Smith, husband and wife, have brought legal actiom against the Village of~Richfield in which they.alaim damages caused. by depreciation 3n their property by reason of raising the eleva-t~.on of the street in front of their property, and ~~TERS, this Council is informed that if damage fiA their pznperty has been caused by a change in the elevation of the street as alleged by them the Village of Richfield can be held liable for such damages and WHEREAS, the Village of Richfield has employed two professional appraisers to appraise the dar~.ge by way of d®preciati~ to the properi~r of sa~.d claimants which damage has been appraised at X500 exclusive of damage caused. by flooding, which appraisal is substan taally less than the deprecia~ti.on clairi-ed by said persons, acid WHEREAS, the Village of Richfield has been provided with an affidavit by said claimants to the effect that they have sustained damage to property from flooding in the amount of x$38. exclusive of their ors. time and labor, and . Y~HEREAS, it now appears that an amicable settlement of the claims of said persons can be ,reached on the basis hereinafter set forth, which. this Council believes to ~ a fair and reasonable settlement Ned THEREF.QRE, BE IT R.E50LVEID by the Village Council of the Village of Richfield as followss 1. That it is hereby determined to pay the sum of ~90fl. to Harold V. Smith a-nd Ruth L. Smith in full and complete settlement of their above mentioned claims and that such payment constitutes a fair and equitable settlement of said claim. 2. That the. Mayor, Managers Finance Officer and Attorney are hereby authorized and direatsd to take any and a]1 steps necessary to secure a settlement of said claims and lawsuit on the basis aforesaid.
