION RELATING TO SETTL~NT OF MULROY
VERSUS VILLAGE OF RICHFIELD
T~HEREAS, Matt B..Mulroy has instituted legal action against the
Village of Richfield for damage to his property resulting from a change
in the grade of Penn Avenue in this Village, and
WHEREAS, said person has provided the Village of xichfield with an
affidavit as to the valueof property damaged or destroyed in substantiation
of his said claim, and
WHEREAS, the Village of Riehfie ld has itself had an appraisal of
damage to said property made on behalf of the Village, ~ d
WHEREAS, this Council is advised that if there is damage to the
property of said person as a result of the acts of the Village as
claimed, this Village is liable for any such damage, and
WHEREAS, this Council believes that ajust and equitable settlement
of said claim has been negotiated;
NOW THEREFORE BE IT RESOLVED~by the Village Council of the Village
of Richfield as follows:
1. That it is hereby determined that the payment of the sum of
$2,080.00 to Matt B: Mulroy for the settlement of his claim against the
Village of Richfield is a fair and equitable settlement and that the
same is hereby accepted.
2. That the Village Manager, Mayor, r'inance Officer and Attorney
are hereby authorized and directed to effect such settlement and do such
_ acts anal execute such instruments as may be necessary to effect the
same..
