RESOLUTION RELATING TO SETTLEP~NT OF
MacFARLANE VS: VILLAGE OF RICHFIELD
WHEREAS, William W, MacFarlane and Florence E. MacFarlane husband and
wife, have brought legal action against the Village of Richfield in which they
claim damages caused by flooding of their property and further damages caused
by depreciation in their property by reason of raising the elevation of the
street in front of their property, and
WHEREAS,~this Council is informed that if damage to their property has been
caused by a change in the elevation of the street as alleged by them the Village
of Richfield can be held liable for such damage, ~ and
WHEREAS, the Village of Richfield has been provided with an affidavit by
said claimants to the effect that they have sustained damage 'to property from
flooding in the amount of ~1,387.1~9 exclusive of their own time and labor, and
TnIHEREAS, it now appeaxs that an amicable settlem~.nt of the claims of
laid persons can be reached on the basis hereinafter set forth, which this
Council believes to be a fair and reasonable settlement.
NUW THEREFORE BE IT RESOLVED by the Village Council•of the Village of
Richfield as followss
1. That it is hereby determined to pay the sum of X800 to William W.
MacFarlane and Florence E. MacFarlane in full and complete settlement of their
above mentioned claims, and that such payment constitutes a fair and equitable
settlem+~nt of said claim.
2. That the mayor, manager, finance officer and attorney are hereby
authorized and directed to take any and all steps necessary to secure a
settlement of such claims and lawsuit on the bass aforesaid.
